HomeMy WebLinkAboutAdmin Order 31-18-01ADMINISTRATIVE ORDER NO. 31-18-01 of the Executive Director of Central Services DELEGATING TO THE MUNICIPAL COURT ADMINISTRATOR THE AUTHORITY TO MODIFY, COMPROMISE, AND CANCEL CLAIMS FOR MUNICIPAL COURT FINES AND FEES. The Executive Director of Central Services finds that: A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002, the City Manager is designated as the administrative head of the City, and is specifically authorized to appoint and remove all employees (except as otherwise provided in the Charter), and to enforce all ordinances of the City. B. Section 2.582 of the Eugene Code, 1971, authorizes the City Manager or designee to modify, compromise or cancel a debt owed to the City, provided that the City Attorney has first reviewed the proposed modification, compromise or cancellation. C. On March 26, 2018, the City Manager issued Administrative Order No. 21-18-02 delegating to me, as the Executive Director of Central Services, the authority to modify, compromise or cancel Municipal Court fines and fees that are deemed uncollectible pursuant to the Eugene Municipal Court Write -Off Policy if I determine that it is in the City's financial interest to do so. Administrative Order No. 21-18-02 also authorized me to sub -delegate that authority. D. I find it would be more efficient and in the public interest to sub -delegate to the Municipal Court Director the authority granted to me by Administrative Order No. 21-18-02. NOW, THEREFORE, The Executive Director of Central Services orders and directs that: 1. As authorized by Section 2.582(4)(e) of the Eugene Code, 1971, the Municipal Court Director is authorized to modify, compromise or cancel Municipal Court fines and fees when the administration and collection costs involved would exceed the amount that can reasonably be expected to be recovered pursuant to the Eugene Municipal Court Write -Off Policy and when the Municipal Court Director determines that it is in the City's financial interest to do so. 2. Pursuant to Section 2.582(6) of the Eugene Code, 1971, the proposed modification, compromise or cancellation of claim shall be reduced to writing and reviewed by Administrative Order - Page 1 of 2 the City Attorney before the Municipal Court Director actually modifies, compromises or cancels the claim. +ti k,.' 1 Dated and effective this day of March, 2018. t4 Sue Cutsog�prge Executive Director of Central Services Administrative Order - Page 2 of 2
