HomeMy WebLinkAboutOrdinance No. 20290 ORDINANCE NO. 20290 AN ORDINANCE CONCERNING THE CHANGE OF STREET NAME OF CENTENNIAL BOULEVARD, LOCATED-WITHIN THE CITY OF EUGENE BETWEEN COBURG ROAD AND INTERSTATE 5~ TO MARTIN LUTHER KING JR. BOULEVARD. The City Council of the City of Eugene finds that: A. On Jarma~ 13, 2003, the City Council passed a motion by a unanknous vote to initiate the processing of a street name change application to change Centennial Boulevard to Martin Luther King Jr. Boulevard. B. ORS 227.120 and Eugene Code (EC) Sections 9.8475 through 9.8490 set forth the procedures for considering a street name change, which includes a Type IV review process requiring the planning commission to hold a public hearing according to the quasi-judicial procedures of state law and those set out in EC 9.7065 through 9.7095, and to make a recommendation to the City Council to approve, approve with modifications, or deny the application. On March 21, 2003, notice of a public hearing to be held by the Eugene planning commission was mailed to property' owners and occupants within 300' of Centennial Boulevard, to the affected Eugene neighborhood association and to persons who requested notice. Notice was also posted and freestanding signs were installed pursuant to EC 9.7415. D. On April 22, 2003, the Eugene planning commission held a public hearing on the proposed street name change, and following the public hearing, the planning corrnnission unanhxaously recommended (6:0) that the City Council approve the proposed street name change. E. On May 11, 2003, notice of the Eugene City Council public hearing and proposed ordinance were published in the Register-Guard as required by Section 28 of the Eugene Charter of 2002. On May 16, 2003, notice of the Eugene City Council public hearing was mailed to all parties who submitted written or oral testimony and to parties who requested notice of the planning commission decision, pursuant to EC 9.7440. On May 21,2003, notice of the Eugene Cky Council public hearing was published in the Register-Guard, as required by EC 9.7440(3). On May 27, 2003, the Eugene City Council held a public hearing on the proposed street name change, and the Eugene City Council is now ready to take action. G. Evidence exists within the record and the findings attached hereto establishing that the proposal meets the requirements of Chapter 9 of the Eugene Code, 1971, and the requirements of applicable state and local law. NOW, THEREFORE THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. In accordance with the Eugene planning commission recommendation, the street name "Centermial Boulevard," extending east from Coburg Road to Interstate 5 within the city of Eugene, as shown on Exhibit A attached hereto, is hereby changed to "Martin Luther King Jr. Boulevard.' Section 2~ The above findings, and the findings set forth in Exhibit B attached hereto are adopted in support of this Ordinance. Section 3. The Ci~ Manager is directed to cause appropriate signs to be installed indicating that Centennial Boulevard, as described in Section 1 above, is now Martin Luther King Jr. Boulevard. Section 4. Certified copies of this Ordinance shall be filed with the Lane County Recorder, the Lane County Assessor, and the Lane County Surveyor. Section 5. If any section, subsection, sentence, clause, phrase or portion of this Ordinance is for any reason held invalid or unconstkutional by a court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the val~dky of the remaining portions thereof. Passed by the City Council this Approved by the Mayor this day of June, 2003 mty City Recorder k~ta day of June, 2003 0 0 0 EXHIBIT A Exhibit B Findings of Consistency with Street Name Change Criteria Section 9.8485 of the Eugene Code, 1971 (EC) provides the sole criterion for evaluating a proposed street name change, stating: EC 9.8485 Street Name Change Approval Criteria, The planning commission shall recommend~ and the city council shall approve an application for a street name change upon determining that a proposed renaming is in the best interest of the city. Based on Plamfing Commission's recommendation, the records of the public b_earings before both the Planning Co~ission and the City Council, including the citizen testimony presented at those hearings, the City Council finds that it is in the best interest of the City to honor the memory of Dr. Martin Luther King, Jr. by changing the name of Centermial Boulevard to Martin Luther King Jr. Boulevard. The City Council f;arther finds that the provision of key public services to residents and businesses located along the street Mil not be adversely affected by the proposed street name change~ The U. S. Postoffice and 9- l- 1 emergency center have indicated their support for the proposed street name change, both indicating that they can make the necessary changes to their database systems in a timely manner. The City, the U.S. Postoffice and the emergency center will implement the street name change over a one-year period. The Cky Council finds that this irnplementation of the street name change over a one-year transition period will minirnize inconvenience and confusion to residents, businesses and the general public.
