ISSUE STATEMENT
The City Council is scheduled to take action on this request to withdraw from special districts properties
annexed to the city in the last year.
BACKGROUND
The City Council held its public hearing on this item on February 20, 2007. No public testimony was
received, and the council closed the public record.
There are 32 territories now annexed to the city which are to be withdrawn from special service districts.
These represent annexations initiated by property owners and approved in 2006. The City Council is
asked to adopt the ordinance (Attachment A) which provides for the withdrawal from special service
districts of these annexed territories. Oregon statutes provide only one general approval criterion for
withdrawals: that the City shall determine whether such withdrawal is for the best interest of the city
(ORS 222.524). If the council finds that the withdrawals are in the city's best interest, the ordinance
must be approved by March 31, 2007, or the withdrawals will not become effective until July 2008, and
these properties will remain on the tax roll of the special service districts that no longer provide services
to the property.
The council packet for the February 20, 2007, public hearing contains the ordinance and legal
descriptions (Exhibits 1 through 32) and maps (Maps 1 through 32) showing the location of each
annexed property subject to withdrawal. The ordinance and exhibits are provided here again, for the
City Council's convenience. (Note: Subsequent to the public hearing, a typographical error was
discovered in the legal description for one property, Exhibit 30. The attached exhibits include the
corrected exhibit.)
RELATED CITY POLICIES
None. The process for withdrawals from special districts is prescribed by State law.

COUNCIL OPTIONS
The City Council may consider the following options:
1. Adopt the ordinance as drafted, keeping the withdrawal process on track to meet the March 31
deadline for including the withdrawn properties in the City’s tax rolls for the coming fiscal year.
2. Adopt an amended ordinance including some, but not all of the listed withdrawals.
3. Take no action at this time, thereby leaving all the properties on the tax rolls of the special districts
for the coming fiscal year.
CITY MANAGER’S RECOMMENDATION
The City Manager recommends adoption of the ordinance as drafted, providing for withdrawal of all of
the listed territories by March 31, 2007.
SUGGESTED MOTION
Move to adopt an ordinance withdrawing territories from the River Road Water District and River Road
Park and Recreation District and from the Santa Clara Water District.

ORDINANCE NO. ___________
AN ORDINANCE PROVIDING FOR WITHDRAWAL OF TERRITORIES
FROM THE RIVER ROAD WATER DISTRICT AND THE RIVER ROAD
PARK AND RECREATION DISTRICT, AND FROM THE SANTA
CLARA WATER DISTRICT.
The City Council of the City of Eugene finds that:
A.
Resolution No. 4901, adopted on January 22, 2007, proposed withdrawal from the
River Road Water District and the River Road Park and Recreation District, and from the Santa
Clara Water District (“the Districts”), the parts of the Districts annexed to the City as described
in Exhibit A attached to that Resolution.
B.
The Resolution set February 20, 2007, at 7:30 p.m., in the Council Chambers,
City Hall, in Eugene, Oregon, as the time and place for hearing objections to the withdrawals,
and directed that notice of the time and place of the hearing be published once each week for two
successive weeks prior to the hearing and that the notice be posted in four public places in the
City for the same period. The Notice has been so published in the Register Guard and posted in
four public places in the City of Eugene, Oregon.
C.
The City is willing to assume the liabilities and indebtedness previously
contracted by the Districts proportionate to the parts of the Districts that have been annexed to
the City upon the effective date of the withdrawals.
D.
The withdrawals of the annexed territories from the Districts are consistent with
the fundamental principles and applicable policies of the Eugene-Springfield Metropolitan Area
General Plan, and other adopted City policies, and it is in the best interest of the City that the
territories be withdrawn.
NOW, THEREFORE,
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:

The following territory in Lane County, Oregon, annexed to the City of
Eugene on May 17, 2006, by Notice of the Lane County Local Boundary Commission approved
on March 24, 2006, is withdrawn from the River Road Water District and River Road Park and
Recreation District, effective July 1, 2007:
Tax Lots 3600, 3700, and 3800, Assessor's Map 17-04-14-23, located in the River
Road region of north Eugene, south of Beltline Road, west of River Road, north
of Boyce Street, west of Park Avenue, southwest of Armstrong Avenue, east of
