DELEGATION OF AUTHORITY TO REQUEST EMERGENCY
ASSISTANCE AND RESPOND TO REQUESTS FOR EMERGENCY
ASSISTANCE.
The City Manager Pro Tern of the City of Eugene finds that:
A. Under the provisions of Section 16(2) of the Eugene Charter of 2002, the City
Manager is given authority to make purchases, appoint and remove all employees, and act as the
business agent for the City Council in connection with the sale of real estate and other business
and commercial transactions.
B. Pursuant to ORS 402.200-402.255, under the Oregon Resource Coordination
Assistance Agreement (ORCAA) created pursuant to ORS 402.210, the state government , each
local government that has not opted out of participation, and tribal governments that have opted
in to participation ("participants") may request assistance from other participants in order to
prevent, mitigate, respond to, or recover from an emergency or disaster.
C. Pursuant to ORS 402.215, requests for assistance, and responses to requests for
assistance, must be made by or through the presiding officer or chief executive officer of the
participating local government, or their designee(s).
D. In the event of an emergency or disaster, it may be necessary for the City to request
assistance from other participants, or to respond to requests from requesting participants, to address
the emergency or disaster. It would be most efficient and in the public interest to delegate
expenditure and contract signing authority, and the authority to request assistance and respond to
requests for assistance.
NOW, THEREFORE,
THE CITY MANAGER PRO TEM OF THE CITY OF EUGENE ORDERS AND
DIRECTS THAT:
1. In order to prevent, mitigate, respond to, or recover from an emergency or
disaster, the personnel listed below are authorized to:
(a) Request assistance in emergency and disaster situations from Oregon
Resource Coordination Assistance Agreement (ORCAA) participants;
(b) Respond to requests for assistance from OR CAA participants in emergency
and disaster situations; and

( c) Make expenditures , and execute contracts and change orders for contracts ,
not to exceed the amounts indicated below per transaction or contract, as necessary to
receive from, or provide assistance to, ORCAA participants in emergency or disaster
situations.

When the Emergency Operations Center is fully or partially
activated:
Assistant City Manager, Department Executive Directors; and
City Attorney

2. Nothing in this Administrative Order is intended to waive the City's compliance
with applicable provisions of budget law or public contracting laws and rules.
3. The delegation of authority contained in this Order shall be construed to extend to
and include any person or persons "acting in capacity."
4. The authority delegated in this Order shall not be further sub-delegated.
