1.Work Session and Possible Action: An Ordinance Concerning Accessory Dwellings; Replacing
the Term “Secondary Dwelling” with “Accessory Dwelling” Throughout the Eugene Code
1971; Making Additional Amendments to Sections 9.0500, 9.2010, 9.2011, 9.2740, 9.2741,
9.2750, 9.2751, 9.2775, 9.3060, 9.3115, 9.3125, 9.3210, 9.3215, 9.3310, 9.3510, 9.3615,
9.3625, 9.3810, 9.3811, 9.3815, 9.3910, 9.3915, 9.3970, 9.6410, and 9.8030 of that Code; and
Addressing the Oregon Land Use Board Of Appeals’ Remand of Ordinance Nos. 20594 And
20595.AIC Planning Director Alissa Hansen gave a summary of proposed changes to accessory dwellingunit regulations.Mayor Vinis recommended that council put the motion on the table before discussion; said shehopes that council lands on direction tonight so that the City is in compliance with state law,understanding that this is a shifting landscape.

Discussion
Mayor Vinis - said that her plan for the meeting was to start with councilors putting theirspecific motions on the table.
Councilor Syrett - said she had planned to bring a motion to remove minimum lot sizes related toADUs, but learned from staff that there are complicating factors in terms of related processes andasked staff to explain these complications; said that in the continuing work to comply with HB2001, council will need to revisit how density requirements are defined and she hoped to addressequity issues then; talked about a constituent recommending a slight change to the interiorsetback height limits, expanding from 8 to 10 feet, that would have minimal exterior impact, butopens up interior design options.

MOTION TO AMEND: Councilor Syrett, seconded by Councilor Pryor, moved to amend Section 8 of the ordinance to change the references from 8 feet to 10 feet currently located in EC 9.2751(17)(a)3.b, EC 9.2751(17)(b)5.a, EC 9.2751(17)(c)9.a, EC 9.2775(5)(e)3.a. Discussion
Councilor Clark – asked how HB 2001 alters the density calculation and how that will impact the issue of density; asked why it is a good idea to land on decisions around ADUs prior to LUBA’s decision coming up in a few weeks; asked about the definition of accessory dwelling unit and the mandate in HB 1051 to continue with clear and objective standards and if the City’s definition is clear and objective; said that a really clear definition of ADU will be needed in order to later address incentives; asked if the City could use its own definition for ADU and not the state’s.
Councilor Taylor – said she thinks that in order to call something an accessory dwelling it needs to be accessory to something; said she supported discussing each item separately, noting that she would vote against the motion unless they are separated; said she did not think the state should preempt the City’s authority especially on land use issues and anything to resist the preemption should be considered.
Councilor Semple – asked how Councilor Syrett’s amendment differs from Councilor Yeh’s amendment at the last work session regarding slope.
Councilor Pryor – said he thinks the impact the proposed motion will have on aesthetics is minimal, but it improves the ability to have a decent-sized wall and so he is supportive.
VOTE ON MOTION TO AMEND: PASSED 8:0.
Councilor Zelenka – said that he does not like this law because it’s a one-size-fits-all structure that will likely have many unintended consequences; spoke about the area around the university that has unique pressures related to student housing and that the bill will actually make low- to moderate-income housing disappear in this area; said keeping the two provisions in his motion are reasonable design and siting standards to maintain the livability in these areas related to maximum bedrooms and occupancy.
MOTION TO AMEND: Councilor Zelenka, seconded by Councilor Semple, moved to amend Section 8 of the ordinance to retain the standard entitled “Maximum Occupancy” currently located at EC 9.2751(17)(c)8 and to renumber the remaining subsections accordingly.
Councilor Semple – said she had mixed feelings about this motion because she wants it to be fair to everyone, but also agreed that the university area is a different situation; expressed concern about using the “cookie cutter” approach, but there are neighborhood differences.
Councilor Clark – said he agrees with the intent of the motion and that the university area reflects a different use around an event center; said he’d like to leave the ordinance broad and general because what Eugene looks like today might change for tomorrow and other areas might also be impacted later; said he would not support the motion, though he likes the idea.
Councilor Taylor – said she would vote for the motion if it applied all neighborhoods but was not supportive if it is only restricted to university neighborhoods.
Councilor Evans – asked what the affect would be if the motion was applied to all neighborhoods.
Councilor Clark – asked what argument was used in favor of the standard as reasonably related to siting and design.

