Presiding Judge Wayne Allen retired which means the permanent Municipal Court presiding judge position is vacant. The current contract with Associate Judge Gregory Gill allows for him to serve in the presiding judge position on an interim basis until June 2019. This vacancy presents council with the opportunity to determine how to structure and fill this position on a regular basis. This is a follow up to the January 9, 2019, work session on this topic. BACKGROUND The presiding Municipal Court judge performs and oversees all judicial functions of the Eugene Municipal Court. Historically, the presiding judge has been an independent contractor that is paid a set hourly amount to perform the work outlined in their contract as well as an additional monthly amount to cover time spent attending required meetings. Current code stipulates a detailed process for appointment of the municipal judge. At their January 9 work session, council expressed an interest in exploring hiring the municipal judge as a regular employee that reports directly to council as the City Manager and Police Auditor do. Staff will present options and additional detail about a potential hiring process at the work session. COUNCIL OPTIONS The following are options for council consideration and will be detailed during the work session. 1. Keep the current process as established in code and hire the presiding judge as an independent contractor. 2. (1) The presiding municipal judge shall be hired and accountable to the city council. The city council shall hire, supervise, and specify the salary of the presiding municipal judge, who shall serve at the pleasure of the city council. All city council decisions regarding the presiding municipal judge will be made by a simple majority vote of the city council. appointed in the manner provided in this section. (a) Prior to appointing the presiding municipal judge, the council shall cause contract(s) for the position to be prepared and advertised, and solicit applications for the position. The council shall review the applications, and by majority vote determine which of the applicants shall be referred to a screening committee nominated by the mayor and appointed by the council for interview. The screening committee shall be composed of one person from each of the following: the University of Oregon law school faculty; the Lane County public defender's office; the Lane County district attorney's office; the city's department of public safety; the city's human rights commission; the roster of local state or federal judges; and the city's municipal court staff. At the time of referral, the council shall indicate to the screening committee the number of finalists to be referred for consideration by the council. The screening committee shall interview the applicants and refer the finalists to the council. The council shall select the presiding municipal judge from among those finalists. (b) Notwithstanding the provisions of subparagraph (a), the council may re- appoint the incumbent presiding municipal court judge without first undertaking any of the actions specified in subparagraph (a). (2) The performance of the presiding municipal judge shall be evaluated: (a) Through an informal self-evaluation submitted to the council annually; (b) Through an informal evaluation submitted to the council every two years; and (c) Through a formal evaluation, conducted every four years by an evaluation committee. The informal evaluation shall consist of a completed self-evaluation form, together with evaluation forms completed by representatives of the department of public safety, the city prosecutor's office, and the public defender's office. The formal evaluation process shall include a public hearing. Members of the evaluation committee shall be nominated by the mayor and appointed by the council. The committee shall be composed of not less than five persons, including at least one member of the human rights commission, two attorneys familiar with the municipal court, and two other persons generally familiar with the judicial system. The evaluation report shall be submitted to and accepted by the council. The salary of the presiding municipal judge shall be reviewed as part of the city's budget process, and a written recommendation of the proposed rate shall be submitted to the council. January 28, 2019, Work Session – Item 2 Attachment B 1 Presiding Municipal Court Judge Bargaining Unit: Non-Represented Salary: TBD DEFINITION: The Presiding Municipal Court Judge reports to the Eugene City Council, performs and oversees all judicial functions of the Eugene Municipal Court, and ensures conformance with municipal, state, federal, and other legal requirements. DISTINGUISHING CHARACTERISTICS The Presiding Judge shall have all inherent authority, statutory powers, and duties of a justice of the peace within the jurisdictional limits of the city. This position is characterized by the Presiding Judge maintaining the independence of the Court in performing all the legal and statutory requirements. SUPERVISION RECEIVED AND EXERCISED Receives general supervision from the City Council. Exercises direct supervision over the Associate and Assistant Municipal Court Judges. EXAMPLES OF DUTIES – Duties may include, but are not limited to, the following: Provides regular updates and reports to Eugene City Council. Presides over trials and renders judgements for misdemeanor traffic and non-traffic crimes, violations of city ordinances, traffic violations, parking violations, and any other cases within the jurisdiction of the Municipal Court. Presides over pretrial