Board Chair Sonya Carlson opened the February 11, 2019, meeting of the Eugene Water & Electric Board of Commissioners.
1.JOINT WORK SESSION: Climate and Energy DiscussionsSustainability and Intergovernmental Relations Manager Ethan Nelson, EWEB General ManagerFrank Lawson and EWEB Governmental Affairs Coordinator Jason Heuser presented an updateon climate and energy related policies, programs and planning efforts.Discussion
•Councilor Clark – asked about the source for population forecasts used for data analysis; thepotential impacts of the proposed State cap and trade legislation on local climate goals; andwhether the gap is from sector-based or consumption-based emissions.
•Councilor Semple – asked for clarification about cap and trade legislation, carbon pricing,the threshold for emissions, and where the money from a carbon tax is used.
•Commissioner Brown – explained EWEB’s electric vehicle strategy, noting its relationship to5G technology; encouraged consideration of downtown buildings that transitioned tonatural gas when steam plant was decommissioned.
•Councilor Syrett – appreciated EWEB’s focus on climate change, particularly the socialequity considerations of their strategies and decision-making.
•Councilor Evans – asked about anticipated equity benefits derived from cap and trade orcarbon pricing initiatives; exploring the use of carbon tax funds for grant purposes.
•Commissioner Mital – noted that EWEB’s contribution to addressing the City’s climate goalswere distilled down to five strategies; asked for help in understanding what commitmentsthe City is willing to make to achieve its goals.
•Councilor Pryor – asked for clarification about how the cap and trade legislation could worktogether with the City’s climate goals; affirmed commitment of council to continue pursuingthe City’s climate goals.
•Councilor Taylor – asked questions about EWEB’s strategy around natural gas conversionand the safety of 5G installations; supported outreach and partnerships to mitigate impactson lower-income customers.
•Commissioner Schlossberg – encouraged consideration of updates the rental housing codeto incentivize upgrades to higher-efficiency energy systems; urged council to include EWEBI future discussions of transportation issues.

•Councilor Zelenka – supported devoting most time and energy to sectors that have thegreatest carbon emissions and impacts; noted that appliances and vehicles are gettingsmarter with the ability to control the optimum time for use.
•Commissioner Helgesen – asked his colleagues to be mindful of the longer-termconsequences of strategies and decisions and to consider the lifecycle of energy sources;said EWEB’s decisions must have a nexus with utility purposes.
•Councilor Clark – asked questions about the impacts of natural gas conversions, includingwhether a radical limit on natural gas would double the peak draw on electricity, andwhether the generation source for meeting the new demand will have a greater carbonimpact in today’s environment; Inquired about the effect of a cap and trade policy on theemerging electric vehicle industry.
•Commissioner Carlson – outlined each of the tenets of EWEB’s strategic plan and theiralignment with local carbon and climate conversations and initiatives; supported Cityefforts to address impacts of carbon emissions from rental housing.
•Councilor Yeh – asked about how a council decision to limit natural gas usage to its currentcapacity might impact EWEB’s carbon reduction strategies.
•Commissioner Mital – said that if the State establishes a goal and mechanism to reducecarbon emissions, it will be important to know how much of the City’s goals will be met andwhat gaps will still exist; asked about retargeting goals.
•Mayor Vinis – thanked the councilors and commissioners for their participation andencouraged further synchronization of climate and carbon reduction efforts.The meeting adjourned at 7:05 p.m. Respectfully submitted,

1.PUBLIC FORUM1.Stefan Strek – spoke in support of a local restaurant and property owner.2.Bekki Bruckner – spoke in opposition to the proliferation of 5G technology in the city.3.Sabrina Siegel – spoke in opposition to the proliferation of 5G technology in the city.4.James Manning – expressed concern about the lack of affordable housing in Eugene.5.John Thielking – voice opposition to three proposed ordinances scheduled for public hearing.6.Fred Williams – accused City officials of not enforcing handicapped parking laws.7.Debby McGee – urged council to renegotiate NW Natural franchise agreement to reduce fossil fuels.8.Linda Perrine – supported investment in solar energy technology and incentives.9.Karin Almquist – spoke about the link between climate change and the proliferation of 5G.10.Dave Piccioni – expressed concern about pollution and homelessness.11.Teresa Parker – spoke about the importance of collaboration in implementing the CAP 2.0.12.Jim Ball – explained the energy and emissions impacts of natural gas use in large buildings.13.David Force – urged consideration of Seneca Cogeneration Plan when discussing CO 2 emissions.14.Eliza Kashinsky – supported ADUs, noting there is no livability without affordability/sustainability.15.JoJo Jensen – expressed concern about the impacts of AirBnBs on neighborhoods and safety.16.Sandy Sanders – spoke in opposition to 5G technology, smart meters related to climate change.17.Sue Sierralupé – urged council to oppose the proposed anti-panhandling ordinance.18.Loretta Huston – spoke about the dangers of 5G and its nexus with climate change efforts.19.Linda Heyl – suggested ways to improve progress made on CAP and CRO goals.20.Eric Jackson – offered suggestions for increasing shelter options for the homeless in winter.21.Shelby Shear – spoke about her experience being homeless; supported return of Camp 99.22.Nicholas Engel – demanded immediate action on climate change goals; stop endless debate.23.Robin Bloomgarden – opposed the unregulated proliferation of 5G technology.24.Jean Stacey – encouraged council to facilitate the establishment of more rest stop sites.25.Joel Iboa – supported Oregon sanctuary laws and opposed efforts to erode trust in community.Council Discussion
•Councilor Syrett – supported a council discussion of potential AirBnB regulation; councilaction to prevent evictions related to rent gouging for 2021 visitors; opposed proposed ordinance against unlawful transfer for vehicles; requested rescheduling action on that ordinance; concerned about alleged Lane County practice of assisting ICE in arrests.
•Councilor Semple – expressed opposition to anti-panhandling ordinance but interested inhearing from community; supported efforts to identify more homeless shelter options, including self-governed facilities, dawn-to-dawn camps, less NIMBYism, places for those with dogs; voiced concern about towing practices.

Councilors Present: Emily Semple, Jennifer Yeh, Alan Zelenka, Mike Clark. Chris Pryor, Betty Taylor. Greg Evans, Claire Syrett Mayor Vinis opened the February 13, 2019, Work Session of the Eugene City Council.
•Councilor Taylor – reported that she was receiving many questions from constituents aboutthe legality of a billboard on the corner of 18th Avenue and Willamette Street; urged thecouncil to take a stand on House Bill 2001, which would preempt local control over zoningissues.
•Councilor Zelenka – echoed concerns about the billboard at 18th and Willamette but notedthat Eugene’s Sign Code, as written, does not prohibit it; suggested adding this issue to theupcoming work session on digital display technology.
•Councilor Semple – expressed appreciation to staff for sending council agenda materialsearlier and for providing more detailed meeting minutes; urged action on creating adowntown center and identifying additional sites for car camps and rest stops.
•Mayor Vinis – informed the council about a request from the Eugene YMCA for support fortheir request for lottery funds and announced her intention to bring a resolution to councilon this issue.
1.WORK SESSION: Community Safety Revenue Team UpdateAssistant City Manager Kristie Hammitt, Police Chief Chris Skinner, Fire Chief Joe Zaludek andProject Consultant Kevin Alltucker provided an update on the progress of the Community SafetyInitiative and the Revenue Team.(Councilor Clark left the meeting at 12:54 p.m.)Council Discussion
•Councilor Semple – expressed appreciation for the presentation and for the opportunity toserve on the Community Safety Revenue Team, noting it successfully reached consensusdespite difference of opinion; said the proposal is the best possible and least regressiveresponse to a critical community needs; it casts the widest net and will continue to adjust asneeds grow; asked for more information about the variability of the three proposed taxpercentages and which would achieve the overall goal.
•Councilor Yeh – appreciated the summary of the committee’s work; result is a proposal thatwill be easy to explain to constituents; encouraged the council to ask the committeemembers questions.
•Councilor Pryor – noted there was a real commitment on the part of the committeemembers to look at many options and take decisive action; acknowledged that there will bepublic pushback on any tax increase, but this proposal responds to an essential core value.
•Councilor Zelenka – encouraged council follow the same process used by the committee anddo its own analysis of all scenarios, potential options, etc., noting the committeerecommendation was just one factor to be considered.