Councilor Syrett – said she doesn’t love the exception framework but recognizes the particular pressures that these neighborhoods have been under; said the current exceptions that these neighborhoods have are for valid reasons and she would vote in favor of the motion.
Councilor Pyror – said there was a reasonable argument to be made for why neighborhoods are different; asked how the bedroom and occupancy exceptions relate to the removal of owner-occupancy in the state bills; said he would support the motion.
Councilor Semple – asked if this is one of the issues that is being challenged now; asked if the “five unrelated people rule” comes in when figuring out occupancy; asked what the effect would be of deciding one way or another as far as getting remanded or sued; asked about the difference between regulations and CC&Rs; asked how it will shift things if all R-1 zones become R-2 zones with HB 2001 and the refinement zones are mostly R-2 zones; said she thinks this might make the refinement plans moot.
Councilor Yeh – said she was not in favor of either of Councilor Zelenka’s motions because she does not think that these motions will get at some of the behavioral problems that people have.
Councilor Taylor – said that if HB 2001 is implemented, every neighborhood will be threatened and she would prefer if this applied to all neighborhoods; said she would vote for the proposed amendment asked about the enforcement of CC&Rs.
Councilor Clark – said that Western Title has a record of all CC&Rs and they are not hard to find; asked if the City will issue a permit if it knows about existing CC&Rs and if advisement is given when individuals apply for permits.
Councilor Zelenka – said he’s often surprised about what students put up with in cramming a ridiculous number of young adults into small spaces; said this impacts the livability of the neighborhoods; said that his amendments are directly related to design and siting and he hoped council would support the motion.
Councilor Semple - asked if having five unrelated people in a house is a complaint-driven issue and whether it could be addressed in the university area by simply taking complaints. VOTE ON MOTION TO AMEND: PASSED 7:1, Councilor Yeh opposed.
MOTION TO AMEND: Councilor Zelenka, seconded by Councilor Clark, moved to amend Section 8 of the ordinance to retain the standard entitled “Maximum Bedrooms” currently located at EC 9.2751(17)(c)7 and to renumber the remaining subsections accordingly.
Councilor Taylor – said the motion should apply to the whole city.
VOTE ON MOTION TO AMEND: PASSED 7:1, Councilor Yeh opposed.
Councilor Semple – said that her potential motions came from constituents related to the JWN and S-C refinement areas, acknowledging her respect for these standards and the complicated nature of the issue; explained that while her motions address parking, the state is eliminating any requirements for on-site parking; asked how that affects these refinement zones; asked who would challenge it if council made the refinement zones different; said she’d like to protect the zones but doesn’t know how to do that if council isn’t addressing parking.
MOTION TO AMEND: Councilor Semple, seconded by Councilor Clark, moved to amend section 18 to delete the entire proposed amendment to subsection 9.3625(3)(d)3; and to replace the entirety of the proposed amendment to subsection 9.3625(7) with the following: (7) Parking Standards. (a) Except as provided in (3)(d)3. Above and subsection (7)(b), below, each dwelling shall have one on-street or on-site vehicle parking space for every three bedrooms, rounded up to the next whole number

(i.e. a four-bedroom dwelling must have at least two parking spaces). For purposes of this subsection, each uninterrupted twenty feet of lot line that abuts a street right-of-way where parking is legal within the entirety of that twenty feet shall count as one on-street parking space. The twenty feet may not include any portion of a curb cut. (b) When there are two or more dwellings and there is no on-street parking space, as defined in subsection (7)(a), above, the parking space requirement shall be waived for one dwelling that has primary vehicle access from the street and no more than three bedrooms. [(b)](c) No portion of a vehicle parking area may be located in the area defined by the Street Setback minimum standard (i.e., from which structures, other than permitted intrusions, are excluded) or between the street and the residential building façade that faces, and is closest to, the street. And to renumber the code sections and cross-references accordingly.
Mayor Vinis – asked for clarification about what this motion would be changing from the draft ordinance.
Councilor Clark – asked about Eugene’s density and how that number related to other cities; suggested that other city’s densities are different than Eugene’s; said that the legislature didn’t take livability factors into account when they decided the reasonable criteria for siting and design; said parking is one of the most obvious livability issues, influencing the ability for buses and garbage trucks to drive within street lanes; said the parts of town in Councilor Semple’s motion are where the most likely dangerous realities will occur by forcing more cars to the street; said the legislature was wrong and the City should be able to require on-site parking for each of the people who live in a dwelling.
Councilor Zelenka – asked if the amendment would basically put a requirement on ADUs to have either on-street or on-site parking; said the state legislation explicitly prohibits local regulations related to owner-occupancy requirements or requirements to construct addition off-street parking; asked if the amendment would require in some circumstances additional off-street parking; asked how an on-street parking space is determined for a dwelling.
Councilor Pryor – clarified that this amendment is specific to properties with a second dwelling, not all property; asked about the scale of impact if this motion were to pass; said he doesn’t want to change regulations to address a problem that doesn’t exist in some areas, but if the intent of the motion is to restrict this to an area that is already having parking problems, he could support the proposed remedy; expressed concerns about running afoul of state law that might have to roll back later.
Councilor Syrett – clarified that this amendment would only apply to JWN zone for any ADU development; asked about waiver of parking requirement for one dwelling that has a primary vehicle access from the street and no more than three bedrooms and how that would apply to an ADU above a garage or backyard cottage without vehicle access; said she has too many questions about the impact and will not support the amendment.
Councilor Taylor – said East Amazon no longer has street parking and asked if that meant that those houses could not have an accessory dwelling; said she has a problem with this motion only applying to Jefferson Westside.
Councilor Clark – said he would vote in favor of the motion because there won’t be a lot of ADUs built in Jefferson Westside; talked about the traffic issues that will impact River Road and Santa Clara where ADUs are likely to be built; suggested that this will help inform how this amendment will apply in one area when the question comes up if it should be applied in other areas later.
VOTE ON MOTION TO AMEND: PASSED 6:2, Councilors Yeh and Syrett opposed.

