DELEGATING TO THE COMMUNITY DEVELOPMENT DIVISION
MANAGER OF THE PLANNING & DEVELOPMENT DEPARTMENT
THE AUTHORITY TO GRANT EXTENSIONS AND EXEMPTIONS OF
DOWNTOWN SERVICES DISTRICT OCCUPANCY FEES AND WEST
UNIVERSITY SERVICES DISTRICT OCCUPANCY FEES.
The Executive Director of the Planning & Development Department of the City of
Eugene finds that:
A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002, the
City Manager is designated as the administrative head of the City, and is specifically authorized
to appoint and remove all employees (except as otherwise provided in the Charter), and to enforce
all ordinances of the City.
B. On July 2, 1996, the City Manager issued Administrative Order No. 53-96-09
which, in part, delegated authority to the Executive Director of the Planning & Development
Department to perform the duties and responsibilities of the City Manager set forth in Chapter 3
of the Eugene Code, 1971, and further authored that those duties may be sub -delegated to qualified
person(s).
C. To implement the provisions of Sections 3.650 to 3.680 of the Eugene Code, 1971,
on May 5, 1998, the City Manager issued Administrative Order Nos. 53-98-01-F establishing
Downtown Services District Occupancy Fee Administrative Rule R-3.655(1), and Administrative
Order No. 53-98-03-F establishing West University Services District Occupancy Fee
Administrative Rule R-3.655(2).
D. Rule R -3.655(1)-E and Rule R -3.655(2)-E set out provisions under which the City
Manager or designee can grant extensions to file occupancy fee reports, and grant occupancy fee
exemptions. I find that it would be more efficient and in the public interest to authorize the
Community Development Division Manager of the Planning & Development Department to
administer those sections of the Rules.
NOW, THEREFORE,
The Executive Director of the Planning & Development Department of the City of
Eugene Orders and Directs that:
1. The Community Development Division Manager of the Planning & Development
Department is authorized to grant Downtown Services District occupancy fee extensions and
exemptions pursuant to Rule R -3.655(1)-E and to grant West University Services District
occupancy fee extensions and exemptions pursuant to Rule R -3.655(2)-E.