Work Session
•Councilor Syrett – asked for information about the proposed plan as it relates to cuts made topublic safety services during the last recession, noting that revenues have risen since thenbut not enough to meet current needs; acknowledged that business owners served on thecommittee and were supportive of the proposal; favored a payroll tax over a property tax.
•Councilor Evans – complimented the report and supported the direction and proposedmechanism for revenue generation; asked about the effect on County partners, such asHealth and Human Services, if growth in capacity also increases the need for social services;asked about intended visual and other real, tangible outcomes to change the perceptions ofthose who are now afraid to come downtown.
•Councilor Taylor – asked about and supported plans to increase public safety presence inneighborhoods that are not considered to be in crisis; supported the implementation of callprioritization; inquired about exempting lower-income earners from the proposed payroll tax.
•Councilor Syrett – agreed that there would be value in council discussing the other options;supported strategy that funds detectives dedicated to non-immediate crimes such asprostitution and drug dealing noting that the proposed plan calls out this need.
•Councilor Zelenka – encouraged council to follow a transparent process with definedmetrics for success and a solid accountability mechanism; show benefits of the proposedtax, how it will be shared by the community and how the funds will be allocated.
•Councilor Yeh – noted that the committee did discuss the possibility of exemptions butagree that everyone should contribute at some level because everyone benefits from aneffective public safety system.
•Councilor Semple – said the parks bond and levy is a good example of the value of a smallcommittee doing the analysis and making a recommendation; the condition of Eugene’s publicsafety system is an ongoing crisis needing immediate attention and robust public input.
•Councilor Pryor – agreed that the work of the committee will help expedite the councildecision-making process.
•Mayor Vinis – acknowledged the size and detail of the report, its holistic approach and itsnexus with many other services and programs; the council will have the opportunity todiscuss the issue further in its upcoming workshop; encouraged staying on track to meetthe 18-month timeline for implementation.The meeting adjourned at 1:35 p.m. Respectfully submitted,

ISSUE STATEMENT This is a routine item to approve City Council Tentative Working Agenda.
BACKGROUND On July 31, 2000, the City Council held a process session and discussed the Operating Agreements. Section 2, notes in part that “The City Manager shall recommend monthly to the council which items should be placed on the council agenda. This recommendation shall be placed on the consent calendar at the regular City Council meetings (regular meetings are those meetings held on the second and fourth Monday of each month in the Council Chamber). If the recommendation contained in the consent calendar is approved, the items shall be brought before the council on a future agenda. If there are concerns about an item, the item may be pulled from the consent calendar at the request of any councilor or the Mayor. A vote shall occur to determine if the item should be included as future council business.” Scheduling of this item is in accordance with the Council Operating Agreements.

ISSUE STATEMENT This item is a request to annex property located at 3510 Walton Lane. The property to be annexed is approximately .45 acres and is developed with single-family residence. No public right-of-way is proposed for annexation as part of this request. A vicinity map is provided as Attachment A. The property is zoned AG Agricultural with /UL Urbanizable Land overlay. The property is designated for low density residential use in the Metro Plan and the applicable refinement plan, the Willakenzie Area Plan. The area of annexation is located within the City’s urban growth boundary and is contiguous to the City limits. Annexation will allow for future development consistent with the property’s land use designation and the Eugene Code. Specific plans for future development of the site are not included as part of this annexation application.
BACKGROUND To encourage compact urban growth and sequential development within Eugene’s UGB, the Metro Plan provides that ultimately all land within the UGB will be annexed into the City and provided with a minimum level of urban services. Approval of annexation requests are based on the criteria at Eugene Code 9.7825 which require that (1) the land proposed to be annexed is within the City’s UGB and is contiguous to the City limits or separated from City limits only by a right-of-way or water body; (2) the proposed annexation is consistent with the applicable policies in the Metro Plan and in any applicable refinement plans; and (3) the proposed annexation will result in a boundary in which the minimal level of key urban facilities and services can be provided in an orderly, efficient, and timely manner. Findings demonstrating that the annexation request is consistent with these approval criteria are included as Exhibit C to the attached draft resolution (Attachment B). To provide nearby property owners and residents an opportunity to review and comment on this annexation request, public notice was provided to all owners and occupants of property within 500 feet of the subject property and the affected neighborhood association (Northeast Neighbors) consistent with Eugene Code requirements. No testimony has been received to date regarding the proposed annexation of this property.

Referral comments were provided by affected agencies including City of Eugene Public Works, Eugene Water & Electric Board, and Lane County Public Works. These referral comments confirm that the property can be provided with the minimum level of key urban services consistent with the approval criteria. Given the findings of compliance, ability for the provision of key urban services, and lack of testimony received, a public hearing is not recommended in this instance. Additional background information regarding this request, including relevant application materials, is included for reference as Attachment C. A full copy of all materials in the record is also available at the Permit and Information Center located at 99 West 10th Avenue.

RESOLUTION ANNEXING LAND TO THE CITY OF EUGENE
(ASSESSOR’S MAP 17-03-08-31, TAX LOTS 2900 AND 3000 LOCATED ON
WALTON LANE).
The City Council of the City of Eugene finds that:
A.An annexation application was submitted on September 27, 2018, by LH Fund 3,
LLC, in accordance with the provisions of Section 9.7810 of the Eugene Code, 1971, (“EC”) to
annex property identified as Assessor’s Map 17-03-08-31, Tax Lots 2900 and 3000, to the City of
Eugene.
B.The property proposed to be annexed is depicted on the map attached as Exhibit A
to this Resolution. The legal description of the entire property proposed to be annexed is attached
to this Resolution as Exhibit B.
C.The City’s Planning Director has submitted a written recommendation that the
application be approved based on the criteria of EC 9.7825. The Planning Director’s Findings and
Recommendation is attached as Exhibit C.
D.On January 25, 2019, a notice containing, the assessor’s map and tax lot number
for the property, a description of the land proposed to be annexed, and the Planning Director’s
preliminary recommendation was mailed to the applicant, owners and occupants of property within
500 feet of the perimeter of the subject property, and the Northeast Neighbors neighborhood
organization. The notice advised that the City Council would consider the Planning Director’s full
recommendation on the proposed annexation on February 25.
E.After considering the Planning Director’s recommendation, the City Council finds
that the application should be approved.
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a
Municipal Corporation of the State of Oregon, as follows:
Section 1. Based on the above findings and the Planning Director’s Findings and
Recommendation which are attached as Exhibit C and are adopted in support of this Resolution, it
is ordered that the land identified as Assessor’s Map 17-03-08-31, Tax Lots 2900 and 3000, which
is depicted on the map attached as Exhibit A, and more particularly described in the attached
Exhibit B, is annexed to the City of Eugene.