MOTION TO AMEND: Councilor Semple, seconded by Councilor Clark, moved to amend section 25 to replace the proposed additional text: Additional one family dwelling in the SJW Jefferson Westside Special Area Zone or the R-2 sub area of the SC Chambers Special Area Zone in Table 9.6410 with the following text: For one additional one family dwelling in the R-2 subarea of the SC Chambers Special Area Zone.
Mayor Vinis – asked for clarification about what the current ordinance says and what it would say if this motion were passed.
Councilor Zelenka – clarified that the motion would strike “SJW Jefferson Westside Special Area Zone or”; asked if this motion would make the code consistent with the last motion passed.
Councilor Yeh – asked for further clarification about how this motion clarifies the first motion; asked if these changes will comply with state requirements. VOTE ON MOTION TO AMEND: PASSED 8:0.
MOTION TO DIVIDE: Councilor Taylor, seconded by Councilor Clark, moved to give the City Manager final direction for preparing of the draft ordinance through separate motions that address each of the regulatory topics originally set out in the 2/20/2019 Summary and Initial Analysis of Accessory Dwelling Regulation Matrix.
Councilor Pryor - said council had been talking about this for so long and he didn’t see the benefit of breaking up the ordinance, that it’s in a comprehensive form and council should move forward on the ordinance as a package.
Councilor Syrett – said she was going to vote against the motion because council had discussed each issue on an individual basis and taken votes along the way and she didn’t see the purpose in doing that again.
Councilor Clark – said some of council’s specific questions couldn’t be answered yet and there were some that are dependent upon LUBA’s decision; said he was uncomfortable with portions of the proposed motion, especially the lack of a clear definition for an ADU; said he would vote in favor of the motion but wished for greater clarity.
Councilor Semple – said that council had already talked about all of these issues and at this point they needed to make some decisions to move forward, acknowledging that case law will clarify and develop things; said she was ready to move on to the next phase.
Councilor Zelenka – said council had discussed each of these issues individually and he was ready to move on. VOTE ON MOTION TO DIVIDE: FAILED 2:6, Councilors Taylor and Clark voted in favor.
Councilor Semple – asked staff to go over the issues related to flag lots.
Councilor Taylor – said she would be voting against the motion because she didn’t want to get rid of owner occupancy requirements, opposed allowing ADUs on flag lots, and expressed concern that affordable housing will get torn down and luxury places will be built instead.
Councilor Zelenka – said he would reluctantly vote in favor; said he thought parts of the ordinance will be counterproductive, but that the intent of the state law was clear and these changes make the City’s code in compliance with the law. VOTE ON MAIN MOTION AS AMENDED: PASSED 6:2, Councilors Taylor and Clark opposed.

1.PUBLIC HEARING: An Ordinance and Resolutions Adopting Modifications to the Parks
and Recreation System Development Charge Methodology
Proposed Resolution Adopting the Parks and Recreation SDC Project Plan; Repealing
Resolution No. 4863; and Providing an Effective Date.
Proposed Resolution Adopting Amendments to the System Development Charge
Methodologies (General Methodology and Appendices A and F) Originally Adopted by

Councilor Clark – said that council learned from staff that the City can build fifty-one newpark projects without raising the current SDCs; said he would prefer not raising the SDCs atall, but that to meet in the middle he planned to make the motion to postpone raising theSDC for two years.
Councilor Syrett – asked for staff to provide information at the work session about what theimpact would be on the project list if council were to postpone raising the SDCs for twoyears and if that would allow for modification of the phase-in strategy; asked about theadministrative fees collected with SDCs and what the plan be would be for that money if theSDCs were raised and more administrative money was coming in.
Councilor Semple – said she loves parks and wants to move forward on the project list, butshe’s not sure that the time frame is essential; said she’s concerned that the City is notincentivizing housing and instead is increasing fees to build housing.
Councilor Zelenka – said he’s interested in not disincentivizing low- and moderate-incomehousing; said he’d like to see if there could be a waiver or lower amount for houses under a

certain amount, whatever number was used with the CET; said he’d like to see this analysis done for the work session.
2.Public Hearing and Possible Action: A Resolution Annexing Land to the City of Eugene