disposition conferences, arraignments, motion hearings, traffic hearings, jury and non-jury trials and various other court settings as required for the City of Eugene. Presides over specialty court dockets such as Community Court and Mental Health Court. Presides over in-custody appearances at the Lane County Adult Corrections facility. Authorizes issuance of search and arrest warrants. Writes opinions, stays current with municipal and state law and changes. Accomplishes, by lawful means, notices of jury duty, summonses, and all other orders of the court necessary for the proper conduct thereof and, within the limit set by the penalty and state law, may prescribe the security amounts, fine or forfeiture for violation of any provision of this code. January 28, 2019, Work Session – Item 2 Attachment B 2 Represents Municipal Court on a variety of City committee and task teams, establishing productive and positive relationships with community groups, stakeholders and municipal court staff. Works with the Court Administrator and other judges to establish the policies, procedures and priorities for the Court, including establishing policies regarding security amounts, fines and the entry and docketing of judgments and all other matters touching the conduct of proceedings in the Court. Works closely with the Court Administrator to build a culture committed to innovative programs and achieving a high performance court. This is accomplished through implementation of best practices in case flow management, data analysis, and employee engagement. Works closely with the Court Administrator to stay within the annual budget allocation for the Municipal Court. Sets standards for judicial conduct and decision-making in the Court. Responsible for assigning cases, conducting judicial meetings and providing training for associate and assistant judges as necessary. In consultation with the Associate Municipal Judge, appoints the Assistant Municipal Judges from active members of the Oregon State Bar Association in good standing. Ensures implementation of, and adherence to the City’s Affirmative Action Plan and diversity initiatives. Facilitates judicial development on such issues as diversity and creating a respectful working environment. Performs other duties, as required. QUALIFICATIONS Knowledge of: Oregon law on traffic violations, traffic procedure, Oregon evidence code, misdemeanor crimes and criminal procedure. Pertinent federal, state and local laws, codes and regulations. Current social, political and economic trends related to the operations and issues of municipal government and criminal justice. Ability to: Work closely with the Court Administrator with regards to court programs, policy development and implementation; determine how to work effectively and collaboratively with a variety of stakeholders by identifying potential problems and opportunities. Conduct court room proceedings in a neutral environment. January 28, 2019, Work Session – Item 2 Attachment B 3 Work closely with the Court Administrator with regards to non-judicial functions of the Municipal Court System and to create and maintain a collaborative, welcoming, respectful, and productive work environment. Communicate with a variety of cross-cultural audiences clearly, concisely and effectively, both orally, including public speaking, and in writing. Listen effectively to individuals and groups to build trust and fairness. Maintain confidentiality. Operate standard office equipment and learn case management software. Training and Experience: The Presiding Municipal Judge must have a Juris Doctorate from an accredited university and have at least five (5) years’ experience as a practicing attorney in municipal law, criminal law, trial experience, or as an administrative hearings officer, arbitrator or judge, or any equivalent combination of experience and training that demonstrates possession of the required knowledge, skills, and abilities. Active Member and in good standing with the Oregon State Bar. Compliance with Oregon State Statute 2017 ORS 221.142 Qualifications for Municipal Judges. Desired but not required, is experience in Community Court Administration or other form(s) of alternative jail programs. Additional Requirements: Candidates for this position are subject to a police background investigation and must obtain Law Enforcement Data System (LEDS) clearance. Candidates must also possess or have the ability to obtain and maintain an appropriate, valid, Oregon driver’s license, and respond to incidents within a reasonable amount of time. Working Conditions: This position primarily works in a fast-paced courtroom setting, deals with distraught individuals and challenging interactions. While performing the duties of this job, the employee may have prolonged periods of sitting, using a keyboard or similar device, and focusing on a computer screen. Periodic attendance at meetings or activities outside of normal working hours. BACKGROUND We recently posted Administrative Order 53-19-01 for public comment on a proposal to amend the parking fee schedule. The parking rate increase is important and necessary as it will allow the parking program to continue to address the $10 million in deferred parking garage capital maintenance including replacing elevators, improving lighting and coating the decks as well as continue to support downtown initiatives like the ambassadors, hosted bathrooms, public safety and wayfinding. The rate increase is also an important part of the strategy to help balance the system so there are parking spaces available, both long- and short-term parking, when needed. The