Section 2. This Resolution is effective immediately upon its passage by the City Council.
The annexation and the automatic rezoning of the land pursuant to EC 9.7820(3) from AG

Based on the information provided by the applicant, the City has determined that this request complies
with Eugene Code (EC) Section 9.7805 Annexation ‐ Applicability. As such, it is subject to review and
approval in accordance with the requirements, application criteria and procedures of EC 9.7800 through
9.7835. The applicable approval criteria are presented below in bold typeface with findings and
conclusions following each.
EC 9.7825(1) The land proposed to be annexed is within the city’s urban growth boundary and is:
(a) Contiguous to the city limits; or
(b) Separated from the city only by a public right of way or a stream, bay, lake or other

Policy 15. Ultimately, land within the UGB shall be annexed to a city and provided with
the required minimum level of urban facilities and services. While the time
frame for annexation may vary, annexation should occur as land transitions
from urbanizable to urban. (page II‐C‐5)
The following policy from the Residential Element of the Metro Plan is also applicable:
Policy A.2 Residentially designated land within the UGB should be zoned consistent with
the Metro Plan, and applicable plans and policies; however, existing
agricultural zoning may be continued within the area between the city limits
and UGB until rezoned for urban uses.
The Metro Plan designates the property to be annexed as appropriate for low‐density
residential use. The Willakenzie Area Plan (WAP) is the adopted refinement plan for the
subject properties and also designates the area low density residential development. The
property is currently zoned AG Agricultural and /UL Urbanizable Land Overlay. The /UL
overlay will be automatically removed from the zoning following annexation approval. It
is noted that prior to development consistent with the plan designation, the properties
will need to be rezoned to R‐1 Low‐Density Residential Zone.
With regard to applicable policies of the WAP, the subject property is located within the
North Region, Unincorporated Subarea. None of the listed policies for this subarea
appear to be directly applicable to the subject property. The proposed annexation does
not appear to conflict with any of the Land Use Policies or Residential Policies. The
“Public Facilities and Services Element” policies of the WAP are directed at local
government; however, the premise of these policies (regarding the provision of urban
services) is the assumption that the properties within the UGB will be annexed.
As previously discussed in this subsection, and further detailed under subsection (3)
below, the proposed annexation is consistent with Metro Plan growth management
policies and can be served by the minimum level of key urban services. The annexation
procedures beginning at EC 9.7800 are consistent with State law and therefore, as found
throughout this report, the annexation is consistent with State law.
Therefore, based on the findings above, the proposal is consistent with the applicable
policies of the Metro Plan and refinement plan.
EC 9.7825(3) The proposed annexation will result in a boundary in which the minimum level of key
urban facilities and services, as defined in the Metro Plan, can be provided in an
orderly, efficient, and timely manner.
Complies Findings: Consistent with this criterion, the proposed annexation will result in a
boundary in which the minimum level of key urban facilities and services can be
provided in an orderly, efficient, and timely manner as detailed below:
Wastewater
There is an 8‐inch public wastewater line in Walton Lane on the eastern boundary of the
subject property. The property located adjacent this lot to the south (3470 Walton) and

directly across the street to the east (3487 Walton) are connected to the 8” line. The
related assessments are paid.
Stormwater
There is a public stormwater system to the north within Walton Lane (10‐inch diameter
with inlets #75991 and #75990) where more recent development appears to be located
as well as a 15‐inch line to the South at the Honeywood intersection. All the inlets and
weep holes are on the east side of this portion of Walton; across the street from the
subject lots. The west side of Walton between Ashbury Drive and 3355 Walton Ln
appears to have roadside ditches for conveyance of run off. The soil type for these lots is
mapped as being Type B, indicating high infiltration rates. On‐site management of
stormwater runoff from future development of the site appears to be feasible.
Transportation
Tax lots 2900 & 3000 can be accessed via a private drive. There is no frontage on Walton
Lane. Future development will comply with access and frontage requirements.
Solid Waste
Collection service is provided by private firms. Regional disposal sites and the Short
Mountain Landfill are operated by Lane County.
Water and Electric
EWEB Water staff state no objection to the annexation. EWEB Electric staff also state no
objection to the annexation. Water and electric services can be extended to the subject
property in accordance with EWEB policies and procedures.
Public Safety
Police protection can be extended to this site upon annexation consistent with service
provision through the City. Fire protection will be provided by Eugene Springfield Fire.
Emergency medical services are currently provided on a regional basis by the cities of
Eugene and Springfield and will continue in the same manner upon annexation.
Parks and Recreation
Parks and recreation programs are provided on a City‐wide basis. The inclusion of the
subject property in the City is sufficient evidence to demonstrate the minimum level of
this key urban service is met.
Planning and Development Services
Planning and building permit services are provided for all properties located within the
urban growth boundary by the City of Eugene. The Eugene Code, Chapter 9, will provide
the required land use controls for future development of the subject property upon
annexation.
Communications
A variety of telecommunications providers offer communications services throughout
the Eugene/Springfield area.

Public Schools
The subject property is within Eugene School District 4J and is within the district
boundary of Gilham Elementary School, Cal Young Middle School, and Sheldon High
School. As access to schools is evaluated on a district wide basis, the properties’ location
within the school district is sufficient evidence to demonstrate the minimum level of this
key urban service is met.
CONCLUSION:
Based on the above findings, information submitted to date, and the criteria set forth in EC 9.7825, the
proposed annexation is consistent with the applicable approval criteria. A map and legal description
showing the area subject to annexation are included in the application file for reference. The effective
date is set in accordance with State law.

BBackground
This is an annexation application for approximately 0.45 acre site, located at 3510 Walton Lane, in an area zoned Agricultural (AG). The subject property is in the Urbanizable Land Overlay District, (UL), as it is located outside City of Eugene city limits, but within the Urban Growth Boundary (UGB). The tax lots on the subject property are contiguous to city limits on three sides. The proposed annexation is consistent with the City’s Metro Plan designation, showing the land within the UGB and included in these plan diagrams.
To facilitate city staff review of this annexation application, this written statement clearly demonstrates how the development meets the Annexation application criteria of EDC 9.7825 Criteria. The Eugene Development Code (EDC) text sections are in bold and/or italics and the responses are included in plain text.
Annexations
9.7825 Annexation – Approval Criteria.The city council shall approve, modify and approve, or deny a proposed annexation based on the application’s consistency with the following:
1.The land proposed to be annexed is within the city’s urban growth boundary and is: a.Contiguous to the city limits; or b. Separated from the city only by a public right of way or a stream, bay, lake or other body of water.
The subject property Tax Lot 03000 is contiguous to city limits on three sides: the northern, western, and southern property lines adjacent to Tax Lot 03000. The subject property Tax Lot 02900 is contiguous to city limits on three sides: the northern, eastern, and southern property lines adjacent to Tax Lot 02900.
2. The proposed annexation is consistent with applicable policies in the Metro Plan and in any applicable refinement plans.
The subject property is located within the City’s urban growth boundary and in an area zoned Agricultural (AG). The Metro Plan diagram indicates that the property is designated for low density residential development. The area is within the Willakenzie Refinement Plan. Willakenzie Refinement Plan standards are addressed below. Upon approval of this proposed annexation by the City Council the property will be zoned AG and the Urban Land (UL) Overlay will automatically cease to apply.
As further detailed in subsection (3), the proposed annexation is consistent with Metro Plan growth management policies and can be served by the minimum level of key urban services.
Several other policies from the Metro Plan provide support for this annexation by encouraging compact urban growth to achieve efficient use of land and urban service provisions within the UGB, including the following policies from the Growth Management section:
Metro Plan Growth Management Policies:
Policy 1: The UGB and sequential development shall continue to be implemented as an essential means to achieve compact urban growth. The provision of all urban services shall be concentrated inside the UGB. (page 11-C-3)
The proposed annexation includes land within the UGB and outside city limits. Annexing such land would create more opportunity for compact urban growth. The land is within the UGB, therefore ensuring the provision of all urban services will be concentrated inside the UGB.