Councilor Clark – responded to the speaker and said that sometimes council schedules ahearing about an annexation to give neighbors an opportunity to express their concerns.
Councilor Zelenka – asked a question about how the property would be accessed.
Councilor Syrett – thanked the property owner for coming the public hearing; explainedthat there had been an objection to the annexation at a public forum in November andcouncil decided to schedule a public hearing to give sufficient time for people to makecomments if there were concerns.Mayor Vinis closed the public hearing and the record.
MOTION AND VOTE: Councilor Semple, seconded by Councilor Yeh, moved to adopt a resolution approving the proposed annexation request, consistent with the applicable approval criteria. PASSED 8:0. The meeting adjourned at 7:58 p.m.

Councilors Present: Emily Semple, Betty Taylor, Jennifer Yeh, Greg Evans, Claire Syrett, Chris Pryor, Alan Zelenka, Mike Clark Emily Semple opened the January 27, 2020, meeting of the Eugene City Council in the absence of Mayor Vinis.
1.COMMITTEE REPORTS AND ITEMS OF INTERESTCouncil Discussion
•Councilor Taylor – reported on items that were raised by constituents, including traffic issuesand stop signs on E. Amazon, opening walls on Kesey Square, two-hour time limits at SkinnerButte Park, and the need for the homeless shelter; expressed the desire to locate the shelterdowntown, possibly at the old LCC building.
•Councilor Clark – asked the City Manager to brief the City Council about an article in thenewspaper regarding discussions with the County about the use of fairgrounds property for ahomeless shelter.
•Councilor Semple – talked about attending the Poverty and Homeless Board shelter meetingwhich is working on site locations.
•Councilor Clark – discussed work being done with the Country to determine whether thefairgrounds property is a viable site for a shelter; asked about the potential sites and timelinefor the 75-bed shelter
•Councilor Syrett – Spoke about working together with the County, their role in the fairgroundssite location and what the article outlined; confirmed with the City Manager that the Countrycan proceed with the site without the City’s involvement; shared feedback received about thefairgrounds site and potential impacts to the surrounding neighborhood.

BACKGROUND On July 31, 2000, the City Council held a process session and discussed the Operating Agreements. Section 2 notes, in part, that “The City Manager shall recommend monthly to the council which items should be placed on the council agenda. This recommendation shall be placed on the consent calendar at the regular City Council meetings (regular meetings are those meetings held on the second and fourth Monday of each month in the Council Chamber). If the recommendation contained in the consent calendar is approved, the items shall be brought before the council on a future agenda. If there are concerns about an item, the item may be pulled from the consent calendar at the request of any councilor or the Mayor. A vote shall occur to determine if the item should be included as future council business.” Scheduling of this item is in accordance with the Council Operating Agreements.

ISSUE STATEMENT The City Council is scheduled to take action on this request for the annual withdrawal of previously annexed properties from special districts.
BACKGROUND The purpose of the ordinance is to remove annexed properties from the tax rolls of special service districts, which in this case are the River Road Park & Recreation District, River Road Water District, Santa Clara Rural Fire Protection District, Santa Clara Water District, and Willakenzie Rural Fire Protection District. State law and local code require annexed properties to withdraw from special service districts through a separate process after the annexation of those properties becomes effective. Annexation of these properties was approved by City Council over the period of 2019 through early 2020, at the request of the property owners. Withdrawals come before the City Council on an annual basis. Properties annexed during the previous year are batched together to facilitate this process. The 2020 batch contains 10 annexations approved by City Council in 2019 and early 2020—for a total of 11 tax lots. Withdrawals are time sensitive. State law provides that, if a withdrawal is not approved prior to March 31, the withdrawal does not become effective until July 1 of the following year (i.e., 2021 for these properties). This delay would mean that the properties will remain on the tax roll of the special service districts that no longer provide services to the property for more than a year. Approving the withdrawal ordinance prior to March 31, 2020, will result in the withdrawals taking effect on July 1, 2020, and those properties being included on the City tax roll immediately thereafter. The City Council held the required public hearing on this item on February 18, 2020. Public notice of the hearing was published and posted as required by state law and local code requirements, including notice to the affected special service districts. The inclusion of these properties on City

