ISSUE STATEMENT
Pursuant to Oregon Revised Statutes, Chapter 222, territories annexed to cities are withdrawn from
special service districts through a separate process after the annexation of those areas becomes effective.
The City Council is asked to adopt the attached ordinance providing for the withdrawal from special
service districts of recently annexed territory.
BACKGROUND
Withdrawals routinely come before the council on an annual basis. Properties annexed during the
previous year are batched together to facilitate this process. The 2006 batch contains the 32 annexation
requests made by property owners in 2006 for which withdrawals are needed.
In accordance with state law, withdrawals from special districts are initiated by the council passing a
resolution setting a time and place for a public hearing for the purpose of hearing objections to the
withdrawals. Such resolution (Resolution No. 4901) was passed by the council on January 22, 2007.
Public notice of the hearing was published and posted as required by State law. The attached ordinance
(Attachment A) describes the affected properties and withdraws them from special districts. After the
public hearing, the council will be asked to determine whether the withdrawals are or are not in the
City’s best interest. If the withdrawals are found to be in the City’s best interest, the ordinance should
be adopted to make the withdrawals effective.
Withdrawals are time-sensitive. The Oregon Revised Statutes, Chapter 222, provide that, if the
withdrawal is not approved or enacted prior to March 31, 2007, the withdrawal does not become
effective until July 1 of the following year. If the withdrawal is not effective by July 1, these properties
will remain on the tax roll of the special service districts that no longer provide services to the property.
Enacting the withdrawal ordinance prior to March 31, 2007, will result in the withdrawals taking effect
on July 1, 2007. To meet this deadline, staff requests that the council take action at the close of the
public hearing, time permitting. Based on previous years' withdrawals, little or no public testimony is
anticipated. Alternatively, action on this item has been tentatively scheduled for March 12, 2007

Annexation of the subject parcels was initiated by the property owners, in most cases to facilitate
development. The inclusion of subject parcels on City tax rolls, and withdrawal from special districts
taxation was anticipated by the applicants as part of the annexation process.
Legal descriptions (Exhibits 1 through 32) and maps showing the location of each annexed property
subject to withdrawal are included in the council packet for the public hearing
RELATED CITY POLICIES
None. Properties are withdrawn from special districts upon annexation to the City as a result of the City
assuming responsibility for providing urban services. Withdrawal of properties from rural fire
protection districts occurs automatically upon annexation, while a separate process is required by State
law for withdrawals from a water supply district, sanitary district, or park and recreation district.
COUNCIL OPTIONS
There are no council options regarding the public hearing, which is required by state law. The City
Council may consider the following options for action following the hearing:
1. Adopt the ordinance as drafted, keeping the withdrawal process on track to meet the March 31
deadline for including the withdrawn properties in the City’s tax rolls for the coming fiscal year.
2. Pass an amended ordinance including some, but not all of the listed withdrawals.
3. Take no action at this time, thereby leaving all the properties on the tax rolls of the special districts
for the coming fiscal year.
CITY MANAGER’S RECOMMENDATION
The City Manager recommends adoption of the ordinance as drafted, providing for withdrawal of all of
the listed territories by March 31, 2007.

AN ORDINANCE PROVIDING FOR WITHDRAWAL OF TERRITORIES
FROM THE RIVER ROAD WATER DISTRICT AND THE RIVER ROAD
PARK AND RECREATION DISTRICT, AND FROM THE SANTA
CLARA WATER DISTRICT. (CB #4939)
The City Council of the City of Eugene finds that:
A.
Resolution No. 4901, adopted on January 22, 2007, proposed withdrawal from the
River Road Water District and the River Road Park and Recreation District, and from the Santa
Clara Water District (“the Districts”), the parts of the Districts annexed to the City as described
in Exhibit A attached to that Resolution.
B.
The Resolution set February 20, 2007, at 7:30 p.m., in the Council Chambers,
City Hall, in Eugene, Oregon, as the time and place for hearing objections to the withdrawals,
and directed that notice of the time and place of the hearing be published once each week for two
successive weeks prior to the hearing and that the notice be posted in four public places in the
City for the same period. The Notice has been so published in the Register Guard and posted in
four public places in the City of Eugene, Oregon.
C.
The City is willing to assume the liabilities and indebtedness previously
contracted by the Districts proportionate to the parts of the Districts that have been annexed to
the City upon the effective date of the withdrawals.
D.
The withdrawals of the annexed territories from the Districts are consistent with
the fundamental principles and applicable policies of the Eugene-Springfield Metropolitan Area
General Plan, and other adopted City policies, and it is in the best interest of the City that the
territories be withdrawn.
NOW, THEREFORE,