9.9700Willakenzie Area Plan Policies.
1. Land Use Element - General Policies.
(a) The City shall use the Land Use Diagram and accompanying text and policies of the Willakenzie Refinement Plan, as well as other applicable City goals, policies, and plans, to provide policy direction for public decisions affecting the plan area. (Policy 1)
The Willakenzie Land Use Diagram designates 3510 Walton Lane as low density residential. There is no development proposed with this application except for the annexation of Tax Lot 03000 and Tax Lot 02900. The existing structure on parcel 1 is a single family residence that complies with the Lane County agricultural (AG) designation. Based on this fact, the low-density residential character of the area will be maintained.
(b) The City shall ensure that future commercial development and redevelopment in the Willakenzie planning area is sensitive to and compatible with existing and planned development in the surrounding area. (Policy 2)

3. The proposed annexation will result in a boundary in which the minimum level of key urban facilities and services, as defined in the Metro Plan, can be provided in an orderly, efficient, and timely manner.
The proposed boundary results in key urban facilities and services provided in an orderly, efficient and timely manner. Utilities required to serve the property are located within the right-of-way as shown on the Site Plan.
Electric power facilities are currently provided by Eugene Water and Electric Board, natural gas facilities are provided by Northwest Natural, and wastewater and storm sewer lines are existing. Water is currently provided via a well.
As discussed below, public services are in place and readily available to the properties proposed for annexation. Because of the proximity to the surrounding urban facilities, services can be provided in an orderly, efficient, and timely manner.
- Electrical service is provided by EWEB. Underground wires are available for connection along Walton Lane via tax lot 2900. Overhead wires are available for connection along the south portion of the parcel via tax lot 3000.- Water service is provided by an onsite well but will be transferred to EWEB upon annexation. Water mains are accessible from multiple locations. - A 8” wastewater main exists along Walton Lane and is available for connection on the east side of tax lot 3000 and the east side of tax lot 2900. - The city stormwater system consists of an 8” main and curb inlets in Walton Lane. - Willakenzie/Eugene RFPD currently provides fire service to the area. Upon annexation, service will be provided by Eugene Springfield Fire. - Tax lots 03000 and 02900 can be accessed via a private drive. There is no frontage on Walton Lane. There is no development proposed at the time, however future development will comply with access and frontage requirements. - The property is within the Eugene School District 4J and is within the district boundaries of Gilham Elementary School, Cal Young Middle School, and Sheldon High School. - Garbage collection service is provided by private firms. Regional disposal sites and the Short Mountain Landfill are operated by Lane County. - Police protection can be extended to this site upon annexation consistent with service provision throughout the City.

- Emergency medical services are currently provided on a regional basis by the Cities of Eugene and Springfield to central Lane County and will continue in the same manner upon annexation. - A minimum level of park service can be provided to the proposal area as prescribed in the Metro Plan. - Planning and building permit services are provided for all properties located within the urban growth boundary by the City of Eugene. The Eugene Code, Chapter 9, will provide the required land use controls for future development of the subject property upon annexation. - A variety of telecommunications providers offer communications throughout the Eugene/Springfield area.

Site Plan Requirements
Submit 3 paper copies and 1 digital copy of a site plan, drawn to an engineer’s scale on 8 ½” x 11" sheet of paper. Site plans
shall include the following information:
Show the date & north arrow on site plan.
Show the Assessor’s Map and Tax Lot number(s) on the site plan.
Show a vicinity map on the site plan (vicinity map does not need to be to scale).
Show city limits & UGB (if applicable)
Clearly label the affected territory and any public right of ways to be annexed.
Show all adjacent streets, alleys, and accessways.
Show all dimensions of existing public utility easements and any other areas restricting use of the parcels, such as
conservation areas, slope easements, access easements, etc.

Petition for Annexation form listing all owners, including partial owners, and electors. This form includes the
Certification of Electors which must be signed by the Lane County Elections/Voter Registration Department and also
includes the Verification (Certification) of Property Owners which must be signed by the Lane County Department of
Assessment and Taxation. This form is required even if the land is vacant.
Notarized Consent to Annexation form.
A legal description of the land proposed for annexation, including any public right of way prepared by a registered
land surveyor. Oregon Revised Statues (ORS) 308.225 requires submittal of a closing metes and bounds description
or subdivision block and lot number description. Please see example of acceptable legal descriptions contained in
the application packet. The legal description must exactly correspond with the map included with the application or
the Assessor’s map.

ISSUE STATEMENT This item is a request to annex a property located at 503 Sunnyside Drive. The property to be annexed is approximately .39 acres (16,471 square feet) and is developed with single-family residence. Additionally, approximately 184 feet of public right-of-way (Sunnyside Drive) is proposed for annexation by the applicant as part of this request. A vicinity map is provided as Attachment A. The property is zoned R-1 Low-Density Residential with /UL Urbanizable Land overlay. The property is designated for low density residential use in the Metro Plan and the applicable refinement plan, the River Road – Santa Clara Urban Facilities Plan. The area of annexation is located within the City’s urban growth boundary and is contiguous to the City limits. Annexation will allow for future development consistent with the property’s land use designation and the Eugene Code. Specific plans for future development of the site are not included as part of this annexation application.
BACKGROUND To encourage compact urban growth and sequential development within Eugene’s UGB, the Metro Plan provides that ultimately all land within the UGB will be annexed into the City and provided with a minimum level of urban services. Approval of annexation requests are based on the criteria at Eugene Code 9.7825 which require that (1) the land proposed to be annexed is within the City’s UGB and is contiguous to the City limits or separated from City limits only by a right-of-way or water body; (2) the proposed annexation is consistent with the applicable policies in the Metro Plan and in any applicable refinement plans; and (3) the proposed annexation will result in a boundary in which the minimal level of key urban facilities and services can be provided in an orderly, efficient and timely manner. Findings demonstrating that the annexation request is consistent with these approval criteria are included as Exhibit C to the attached draft resolution (Attachment B).

To provide nearby property owners and residents an opportunity to review and comment on this annexation request, public notice was provided to all owners and occupants of property within 500 feet of the subject property and the affected neighborhood association (River Road Community Organization) consistent with Eugene Code requirements. No testimony has been received to date regarding the proposed annexation of this property. Referral comments were provided by affected agencies including City of Eugene Public Works, Eugene Water & Electric Board, and Lane County Public Works. These referral comments confirm that the property and adjacent right-of-way can be provided with the minimum level of key urban services consistent with the approval criteria. Given the findings of compliance, ability for the provision of key urban services, and lack of testimony received, a public hearing is not recommended in this instance. Additional background information regarding this request, including relevant application materials, is included for reference as Attachment C. A full copy of all materials in the record is also available at the Permit and Information Center located at 99 West 10th Avenue.