tax rolls, and withdrawal from special districts taxation, is anticipated by the property owners and by special districts as part of the annexation process. No testimony has been received as of February 18, 2020. Any written testimony received will be provided to council prior to action. The approval criterion for withdrawal from public service districts following annexation is contained in Eugene Code 9.7835 and corresponding statutory provisions in Oregon Revised Statute 222.524, which require the City Council to find that approval of the withdrawal is in the best interest of the City. If council finds the withdrawals are in the City’s best interest, council is asked to adopt the attached ordinance (see Attachment A), which provides for the withdrawal from special service districts of these annexed properties. Maps and legal descriptions of the properties to be withdrawn are provided as exhibits to the ordinance.
PREVIOUS COUNCIL DIRECTION February 18, 2020, Public Hearing A public hearing was held. No speakers appeared to give testimony either for or against the draft ordinance.
COUNCIL OPTIONS City Council may consider the following options: 1. Approve the withdrawals by ordinance; 2. Approve the withdrawals by ordinance with specific modifications as determined by the City Council; 3. Deny the withdrawals by ordinance.
CITY MANAGER’S RECOMMENDATION The City Manager recommends adoption of the ordinance as drafted, providing for withdrawal of all listed territories by March 31, 2020.

AN ORDINANCE PROVIDING FOR WITHDRAWAL OF ANNEXED PROPERTIES FROM
THE FOLLOWING SPECIAL DISTRICTS: RIVER ROAD PARK & RECREATION
DISTRICT; RIVER ROAD WATER DISTRICT; SANTA CLARA RURAL FIRE
PROTECTION DISTRICT; SANTA CLARA WATER DISTRICT; AND WILLAKENZIE
RURAL FIRE PROTECTION DISTRICT.
The City Council of the City of Eugene finds that:
A.Notice of the proposed withdrawal of real property which has been annexed to the City from
the River Road Park & Recreation District; River Road Water District; Santa Clara Rural Fire Protection
District; Santa Clara Water District; and Willakenzie Rural Fire Protection District (“the Districts”) was
published in the Register-Guard on February 4 and 11, 2020, posted in the Lane County Public Service
Building, the Eugene Downtown Library, Eugene’s Building and Permit Service Center in the Atrium
Building and at the Eugene City Manager’s Office for a period of two successive weeks prior to the hearing
date, and mailed to the affected public service districts.
B.The Notice provided that a public hearing was scheduled for February 18, 2020, at 7:30
p.m., in Harris Hall at the Lane County Public Service Building in Eugene, Oregon, to allow the City Council
to hear objections to the withdrawals and to determine whether the withdrawals are in the best interest of
the City.
C.The City is willing to assume the liabilities and indebtedness previously contracted by the
Districts proportionate to the parts of the Districts that have been annexed to the City upon the effective
date of the withdrawals as provided in ORS 222.520.
D.The withdrawals of the annexed territories from the Districts are consistent with adopted
City policies, and are in the best interest of the City.
NOW, THEREFORE,
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. The following territories in Lane County, Oregon, annexed to the City of Eugene by
Resolution of the Eugene City Council, are withdrawn from the Districts indicated effective July 1, 2020:

ISSUE STATEMENT
Urban Forestry is seeking to repeal City Council Resolution No. 3993, which pertains to the
abatement of Dutch elm disease. Although this treatment was considered a best management
practice at the time it was put into effect, it is no longer necessary as the vast majority of the
American Elms in Eugene have succumbed to Dutch Elm Disease or other causes.
Since 2014, the City of Eugene has spent just over $30,000 on private tree removal. Currently, the
cost of tree removal and disposal is averaging about $5000 per tree due to the exorbitant cost of
disposal and access to the trees themselves. Many of these trees require use of a crane for removal
as many are in citizen’s backyards. In fact, one single complex tree removal can cost in excess of
$15,000. This cost would be justifiable if the treatment were effective, but at this time, it is no
longer considered a best management practice for controlling the spread of the disease. Since the
time of the original council resolution, new disease resistant elms have been introduced to the
market and preventative chemical treatments are available.
It is the opinion of Urban Forestry staff that the money spent to remove elms from private
property would be better spent in other areas of the Urban Forestry program such as tree planting
or pruning to reduce the City’s pruning cycle.
BACKGROUND
At the time that the Council Resolution and subsequent Administrative Order went into effect in
1986, both the City of Eugene and the nation were aggressively trying to prevent the spread of
Dutch Elm Disease. The Order was put into place in an attempt to prevent the spread of disease,
ensure that removed trees were properly disposed of, and to save the American Elm population in
Eugene. Many of these trees were mature and stately, adding to the character and livability of
Eugene. At that time, considering that there was no chemical or biological treatment available,
preemptive removal of all tree material to lessen habitat for the fungus spreading elm beetle was a
valid solution to the problem.

