DELEGATING TO THE ASSISTANT CITY MANAGER AND THE
DIVISION MANAGER FOR THE CITY MANAGER'S OFFICE THE
AUTHORITY TO APPROVE, MODIFY, OR DENY REQUESTS
CONCERNING PROHIBITING SMOKING ON PUBLIC RIGHTS-OF-
WAY OUTSIDE OF DOWNTOWN CORE (OPT -IN), AND ALLOWING
SMOKING IN DESIGNATED AREAS INSIDE OF DOWNTOWN CORE
(OPT -OUT), PURSUANT TO ORDINANCE NO. 20603.
The City Manager of the City of Eugene finds that:
A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002, the
City Manager is designated as the administrative head of the City, and is specifically authorized
to appoint and remove all employees (except as otherwise provided in the Charter), and to enforce
all ordinances of the City.
B. On July 23, 2018, the City Council adopted Ordinance No. 20603 amending Section
6.230 of the Eugene Code, 1971 ("EC"), by adding EC 6.230(2)(q) to provide that the City
Manager may approve requests to create smoke-free areas on the public right-of-way adjacent to
smoke-free properties outside of the downtown core (opt -in); and by adding EC 6.230(2)(r) to
prohibit smoking within the downtown core and provide that the City Manager may approve
requests to create designated smoking areas in the downtown core (opt -out). Ordinance No. 20603
will become effective on August 24, 2018.
C. On August 15, 2018, I issued Administrative Order No. 21-18-07, adopting
Emergency Rules implementing Ordinance No. 20603 by setting out how approval under EC
6.230(2)(q) and EC 6.230(2)(r) can be obtained, and that such requests shall be approved, approved
with modifications, or denied by the City Manager or the Manager's designee.
D. I find it would be more efficient and in the public interest to authorize the Assistant
City Manager and/or the Division Manager for the City Manager's Office to approve, approve
with modifications, or deny requests for approval.
NOW, THEREFORE,
The City Manager of the City of Eugene Orders and Directs that:
1. The Assistant City Manager and/or the Division Manager for the City Manager's
Office are authorized to approve, approve with modifications, or deny requests submitted pursuant

to Sections 6.230(2)(q) and 6.230(2)(r) of the Eugene Code, 1971, and Rules established by the
City Manager implementing those Code sections.
2. The Assistant City Manager and the Division Manager for the City Manager's
Office may sub -delegate the authority granted by this Order.