RESOLUTION ANNEXING LAND TO THE CITY OF EUGENE
(ASSESSOR’S MAP 17-04-24-32, TAX LOT 3300 LOCATED AT 503
SUNNYSIDE DRIVE) AND A PORTION OF RIGHT-OF-WAY
(SUNNYSIDE DRIVE ADJACENT TO THE PROPERTY).
The City Council of the City of Eugene finds that:
A. An annexation application was submitted on December 21, 2018, by Randall
McClay Morrow and Denise Thomas in accordance with the provisions of Section 9.7810 of the
Eugene Code, 1971, (“EC”) to annex to the City of Eugene property identified as Assessor’s Map
17-04-24-32, Tax Lot 3300, and the approximately 7,368 square foot portion of the Sunnyside
Drive right-of-way that is adjacent to the subject property.
B. The property proposed to be annexed is depicted on the map attached as Exhibit A
to this Resolution. The legal description of the property proposed to be annexed is attached to this
Resolution as Exhibit B.
C. The City’s Planning Director has submitted a written recommendation that the
application be approved based on the criteria of EC 9.7825. The Planning Director’s Findings and
Recommendation is attached as Exhibit C.
D. On January 25, 2019, a notice containing the street address, the assessor’s map and
tax lot number for the property, a description of the land proposed to be annexed, and the Planning
Director’s preliminary recommendation was mailed to the applicant, owners and occupants of
property within 500 feet of the perimeter of the subject property, and the River Road Community
Organization. The notice advised that the City Council would consider the Planning Director’s
full recommendation on the proposed annexation on February 25, 2019.
E. After considering the Planning Director’s recommendation, the City Council finds
that the application should be approved.
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a
Municipal Corporation of the State of Oregon, as follows:
Section 1. Based on the above findings and the Planning Director’s Findings and
Recommendation which are attached as Exhibit C and are adopted in support of this Resolution, it
is ordered that the land identified as Assessor’s Map 17-04-24-32, Tax Lot 3300, and the
approximately 7,368 square foot portion of the Sunnyside Drive right-of-way that is adjacent to

the subject property, which are depicted on the map attached as Exhibit A, and more particularly
described in the attached Exhibit B, is annexed to the City of Eugene.
Section 2. This Resolution is effective immediately upon its passage by the City Council.

Density Residential with /UL Urbanizable Land Overlay to R-1 Low-Density Residential shall
become effective in accordance with State law.

EVALULATION:
Based on the information provided by the applicant, the City has determined that this request complies
with Eugene Code (EC) Section 9.7805 Annexation - Applicability. As such, it is subject to review and
approval in accordance with the requirements, application criteria and procedures of EC 9.7800 through
9.7835. The applicable approval criteria are presented below in bold typeface with findings and
conclusions following each.
EC 9.7825(1) The land proposed to be annexed is within the city’s urban growth boundary and is:
(a) Contiguous to the city limits; or
(b) Separated from the city only by a public right of way or a stream, bay, lake or other
body of water.
Complies Findings: The annexation area is within the City’s urban growth boundary (UGB), and is
contiguous to the City limits, consistent with subsection (a).

Complies Findings: Several policies from the Metro Plan provide support for this annexation by
encouraging compact urban growth to achieve efficient use of land and urban service
provisions within the UGB, including the following policies from the Growth
Management section (in italic text):
Policy 8. Land within the UGB may be converted from urbanizable to urban only
through annexation to a city when it is found that:
a. A minimum level of key urban facilities and services can be provided to the
area in an orderly and efficient manner.
b. There will be a logical area and time within which to deliver urban services
and facilities. Conversion of urbanizable land to urban shall also be
consistent with the Metro Plan. (page II-C-4)
Policy 10. Annexation to a city through normal processes shall continue to be the
highest priority. (page II-C-5).

Policy 15. Ultimately, land within the UGB shall be annexed to a city and provided with
the required minimum level of urban facilities and services. While the time
frame for annexation may vary, annexation should occur as land transitions
from urbanizable to urban. (page II-C-5)
The following policy from the Residential Element of the Metro Plan is also applicable:
Policy A.2 Residentially designated land within the UGB should be zoned consistent with
the Metro Plan, and applicable plans and policies; however, existing
agricultural zoning may be continued within the area between the city limits
and UGB until rezoned for urban uses.
The Metro Plan designates the property to be annexed as appropriate for low density
residential use. The River Road - Santa Clara Urban Facilities Plan (RR/SC UFP) is the
adopted refinement plan for the subject property and also designates the area for
residential uses. Consistent with the land use designations, the property is currently
zoned R-1 Low-Density Residential with /UL Urbanizable Land Overlay. The /UL overlay
will be automatically removed from the zoning following annexation approval.
With regard to applicable policies of the RR/SC UFP, the subject property is not located
within any of the described subareas. Further, none of the general “Residential Land Use
Policies” at Section 2.2 appear to be directly applicable to the subject request. The
“Public Facilities and Services Element” policies of the RR/SC UFP are directed at local
government; however, the premise of these policies (regarding the provision of urban
services) is the assumption that property within the UGB will be annexed.
As previously discussed in this subsection, and further detailed under subsection (3)
below, the proposed annexation is consistent with Metro Plan growth management
policies and can be served by the minimum level of key urban services. The annexation
procedures beginning at EC 9.7800 are consistent with State law and therefore, as found
throughout this report, the annexation is consistent with State law.
Therefore, based on the findings above, the proposal is consistent with the applicable
policies of the Metro Plan and RR/SC UFP refinement plan.
EC 9.7825(3) The proposed annexation will result in a boundary in which the minimum level of key
urban facilities and services, as defined in the Metro Plan, can be provided in an
orderly, efficient, and timely manner.
Complies Findings: Consistent with this criterion, the proposed annexation will result in a
boundary in which the minimum level of key urban facilities and services can be
provided in an orderly, efficient, and timely manner as detailed below:
Wastewater
Public wastewater is available within Sunnyside Drive, via an 8-inch PVC pipe. The
existing residence is currently connected per the City sewer connection records (1-25-

1993). The lien docket indicates there are no on-hold assessments currently due.
Stormwater
The nearest public system is near the intersection of Sunnyside with River Rd.,
approximately 1,000 feet east of the subject property. Soils appear to be type “C”
indicating poor infiltration rates. Future development proposals must demonstrate
consistency with flood control standards; on-site retention may be an acceptable option,
if on-site infiltration rates and design calculations are provided to demonstrate
feasibility.
Staff note that stormwater runoff from private property must not be directed to the
Lane County road right-of-way or into any Lane County drainage facility, including
roadside ditches. Ditches adjacent to County roads are designed solely to accommodate
stormwater runoff generated by the roadways themselves, per Lane Manual Chapter
15.515.
Transportation
The property abuts Sunnyside Drive, a Lane County Urban Local road; which connects to
River Road (a major arterial). Access management and street standards will be evaluated
at the time of future development.
Comments from Lane County Public Works staff support the inclusion of the adjacent
portion of Sunnyside Drive as part of the annexation request in order to help facilitate
the possibility of transferring Sunnyside Drive to the City of Eugene if and when that
transfer is desired.
Sunnyside Drive’s functional classification as an Urban Local road enables Lane County to
defer to the City of Eugene’s access management requirements and design requirements
for the road (Lane Code 15.137(6), 15.138(2), and 15.704(1)(d)). Lane County Public
Works may provide additional review, if and when the property becomes divided and/or
redeveloped in the future.
Solid Waste
Collection service is provided by private firms. Regional disposal sites and the Short
Mountain Landfill are operated by Lane County.
Water and Electric
EWEB Water staff state no objection to the annexation. EWEB Electric staff also state no
objection to the annexation. Water and electric services can be extended to the subject
property in accordance with EWEB policies and procedures.
Public Safety
Police protection can be extended to this site upon annexation consistent with service
provision through the City. Fire protection will be provided by Eugene Springfield Fire.
Emergency medical services are currently provided on a regional basis by the cities of
Eugene and Springfield and will continue in the same manner upon annexation.

Parks and Recreation
Parks and recreation programs are provided on a City-wide basis. The inclusion of the
subject property in the City is sufficient evidence to demonstrate the minimum level of
this key urban service is met.
Planning and Development Services
Planning and building permit services are provided for all properties located within the
urban growth boundary by the City of Eugene. The Eugene Code, Chapter 9, will provide
the required land use controls for future development of the subject property upon
annexation.
Communications
A variety of telecommunications providers offer communications services throughout
the Eugene/Springfield area.
Public Schools
The subject property is within Eugene School District 4J and is within the district
boundary of River Road Elementary School, Kelly Middle School, and North Eugene High
School. As access to schools is evaluated on a district wide basis, the property’s location
within the school district is sufficient evidence to demonstrate the minimum level of this
key urban service is met.
CONCLUSION:
Based on the above findings, information submitted to date, and the criteria set forth in EC 9.7825, the
proposed annexation is consistent with the applicable approval criteria. A map and legal description
showing the area subject to annexation are included in the application file for reference. The effective
date is set in accordance with State law.