A RESOLUTION DECLARING DUTCB ELM DISEASE TO BE
A PUBLIC NUISANCE AKD AUTHORTZING THE SUMMARY
ABATEMENT OF INFESTED TREES.
The City Council of the City of Eugene finds that:
The Parks and Recreation Department of the City has advised
the Council that :
A. It has discovered an elm tree located on private
prcperty within the City that is infested with Dutch Elm
disease. It has therefore begun an inspection of all elm
trees located within the City to determine rf other trees are
so infested;
B. Dutch Elm disease is a currently incurable disease
carried by beetles and root graft, and once infested there is
no known way to prevent the eventual death of the tree. The
only "treatment" is to prevent the spread of the disease by
immediately cutting down the infested trees and berying all
wood, limbs, branches and other debris from the trees.
Because the early detection, removal and proper burial of all
debris from infested trees is the only way to prevent the spread
of the disease to all elm trees in Eugene, it is in the public
interest that the City perform those services with respect to
trees located on private property, at no expense to the property
owner.
In order to prevent the spread of this dis~ase the Courcil
therefore specifically finds that Dutch Elm disease is a public
nuisance which is injurious or detrimental to the welfare of the
City and infested trees should 5e immediately abated by City
personnel.
The Council further finds that the removal of any elm tree,
or any wood, limbs, branches or other debris from any elm tree
within the City limits by any person other than authorized City
personnel will constitute a violation of Section 6.110 of the
Eugene Code, 1971, and is punishable by a fine not to exceed
$200.00, pursuant to Section 5.990(2) of the Eugene Code, 1971.
NOW , THEREFOR33 ,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a
Municipal Corporation of the State of Oregon, as follows:
Secti~n 1. Based upon the above findings, which are adopted
herein, and pursuant to the provisions of Section 6.010(k) of the
Eugene Code, 1971, Dutch Elm disease is hereby declared to be a

public ~uisance which is injurious or detrimental to the welfare
of the Ci ty of Eugene.
Section 2. The City Manager is authorized and req,les+-ed to
immediately begin the summary abatement procedures authorized
under Section 6.110 of the Eugene Code, 1971 of all Dotch Elm
diseased trees found on private property within the City of
Eugene.
Section 3. The cutting or removal oE any elm tree, or wood,
limbs, branches and other debris therefrom by any person other
than authorized City personnel shall constitute a violation of
Section 6.110 of the Eu9er.e Code, 1971, which is punishable by a
fine not to exceed $2C0.00 pursuant to Section 6.990(2) of the
Eugene Code, 1971.
Section 4. The declarations, directives and prohibitions
contained herein shall be immediately effective and shall remain
in effect until such time as the Director of the Parks & Recre-
8tion Department advises the Council that all Dutch Elm dlseazad
trees have been abated and there is no further danger to remaining
elm trees.
The foregoing Resolution adopted the 28th day of July, 1985.

B.Despite the City’s abatement efforts, a significant number of elm trees have been
lost and the City’s remaining population of elms does not justify the administration of a public
abatement program or the prohibition on private parties’ cutting or removal of the trees.
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a
Municipal Corporation of the State of Oregon, as follows:
Section 1. Resolution No. 3993 declaring Dutch Elm disease to be a public nuisance and
authorizing the abatement is repealed.
Section 2. This Resolution shall become effective immediately upon its adoption.

ISSUE STATEMENT This item is a request to annex the property located at 1345 Elkay Drive. The property to be annexed is approximately .44 acres (19,091 square feet) and is located on the north side of Elkay Drive, west of River Road. No public right-of-way is proposed for annexation as part of this request, and there is no formal deadline for City Council action on this item. A vicinity map is provided as Attachment A. The property is zoned R-1 Low-Density Residential with the /UL Urbanizable Land Overlay. Both the Metro Plan and the applicable refinement plan, the River Road - Santa Clara Urban Facilities Plan, designate the subject property for Low Density Residential use. The area of annexation is located within the City’s urban growth boundary and is only separated from the City limits by the right-of-way for Elkay Drive along the property’s south property boundary. Annexation will allow for future development consistent with the property’s land use designation and the Eugene Code. Specific plans for future development of the site are not included as part of this annexation application.
BACKGROUND To encourage compact urban growth and sequential development within Eugene’s UGB, the Metro Plan provides that ultimately all land within the UGB will be annexed into the City and provided with a minimum level of urban services. Approval of annexation requests are based on the criteria at Eugene Code 9.7825 which require that (1) the land proposed to be annexed is within the City’s UGB and is contiguous to the City limits or separated from City limits only by a right-of-way or water body; (2) the proposed annexation is consistent with the applicable policies in the Metro Plan and in any applicable refinement plans; and (3) the proposed annexation will result in a boundary in which the minimal level of key urban facilities and services can be provided in an orderly, efficient, and timely manner. Findings demonstrating that the annexation request is consistent with these approval criteria are included as Exhibit C to the attached draft resolution (Attachment B).

