AMENDING THE TERMS OF USE FOR THE DUSK TO DAWN SITE AT
4060 WEST AMAZON DRIVE AND REPEALING ADMINISTRATIVE
ORDER NO. 53-18-02.
The City Manager of the City of Eugene finds that:
A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002, the
City Manager is designated as the administrative head of the City and is authorized to enforce all
ordinances of the City.
B. On November 2' ), 2015, Ordinance No. 20559 was adopted approving the Dusk to
Dawn overnight sleeping pilot program. That Ordinance provided that sleeping overnight at
designated sites would be permitted upon Council's approval of a site and the City Manager's
adoption of an administrative rule governing use of the site. Ordinance No. 20559 was amended
on March 14, 2016, by Ordinance No. 20563 to allow the City Manager to consider the seasonal
sunset in determining the hours of permitted overnight sleeping at designated sites.
C. On March 1, 2017, Ordinance No. 20576 was adopted removing the sunset date
from the Dusk to Dawn Program. On March 29, 2017, I issued Administrative Order No. 53-1.7-
03-F. adopting permanent rules and regulations for the Dusk to Dawn Overnight Sleeping
Program.
D. On January 10, 2018, the City Council approved a site at 4060 West Amazon Drive
as a site for the Dusk to Dawn overnight sleeping program. On January 22, 2018, 1 issued
Administrative Order No. 53-18-02 governing use of the site. Prior to issuing that Order, I had
adopted Administrative Order No. 53-18-01 implementing an emergency Dusk to Dawn Rule
amendment that allows the City Manager to authorize families with children to use a Dusk to Dawn
site.
E. It is necessary to amend the ten -as of the use for the West Amazon Drive site to
allow more people to use the site.
NOW THEREFORE, based on the above findings, I order that:
1. The � terms of use for the 4060 West Amazon Drive Dusk to Dawn overnight
sleeping site are amended to provide as follows:
Up to 20 families may sleep overnight at 4060 West Amazon Drive pursuant to the Dusk
to Dawn overnight sleeping program (a) adopted by Ordinance No. 20559, and amended
Administrative Order -Page 1 of 2
by Ordinance No. 20563 and Ordinance No. 20576'. and (b) implemented by the
Administrative Rules issued by the City Manager.
2. Administrative Order No. 53-18-02 is repealed as of the effective date of this Order.