CRITERIA CONFORMANCE STATEMENT
GENERAL CRITERIA
MAY 16, 2018
This criteria conformance statement was written to accompany the annexation
application for Randall Morrow and Denise Thomas. The subject property contains
16,471 square feet and zoned R-1/UL. The application is also requests the annexation
of the adjacent Sunnyside Drive public right-of-way as depicted on the attached site
plan in order to facilitate the annexation of lands contiguous to the city limits. Said public
right-of-way contains 7,368 square feet. The future goal of the annexation is to create a
two parcel partition of the subject property.
9.7825 Annexation – Approval Criteria.The city council shall approve, modify and
approve, or deny a proposed annexation based on the application’s
consistency with the following:
(1)The land proposed to be annexed is within the city’s urban growth
boundary and is:
(a) Contiguous to the city limits; or
(b) Separated from the city only by a public right of way or a stream,
bay, lake or other body of water.
Response: The subject property and adjacent Sunnyside Drive right-of
way are contiguous to property within the city limits, being Assessor’s
Map 17-04-24-32, Tax Lot 4800.
(2)The proposed annexation is consistent with applicable policies in the
Metro Plan and in any applicable refinement plans.
Response: The Metro Plan Policy 10, page 11-C-4, recognizes
annexations through this normal process to be the highest priority. As
such, the proposal is consistent with this policy.
Metro Plan Policy 8 provides for annexation when a minimum level of key
facilities and services can be provided. Please see (3) below for list of key
urban services.

Metro Plan Policy 15 provides that land within the UGB shall be annexed
to a city and provided with the minimum level of urban facilities and
services. It further provides that while the timeframe for annexation may
vary, annexation should occur as land transitions from urbanizable to
urban. The property is within the UGB and therefore, based on this policy,
should be annexed. The provision of facilities and services is addressed in
standard (3) below. The property is currently zoned R-1/UL which is
consistent with the assigned to the site in the Metro Plan.
Metro Plan Policy 17 is instructional to the City to dissolve special service
districts after annexation and to consider intergovernmental agreements
with affected special service districts. This policy is solely informational
with respect the applicant proposal & is to be applied at the discretion of
the City staff.
Metro Plan Policy 19 stipulates the criteria that must be met in order to
annex territory to existing service districts within the UGB. This proposal is
consistent with Policy 19 in the fact that the key urban services are directly
available to the property making immediate annexation to the City a
possibility and the affected property owners have provided the signed
consent to annex agreement with the City of Eugene in accordance
Oregon annexation law.
Metro Plan Policy 20 outlines the methodology for extending new urban
service to unincorporated areas within the UGB. This proposal is
consistent with Policy 20 in the fact that the applicant is requesting
annexation to the City of Eugene, which is the highest priority of all the
methods outlined in Policy 20 for providing new urban service to
unincorporated areas within the UGB.
(3)The proposed annexation will result in a boundary in which the minimum
level of key urban facilities and services, as defined in the Metro Plan,
can be provided in an orderly, efficient, and timely manner.
Response: Key urban facilities and services, as defined in the Metro Plan,
can be provided in an orderly, efficient, and timely manner as follows:
Wastewater service: Wastewater service is currently connected to the
existing single family residence on the subject property via the wastewater
8” main which lies in the Sunnyside Drive right-of-way.
Stormwater: There are no public storm facilities on or adjacent to the
property. The property can be developed through the use of infiltration
facilities for both volume and treatment of stormwater.

Transportation: Sunnyside Drive connects directly to River Road to the
east.
Solid Waste Management: Private firms and individuals collect and
transport solid waste to the Lane County administered landfill. Therefore,
the subject property is currently served with this key urban facility.
Water Service: Water is available from the 4" water main located in
Sunnyside Drive right-of-way.
Fire and emergency medical services: According to RLID, fire protection
is currently provided by the Santa Clara RFPD. Upon annexation, the City
of Eugene will provide services directly to the property. Therefore, the
subject property is already served with this type of"key urban facility."
Police Protection: Police protection will be provided by Eugene, which
currently services other properties inside the city. After annexation this
property will receive police services on an equal basis with all properties
inside the city
City-wide parks and recreation programs: Park services are already
provided to this area, consistent with the Metro Plan. Maurie Jacobs Park
and Emerald Park are in the vicinity of the subject property.
Electric Service: Electric service is available via the overhead line located
within Sunnyside Drive right-of-way.
Land Use Controls: The subject property is subject to the land use
controls of the City of Eugene.
Communication Facilities: Land line phone service, cellular phone and
data service, and cable television are available in the area, and can be
extended to the subject property.

annexations and development in this area will increase the efficiency of service delivery

ISSUE STATEMENT The City Council is scheduled to take action on this request for the annual withdraw of previously annexed properties from special districts.
BACKGROUND The purpose of the ordinance is to remove annexed properties from the tax rolls of special service districts, which in this case are Santa Clara Rural Fire Protection District, Santa Clara Water District, Willakenzie Rural Fire Protection District, Lane Fire Authority, River Road Park & Recreation District, and River Road Water District. State law and local code require annexed properties to withdraw from special service districts through a separate process after the annexation of those properties becomes effective. Annexation of these properties was approved by City Council over the previous year, at the request of the property owners. The City is now providing urban services to these properties; however, they remain on the tax rolls of special service districts until withdrawn. Withdrawals come before the City Council on an annual basis. Properties annexed during the previous year are batched together to facilitate this process. The 2019 batch contains seven annexations approved by City Council in 2018—for a total of 10 tax lots Withdrawals are time-sensitive. State law provides that, if a withdrawal is not approved prior to March 31, the withdrawal does not become effective until July 1 of the following year (i.e., 2020 for these properties). This delay would mean that the properties will remain on the tax roll of the special service districts that no longer provide services to the property for more than a year. Approving the withdrawal ordinance prior to Mar. 31, 2019 will result in the withdrawals taking effect on July 1, 2019 and those properties being included on the City tax roll immediately thereafter. The City is already providing urban services to these properties.

The City Council is scheduled to hold the required public hearing on this item on February 19, 2019. Public notice of the hearing was published and posted as required by state law and local code requirements, including notice to the affected special service districts. The inclusion of these properties on City tax rolls, and withdrawal from special districts taxation, is anticipated by the property owners and by special districts as part of the annexation process. No testimony has been received as of February 12, 2019. Any written testimony received will be provided to council prior to action. The approval criterion for withdrawal from public service districts following annexation is contained in Eugene Code 9.7835, and corresponding statutory provisions at ORS 222.524, which require the City Council to find that approval of the withdrawal is in the best interest of the City. If the council finds that the withdrawals are in the City's best interest, the council is asked to adopt the attached ordinance (Attachment A), which provides for the withdrawal from special service districts of these annexed properties. Maps and legal descriptions of the properties to be withdrawn are provided as exhibits to the ordinance.
PREVIOUS COUNCIL DIRECTION Withdrawals of recently annexed properties from special districts are routinely batch-processed on an annual basis. This is the second step in a two-step process that includes City Council public hearing followed by City Council deliberations and action.
COUNCIL OPTIONS The City Council may consider the following options: 1. Approve the withdrawals by ordinance; 2. Approve the withdrawals by ordinance with specific modifications as determined by the City Council; 3. Deny the withdrawals by ordinance.
CITY MANAGER’S RECOMMENDATION The City Manager recommends adoption of the ordinance as drafted, providing for withdrawal of all listed territories by March 31, 2019.
SUGGESTED MOTION I move to adopt Council Bill No. 5201, an ordinance withdrawing territories from The Santa Clara Rural Fire Protection District; Santa Clara Water District; Willakenzie Rural Fire Protection District; Lane Fire Authority; River Road Parks and Recreation District; And River Road Water District.