To provide nearby property owners and residents an opportunity to review and comment on this annexation request, public notice was provided to all owners and occupants of property within 500 feet of the subject property and the affected neighborhood association (River Road Community Organization) consistent with Eugene Code requirements. No testimony has been received to date regarding the proposed annexation of this property. Referral comments were provided by affected agencies including City of Eugene Public Works, Eugene Water & Electric Board, and Lane County Public Works. These referral comments confirm that the property can be provided with the minimum level of key urban services consistent with the approval criteria. Given the findings of compliance, ability for the provision of key urban services, and absence of any testimony, a public hearing is not recommended in this instance. Additional background information regarding this request, including relevant application materials, is included for reference as Attachment C. A full copy of all materials in the record is also available at the Permit and Information Center located at 99 West 10th Avenue.

RESOLUTION ANNEXING LAND TO THE CITY OF EUGENE
(ASSESSOR’S MAP 17-04-23-13, TAX LOT 7400 LOCATED AT 1345

The City Council of the City of Eugene finds that:
A.An annexation application was submitted on November 27, 2019, by Kathryn
Finnerty, in accordance with the provisions of Section 9.7810 of the Eugene Code, 1971, (“EC”)
to annex property identified as Assessor’s Map 17-04-23-13, Tax Lot 7400, to the City of Eugene.
B.The property proposed to be annexed is depicted on the map attached as Exhibit A
to this Resolution. The legal description of the property proposed to be annexed is attached to this
Resolution as Exhibit B.
C.The City’s Planning Director has submitted a written recommendation that the
application be approved based on the criteria of EC 9.7825. The Planning Director’s Findings and
Recommendation is attached as Exhibit C.
D.On January 22, 2020, a notice containing the street address, the assessor’s map and
tax lot number for the property, a description of the land proposed to be annexed, and the Planning
Director’s preliminary recommendation was mailed to the applicant, owners and occupants of
properties located within 500 feet of the perimeter of the subject property, and the River Road
Community Organization. The notice advised that the City Council would consider the Planning
Director’s full recommendation on the proposed annexation on February 24, 2020.
E.After considering the Planning Director’s recommendation, the City Council finds
that the application should be approved.
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a
Municipal Corporation of the State of Oregon, as follows:
Section 1. Based on the above findings and the Planning Director’s Findings and
Recommendation which are attached as Exhibit C and are adopted in support of this Resolution, it
is ordered that the land identified as Assessor’s Map 17-04-23-13, Tax Lot 7400, which is depicted
on the map attached as Exhibit A, and more particularly described in the attached Exhibit B, is
annexed to the City of Eugene.
Section 2. This Resolution is effective immediately upon its passage by the City Council.

EVALULATION:
Based on the information provided by the applicant, the City has determined that this request complies
with Eugene Code (EC) Section 9.7805 Annexation - Applicability. As such, it is subject to review and
approval in accordance with the requirements, application criteria and procedures of EC 9.7800 through
9.7835. The applicable approval criteria are presented below in bold typeface with findings and
conclusions following each.
EC 9.7825(1) The land proposed to be annexed is within the city’s urban growth boundary and is:
(a) Contiguous to the city limits; or
(b) Separated from the city only by a public right of way or a stream, bay, lake or other
body of water.
Complies Findings: The annexation area is within the City’s urban growth boundary (UGB) and is
separated from the city only by a public right of way, consistent with subsection (b).

EC 9.7825(2) The proposed annexation is consistent with applicable policies in the Metro Plan and in
any applicable refinement plans.
Complies Findings: Several policies from the Metro Plan provide support for this annexation by
encouraging compact urban growth to achieve efficient use of land and urban service
provisions within the UGB, including the following policies from the Growth
Management section (in italic text):
Policy 8. Land within the UGB may be converted from urbanizable to urban only
through annexation to a city when it is found that:
a. A minimum level of key urban facilities and services can be provided to the
area in an orderly and efficient manner.
b. There will be a logical area and time within which to deliver urban services
and facilities. Conversion of urbanizable land to urban shall also be
consistent with the Metro Plan. (page II-C-4)
Policy 10. Annexation to a city through normal processes shall continue to be the
highest priority. (page II-C-5).

