RESOLUTION NO. 5291
A RESOLUTION REPEALING RESOLUTION NO. 3993 REGARDING
THE ABATEMENT OF DUTCH ELM DISEASE.
The City Council of the City of Eugene finds that:
A. On July 28, 1986, the City Council adopted Resolution No. 3993 declaring Dutch
Elm disease to be a public nuisance, requesting the City Manager to abate from private property
all trees diseased with Dutch Elm disease, and (in order to limit the spread of the disease)
prohibiting anyone other than authorized City personnel from cutting or removing any elm tree,
or wood, limbs, branches and other debris from an elm tree.
B. Despite the City's abatement efforts, a significant number of elm trees have been
lost and the City's remaining population of elms does not justify the administration of a public
abatement program or the prohibition on private parties' cutting or removal of the trees.
NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF EUGENE, a
Municipal Corporation of the State of Oregon, as follows:
Section 1. Resolution No. 3993 declaring Dutch Elm disease to be a public nuisance and
authorizing the abatement is repealed.
Section 2. This Resolution shall become effective immediately upon its adoption.
The foregoing Resolution adopted the 24" day of February, 2020.