RECREATION DISTRICT; AND RIVER ROAD WATER DISTRICT.
The City Council of the City of Eugene finds that:
A. Notice of the proposed withdrawal of real property which has been annexed to the City, but
is currently contained within the boundaries of Santa Clara Rural Fire Protection District; Santa Clara Water
District; Willakenzie Rural Fire Protection District; Lane Fire Authority; River Road Park & Recreation
District; and River Road Water District (“the Districts”) was published in the Register-Guard on February 5
and 12, 2019, posted in four public places in the City of Eugene for a period of two successive weeks prior
to the hearing date, and mailed to the affected public service districts.
B. The Notice provided that a public hearing was scheduled for February 19, 2019, at 7:30
p.m., in Harris Hall at the Lane County Public Service Building in Eugene, Oregon, to allow the City Council
to hear objections to the withdrawals and to determine whether the withdrawals are in the best interest of
the City.
C. The City is willing to assume the liabilities and indebtedness previously contracted by the
Districts proportionate to the parts of the Districts that have been annexed to the City upon the effective
date of the withdrawals as provided in ORS 222.520.
D. The withdrawals of the annexed territories from the Districts are consistent with adopted
City policies, and are in the best interest of the City.
NOW, THEREFORE,
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. The following territories in Lane County, Oregon, annexed to the City of Eugene by
Resolution of the Eugene City Council, are withdrawn from the Districts indicated effective July 1, 2019:

ISSUE STATEMENT This item is an opportunity for the City Council to adopt the Capital Improvement Program (CIP) for fiscal years 2020 through 2025 (FY20–25). The CIP was reviewed and recommended by the City’s Budget Committee on February 20, 2019.
BACKGROUND The Capital Improvement Program is a planning document that forecasts the City’s capital needs over a six-year period based on various City-adopted long-range plans, policies, goals and other planning processes. The FY20–25 CIP totals approximately $312.7 million and includes projects for the Airport, Parks and Open Space, Public Buildings and Facilities, Stormwater, Transportation and Wastewater. The Project Summaries section of the CIP document contains tables summarizing all CIP projects, anticipated annual funding levels and maps indicating the geographic location of CIP projects. The primary goals of the CIP are to:
• Provide a balanced program for capital improvements given anticipated funding sources over a six-year planning period;
• Illustrate upcoming capital needs based on anticipated funding levels;
• The underlying strategy of the CIP is to plan for land acquisition, construction, and the major preservation of public facilities necessary for the safe and efficient provision of services, and;
• Serve as the basis for the Capital Budget for the coming two fiscal years. Capital projects are generally large-scale endeavors in terms of cost, size and benefit to the community. A critical element of a balanced CIP is the provision of funds to preserve or enhance existing facilities and provide new assets that will aid response to service needs and community growth. Changes to the FY20–25 CIP In 2017, the Budget Committee passed a motion to integrate the City’s Climate Recovery Ordinance with the CIP. Changes have been made to the FY20–25 CIP to meet the motion’s

directives by incorporating estimated Greenhouse Gas metrics for CIP projects where feasible. The GHG metrics help quantify the impacts of the City’s infrastructure on the climate. These estimates, along with additional narrative on efforts to reduce emissions by program area, are included in the new GHG Summary section of the document. Changes have also been made to provide more information on specific capital projects within ongoing capital programs. For the first two years of the FY20–25 CIP, the individual capital projects within ongoing capital programs have been provided where feasible. Staff do not always know with certainty which projects within a capital program will be funded, but where possible those projects and related financial and planning information have been provided for FY20 and FY21. This change provides greater transparency for the public, Budget Committee and City Council on individual projects within capital programs and an improved understanding of how the City spends capital budget dollars. This change also enhances the connection between important policy initiatives and more capital projects. FY20–25 CIP Projects The capital projects and ongoing capital improvement programs in this CIP total approximately $312.7 million. Transportation is the largest portion of the CIP, with approximately $92.1 million of anticipated spending. Projects funded by the 2017 Street Bond approved by voters account for $51.0 million of this amount, and pavement preservation capital projects account for $18.6 million. Federal funds are projected to fund $7.2 million in Transportation projects. Airport is the second largest category with $83.3 million in planned projects over the six-year forecast period. Major projects include Concourse C addition to the Terminal Building ($30.0 million), Taxiway Golf ramp construction ($16.6 million), Runway 34R rehabilitation ($11.3 million), and Taxiway C/M rehabilitation ($9.5 million). Public Buildings and Facilities is the third largest category with $51.0 million in proposed projects, including $15.5 million for the Sheldon and Echo Hollow Pools renovation and expansion projects supported by the 2018 Parks and Recreation Bond approved by voters. Additional large projects include a Downtown Urban Renewal project for a permanent Farmers’ Market ($3.1 million) and parking structure deferred maintenance ($4.0 million). Parks and Open Space represents the next largest category with $50.8 million for proposed projects including $19.3 million from the 2018 Parks and Recreation Bond. Major projects include $7.0 million for site renovations and rehabilitations, $5.5 million for the Downtown Riverfront Park, $5.2 million identified for the Park Blocks and Downtown open space improvements, $4.8 million for park renovations, $4.1 million for parkland acquisition, $4.1 million for park and path lighting, and $3.0 million for Phase 1 of a new sports complex. Wastewater is projected to spend $19.0 million on capital projects. Included in these improvements is $15.6 million to preserve and rehabilitate the City’s aging wastewater system,

$2.0 million to replace the West Irwin Pump Station, and $1.5 million for wastewater services for new development. Finally, Stormwater is planning to invest $16.4 million, primarily for rehabilitation and improvements. Projects include the continuation of drywell removal ($3.0 million), which is mandated by the Department of Environmental Quality, and system rehabilitation ($6.6 million). With the exception of General Capital Projects, the vast majority of funding for CIP projects is restricted to a particular use, such as the 2017 Street Bond for transportation projects, funding for airport projects, wastewater and stormwater charges, local motor vehicle fuel tax revenue, system development charges, airport passenger facility charges and more. General Capital Projects refer mostly to capital improvements and preservation for public buildings and facilities, which account for $23.1 million, or 8.7 percent, of planned capital spending over the next six years. General capital projects are primarily funded through the City’s General Fund. CIP Development and Review Process During the summer and fall of even numbered years, staff compiles the draft CIP using input and requests from a variety of sources including council-adopted plans and policy documents, maintenance monitoring programs, funding directives from federal and state grants and mandates, public input and more. The draft CIP is subsequently published and made available to the public. Following review of the CIP by the Budget Committee, and adoption by the City Council, the projects become the basis for preparation of the City’s Capital Budget for the next two fiscal years. The draft CIP document was made available on the City’s website on February 7, 2019. Information about the draft FY20–25 CIP was also sent electronically to interested citizens via the City Council newsletter, Neighborhood Services bulletin, and the Budget Interested Parties e-mail list. Hard copies of the draft CIP document were made available to the public at the Finance Division and the City Manager’s Office. At their request, a presentation on the draft FY20–25 CIP was made to the Planning Commission at their February 25, 2019, meeting. The Budget Committee held a public comment period on the draft FY20–25 CIP on February 20, 2019. One member of the public provided comment expressing thanks and support for the GHG data included in the new document. The committee passed a motion to recommend that the City Council adopt the FY20–25 CIP as proposed.
PREVIOUS COUNCIL DIRECTION City Council acts on the CIP on a biennial basis. The FY20–25 CIP presentation to the Budget Committee and subsequent discussion and recommendation regarding the Draft FY20–25 CIP on February 20, 2019.