Policy 15. Ultimately, land within the UGB shall be annexed to a city and provided with
the required minimum level of urban facilities and services. While the time
frame for annexation may vary, annexation should occur as land transitions
from urbanizable to urban. (page II-C-5)
The following policy from the Residential Element of the Metro Plan is also applicable:
Policy A.2 Residentially designated land within the UGB should be zoned consistent with
the Metro Plan, and applicable plans and policies; however, existing
agricultural zoning may be continued within the area between the city limits
and UGB until rezoned for urban uses.
The Metro Plan designates the annexation area as appropriate for low-density
residential use. The River Road - Santa Clara Urban Facilities Plan (RR/SC UFP) is the
adopted refinement plan for the subject property and designates the area for low
density residential use. The property is zoned R-1 Low-Density Residential with a /UL
Urbanizable Land overlay. The R-1 zoning is consistent with the Metro Plan and RR/SC
UFP designations. The /UL overlay will be automatically removed from the property
following annexation approval.
Regarding applicable policies of the RR/SC UFP, the subject property is not within a
defined subarea. Further, none of the general “Residential Land Use Policies” at Section
2.2 appear to be directly applicable to the subject request. The “Public Facilities and
Services Element” policies of the RR/SC UFP are directed at local government; however,
the premise of these policies (regarding the provision of urban services) is the
assumption that property within the UGB will be annexed.
As previously discussed in this subsection, and further detailed under subsection (3)
below, the proposed annexation is consistent with Metro Plan growth management
policies and can be served by the minimum level of key urban services. The annexation
procedures beginning at EC 9.7800 are consistent with State law and therefore, as found
throughout this report, the annexation is consistent with State law.
Therefore, based on the findings above, the proposal is consistent with the applicable
policies of the Metro Plan and RR/SC UFP refinement plan.
EC 9.7825(3) The proposed annexation will result in a boundary in which the minimum level of key
urban facilities and services, as defined in the Metro Plan, can be provided in an
orderly, efficient, and timely manner.
Complies Findings: Consistent with this criterion, the proposed annexation will result in a
boundary in which the minimum level of key urban facilities and services can be
provided in an orderly, efficient, and timely manner as detailed below:
Wastewater
Public Wastewater lines are available within the right-of-way of Elkay Drive. The existing
home located at 1345 Elkay Drive is currently connected to the City’s wastewater
system. There is no lien information in the special assessment database for the subject
property.

Stormwater
City of Eugene stormwater systems are not available in this area and the soils appear to
have poor permeability rates. Infiltration testing may be required at the time of
development to demonstrate adequate percolation rates. There are additional options
for complying with stormwater standards which will be further evaluated at the time of
future development. All treatment and destination must be approved prior to
development.
Transportation
The property has frontage on Elkay Drive, a Lane County local street with North Park
Avenue (Minor Arterial) to the west leading directly to NW Expressway (Major Arterial).
To the East, Elkay Drive connects directly to River Road, also a Major Arterial, owned and
maintained by the City of Eugene. Elkay Drive and North Park Avenue are paved but not
improved with sidewalks, curb and gutter, street trees or street lights. Any future
development will be evaluated for compliance with current standards through the
applicable development application.
Solid Waste
Collection service is provided by private firms. Regional disposal sites and the Short
Mountain Landfill are operated by Lane County.
Water and Electric
EWEB Water staff state no objection to the annexation. EWEB Electric staff also state no
objection to the annexation. Water and electric services can be extended to the subject
property in accordance with EWEB policies and procedures.
Public Safety
Police protection can be extended to this site upon annexation consistent with service
provision through the City. Fire protection will be provided by Eugene Springfield Fire.
Emergency medical services are currently provided on a regional basis by the cities of
Eugene and Springfield and will continue in the same manner upon annexation.
Parks and Recreation
Parks and recreation programs are provided on a City-wide basis. The inclusion of the
subject property in the City is sufficient evidence to demonstrate the minimum level of
this key urban service is met.
Planning and Development Services
Planning and building permit services are provided for all properties located within the
urban growth boundary by the City of Eugene. The Eugene Code, Chapter 9, will provide
the required land use controls for future development of the subject property upon
annexation.
Communications
A variety of telecommunications providers offer communications services throughout
the Eugene/Springfield area.

Public Schools
The subject property is within Eugene School District 4J and is within the district
boundary of River Road Elementary School, Kelly Middle School, and North Eugene High
School. As access to schools is evaluated on a district-wide basis, the property’s location
within the school district is sufficient evidence to demonstrate the minimum level of this
key urban service is met.
CONCLUSION:
Based on the above findings, information submitted to date, and the criteria set forth in EC 9.7825, the
proposed annexation is consistent with the applicable approval criteria. A map and legal description
showing the area subject to annexation are included in the application file for reference. The effective
date is set in accordance with State law.
