AN ORD][NANCE CONCERNING TELECOMMUNICATIONS
AND AMENDING SECTION 3.415 OF THE EUGENE CODE,
1971, AND PROVIDING AN IMMEDIATE EFFECTIVE DATE~
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. SrfDsections (1) and (8)(a) of Section 3.415 of the Eugene Code, 1971, are
amended and a new subsection (9) is added to Section 3.415 of the Eugene Code, 1971, as follows:
3:415 Telecommunications - Annual Registration and License Fees.
(1) Aunual Registration Fee. Each person required to register under section 3.405
of this code, except an operator of a private communications system, shall pay to the city an ammal
registration fee ~n the amount of 2% of the registrant's gross revenues derived from its
~elecommunicafion acfivkies wkhin the city. In addition, the first anrmal registration fee paid by a
reg}strant shalt include ~ addkional charge, in an amount set by the city' manager pursuant to section
2.020 of this code, that is calculated to recover all of the city's costs incurred in processing the
registration, as well as a share of the city's costs in preparation of the city's telecommunications
plan, this ordinance, and the implementing rules.
(8) Penalties and Interest.
(a) Any registrant or licensee who has not been granted an extension of
time for remittance of a f~e due and who fails to remit any fee imposed reader this
section prior to delinquency shall pay a penalty of ten percent (10%) of the amount
of the fee due in addkion m the amount of the fee.
(9) Calculation of Fees. In determining gross revenues for the calculation of fees
under this section, the city shall consider mobile telecommunications services to occm- within the
cky if they are used by a customer whose place of primary use is wkhin the city. As used in this
section, ~;place of primary use" means the residential street address or the primary business street
address of the customer. The city shall apply this provision consistently with the Mobile
Telecommunications Sourcing Act, 4 USC 116 to 126.
Section 2. The City Recorder, atthe request of, or with the concurrence of the City Aaorney,
is authorized to administratively correct any reference errors contained herein or in other provisions
of the Eugene Code, 1971, to the provisions added, amended or repealed herein.

Section 3~ This Ordinance shall become effective immediately upon its passage by the City
Council and approval by fhe Mayor or passage over the Mayor's veto.
Section 4. An effective date of less than 30 days after adoption is necessary in order to avoid
confusion concerning the meaning of the fee calculation provisions and thereby to ensure that fhe
City can begin calculating and collecting all the revenues intended to be collected 'under the Code
provisions being amended. Further delay potentially could reduce the City's revenues or increase
administrative costs.