COUNCIL OPTIONS The City Council may exercise one of the following two options: 1. The Council may choose to adopt the FY20–25 CIP as recommended by the Budget Committee. 2. The Council may choose to amend the CIP by identifying changes in the projects and/or funding sources and adopt the FY20–25 CIP that includes those changes.
CITY MANAGER’S RECOMMENDATION The City Manager recommends that the council adopt the FY20–25 CIP as recommended by the Budget Committee.
SUGGESTED MOTION Move to adopt the FY 20-25 Capital Improvement Program as recommended by the Budget Committee.

ISSUE STATEMENT This is an action item to review the Mayor’s nomination to the River Guides for the Riverfront Urban Renewal Plan and to appoint a new committee member.
BACKGROUND The concept for the River Guides comes from Section 900 of the 2004 amended Riverfront Urban Renewal Plan, which calls for a committee authorized by the Agency Board to advise on the activities of the District. Section 700 of the Plan sets out that the Agency Board is to approve all projects, other than loans, in excess of $250,000. When appropriate, the River Guides can provide input on those projects. The River Guides provide recommendations to the Agency Director, who then provides them to the Agency Board. Attachment A provides the framework for the committee. The River Guides framework identifies that the committee is to be comprised of seven members who represent the richness of the community’s perspectives, neighborhoods and population demographics. The six existing members are identified in Attachment B. Currently, there is one vacancy on the River Guides. Thomas Fiorelli, appointed to the River Guides in May 2018, recently accepted a position across the country. He will need to relocate for work and can no longer serve on the River Guides. He provided landscape architecture expertise to the committee. The Mayor nominates Karen Williams to replace Mr. Fiorelli on the River Guides. Karen is an architect at PIVOT Architecture in Eugene and brings expertise in architecture and building design to the River Guides, a skill set that is needed in the group. Her application is included as Attachment C.
AGENCY BOARD OPTIONS 1. Appoint the Mayor’s nomination for the River Guides.2.Direct staff to open a recruitment process and generate another applicant pool to select from.3. Choose no replacement at this time.

Riverfront Renewal Guides Framework
Advisory Committee for the Riverfront Urban Renewal Plan The concept for the Riverfront Renewal Guides (River Guides) for the Riverfront Urban Renewal Plan comes from Section 900 of the 2004 amended Plan, which calls for a committee authorized by the renewal agency board of directors to advise on the activities of the District. Charter Advise on the activities of the District. (One of the primary focuses within the District will be with the downtown riverfront redevelopment, which could involve investments in infrastructure, roads, sidewalks, rail road access, housing, commercial, and a world class park.)
Expectations of Members
•Have or develop a basic understanding of the projects and requirements authorized in theRiverfront Urban Renewal Plan.
•Meet as needed, review meeting materials, provide input to advise on best outcomes for thecommunity.
Membership Guidelines
•A total of seven members that represent the richness of the community’s perspectives,neighborhoods and population demographics
•Seek a balanced mix of constituent representatives*, including but not limited to:
o Riverfront stakeholder(s) (resident, property/business owner)
o Representative(s) from the general public
o Member(s) with development/financial/architecture expertise
o Member(s) with ecological/sustainability/river conservation group expertise

o Riverfront partner agency(s) (e.g. UO, LTD, Parks Foundation)
•Terms not to exceed the life of the Riverfront District (approximately seven years)
•A long-term commitment to serve is preferred but not required
•The committee will select a Chair and Co-Chair who will serve for one year periods. TheChair will work with staff on meeting agendas and processes.
* One person may be able to represent more than one interest (for example, a riverfront resident
with financial expertise).
Membership Selection Process The Mayor compiled a list of individuals and recommended seven for Agency Board consideration. The Agency Board selected the committee in October 2017. At the orientation (or soon thereafter), the River Guides will select a committee Chair and Co-Chair. In the event of vacancies, the Mayor will nominate a replacement, striving to maintain a balanced mix of constituent representatives. The Agency Board will approve or deny the Mayor’s nomination.

Staff Support Agency staff will support the work of the River Guides with project, financial, technical, and legal expertise. Staff will also assist with scheduling meetings and facilities, preparing meeting agendas, taking action summary notes at meetings, and other administrative functions deemed necessary and appropriate by the Agency Director. Staff support will be paid for with Agency administrative funds.
Decision Making Process River Guides members will aim to come to recommendations on consensus. Should consensus not be possible, recommendations will be decided based on a majority vote.
Ethics and Conflict of Interest Ethics. The provisions of the Oregon Government Ethics laws apply to actions of individuals who qualify as “public officials.” A “public official” is someone who serves the State of Oregon or any of its political subdivisions (e.g., the City of Eugene) as an elected official, appointed official, employee or agent, whether compensated or not. Volunteers who serve on local boards and commissions have been determined to qualify as public officials subject to the ethics laws. The ethics laws prohibit public officials from using their official positions to obtain financial benefit for themselves, their relatives or associated businesses. The laws also impose certain requirements regarding the disclosure of potential and actual conflicts of interest. Further information on Oregon’s Government Ethics laws can be accessed at ORS Chapter 244 and the following website: http://www.oregon.gov/OGEC/docs/Public_Official_Guide/2010-10_PO_Guide_October_Final_Adopted.pdf Conflict of Interest. A River Guides member could have a potential conflict of interest. A potential conflict of interest exists if a public official, in the discharge of his or her official state duties, would be required to take an action that would affect his or her financial interest, or the financial interest of his or her spouse, parent, brother, sister, child, spouse of the child, or a business with which the official or employee is associated. If a potential conflict applies, a committee member must either a) abstain from taking official action on the matter or b) prepare a written statement explaining the potential conflict and why despite the potential conflict they are able to act fairly, objectively, and in the public interest.
Chair and Co-Chair Roles and Responsibilities: 1.The Chair and Co-Chair shall serve for one (1) year. The election will be held at the first RiverGuides meeting of each calendar year, starting in 2019. If the Chair cannot serve a full term, the Co-Chair shall assume the office for the remainder of the Chair’s term. If the Co-Chair cannot serve a full term, the River Guides shall, at the meeting in which the resignation is received, elect a new Co-Chair to complete the unexpired term. If both Chair and Co-Chair vacate their respective positions prior to the end of their terms, elections will be held at the following meeting to fill both offices. 2.Committee members may not be elected as Chair for more than two (2) successive terms.3.The Chair shall facilitate all meetings of the River Guides and consult with staff on preparation ofmeeting agendas.4.The Co-Chair shall perform the duties of the Chair in the absence or inability of the Chair.5.The Chair and Co-Chair are entitled to vote on all issues.

6.The Chair or Chair’s designee is the official spokesperson for the River Guides on all matters of thecommittee that concern the community. This includes media inquiries.7.The Chair and Co-Chair will work with staff to ensure that all River Guides review and approvewritten committee materials. The Chair or Co-Chair will sign all materials provided on behalf ofthe River Guides to the Agency Director (City Manager), if any.Selection Process: 1.The officers of the River Guides shall be the Chair and Co-Chair elected from among the 7members of the committee. To be eligible for chair nomination, a member must have served on the River Guides for at least one (1) year. 2.Any member may nominate a candidate for the position of Chair or Co-Chair. Nominations neednot be seconded.
3.A member may decline nomination because of an inability to serve.4.Any member may move to close the nominations; a second is required. If the motion carries, theChair then calls for the election.5.The votes of all members will be recorded by staff. The candidate who receives a majority of thevotes cast becomes the new chair.