downtown parking system is experiencing unprecedented use with garages reaching capacity on a regular basis. The increased use is adding more wear and tear on the structures and could eventually stifle new development and growth. Along with the rate increase, Parking and Transportation are working on innovative solutions to help more people take advantage of all the excellent transportations options available to downtown employees (for example bikeshare, regular bus and EmX service, and enhanced biking facilities). We have kept the parking rates flat over the last five years to assist in the continuing development of our downtown. Now that the parking garages are at capacity we need to continue to make strategic adjustments that support new development and provide access for customers. RELATED CITY POLICIES The City of Eugene has several adopted transportation-related and downtown plans and policies, including the Eugene-Springfield Area Transportation Plan (2002), Climate Recovery Ordinance (2016), the Downtown Plan. January 28, 2019, Work Session – Item 3 The Eugene-Springfield Area Transportation Plan was adopted as amended by council ordinance number 20258 on July 8, 2002. TRANSPLAN TDM Policy #2 Parking Management Policy Definition/Intent states: Parking management strategies address both the supply and demand for vehicle parking. They contribute to balancing travel demand within the region among the various modes of transportation available. To promote parking equity in the region, consideration should be given to applying parking management strategies at a region- wide level, in addition to downtown centers. It further identifies Parking Management Demand Strategy 2.2 “Shift free parking areas to paid parking where appropriate. The Climate Recovery Ordinance includes four goals: 1. Reduce community fossil fuel use by 50 percent of 2010 levels by 2030. 2. Reduce total community greenhouse gas emissions to an amount that is no more than the city of Eugene's average share of a global atmospheric greenhouse gas level of 350 ppm, which was estimated in 2016 to require an annual average emission reduction level of 7.6 percent 3. City of Eugene owned facilities and operations are to be carbon neutral by 2020, meaning no net release of greenhouse gas emissions. 4. Reduce the City of Eugene's use of fossil fuels by 50 percent compared to 2010 usage. Eugene Downtown Plan • Facilitate dense development in the courthouse area and other sites between the core of downtown and the river. • Downtown development shall support the urban qualities of density, vitality, livability and diversity to create a downtown, urban environment. • Actively pursue public/private development opportunities to achieve the vision for an active, vital, growing downtown. • Use downtown development tools and incentives to encourage development that provides character and density downtown. The City Manager of the City of Eugene finds as follows: A. Section 2.020 of the Eugene Code, 1971 (EC), authorizes the City Manager to detennine and set fees and charges to be imposed by the City for services, goods, use of municipal property, and licenses and pennits. In addition, EC 5.040 authorizes the City Manager to establish parking areas, time limitations, fonns of pennissible parking and fees therefore. EC 5.285(5) provides that charges for off-street parking facilities must be established by administrative action of the City Manager. EC 5.335(2) authorizes the City Manager to designate on-street parking meter zones, hourly rates and time limitations by administrative action, subject to the maximum charges for on-street parking meter rates in subsection EC 5.335(1). B. Pursuant to the authority referenced above, on August 27, 2015, I issued Administrative Order No. 53-15-08-F establishing the current Parking Fee Schedule ("the Fee Schedule"). C. In detennining whether to amend the Fee Schedule, I have considered the applicable criteria of EC 5.055 and EC 5.285(7). I have also considered the applicable policies, enactments and directives of the City Council, the amount charged for these services by the City in the past, the full costs of providing the services supported by the fees, the amounts charged by other comparable providers, and the revenue needs of the City as detennined by the adopted City budget. D. Based on my consideration of the factors listed above, I propose to amend the Fee Schedule and replace it with an updated Fee Schedule as set forth in the Notice attached as Exhibit A to this Order. On the basis of these findings, I order that the Notice attached as Exhibit A shall be: a. Provided to the Mayor and City Councilors, and to persons who have requested such notice; b. Posted at two locations at City Hall; and c. Off-Street Parking -Restrictions and Exceptions: 3.1 Except for Special Event permits by contract with the City, contracts with the City encompassing payment for parking, and legal holidays as defined in ORS 187.010 (which includes Sundays), the permits andlor other fees set forth in Sections 1 and 2 are required when parking between the hours of 7:00 a.m. and 6:00 p.m. If a holiday (other than Sunday) falls on Sunday, the succeeding Monday shall be a legal holiday. If a holiday falls on Saturday, the preceding Friday shall be a legal holiday. 3.2 A Special Event permit by contract with the City, a contract with the City encompassing payment for parking, or payment of a fee as set forth in Sections 1 and 2 shall be required for any day of the year, including those hours after 6:00 p.m. and holidays (including Sunday) when a Special Event is being held.
