City Manager of the City of Eugene, Oregon
FIFTH EXTENSION OF THE MARCH 17, 2020, DECLARATION OF A
STATE OF EMERGENCY UNDER SECTION 2.1055 OF THE EUGENE
CODE, 1971 WITHIN THE CITY OF EUGENE, OREGON, DUE TO THE
COVID-19 PANDEMIC.
The City Manager Pro Tern of the City of Eugene finds that:
A. Section 2.1055 of the Eugene Code, 1971, provides that the City Manager may
declare a state of emergency when an emergency requires a coordinated response beyond that
which occurs routinely, the required response is not achievable solely with the added resources
acquired through mutual aid or cooperative assistance agreements, and the emergency consists of
a Level 3 emergency under the city's emergency management plan.
B. Following a special meeting of the City Council during which the City Council
unanimously passed a motion supporting the City Manager Pro Tern declaring a state of emergency
due to the COVID-19 pandemic, on March 17, 2020, at 1:04 p.rn., the City Manager Pro Tern
executed Administrative Order No. 21-20-03 declaring a state of emergency under Section 2.1055
of the Eugene Code within the City of Eugene due to the COVID-19 pandemic.
C. On March 23, 2020, Governor Kate Brown issued Executive Order No. 20-12
("Stay Horne, Save Lives"), ordering Oregonians to stay at home, closing specified retail
businesses, requiring social distancing measures for other public and private facilities, and
imposing requirements for outdoor areas and licensed childcare facilities. On March 27, 2020, the
City Manager Pro Tern executed Administrative Order No. 21-20-04 extending the March 17,
2020 , emergency declaration until April 14, 2020. On April 13, 2020, City Manager Pro Tern
executed Administrative Order No. 21-20-05 extending the March 17, 2020, emergency
declaration until April 28, 2020. On April 27, 2020, City Manager Pro Tern executed
Administrative Order No. 21-20-06 extending the March 17, 2020, emergency declaration until
May 12, 2020. On May 11, 2020, City Manager Pro Tern executed Administrative Order No. 21-
20-07 extending the March 17, 2020, emergency declaration until May 26, 2020.
D. On May 1, 2020, Governor Brown found that COVID-19 continues to threaten
public health and safety, and remains a statewide emergency under ORS 401.025 and, therefore,
she extended the statewide emergency that she had declared on March 8, 2020 (that was set to
expire on May 7, 2020) for an additional 60 days, through July 6, 2020. The Lane County
Emergency Declaration, adopted onMarch 17, 2020, has been extended by the Lane County Board
of Commissioners until July 15, 2020 . The City of Springfield's Emergency Declaration, initially
set to expire on May 12, 2020, has been extended indefinitely. For a number of reasons, the
Emergency Managers for Eugene, Springfield, and Lane County recommend that each
jurisdiction's emergency declarations remain in place until Lane County has completed Governor
Brown's Phase II, plus an additional two weeks.

E. As of May 24, 2020, there are 3,888 positive COVID-19 test results in Oregon, 67
of which are in Lane County. The COVID-19 pandemic continues to be a public health emergency
which constitutes at least a Level 3 emergency under the Eugene-Springfield Multi-Jurisdictional
Emergency Operations Plan for the City of Eugene. The COVID-19pandemiccontinues to require
a coordinated response beyond that which occurs routinely, and the required response is not
achievable solely with the added resources acquired through mutual aid or cooperative assistance
agreements.
F. Section 2.105 5(2)( c) 1. of the Eugene Code states that the administrative order
declaring a state of emergency must "[f]ix the duration of time in which the state of emergency
shall exist. The initial duration shall not exceed a two week period, but my be extended for
additional periods of two weeks." Section 2 of Administrative Order No. 21-20-03 set the initial
duration stating: "The declaration of a state of emergency continues until March 31, 2020, unless
extended for additional periods by additional administrative orders." Administrative Order No.
21-20-04 extended the initial duration by two weeks, stating: "The extended declaration of a state
of emergency continues until April 14, 2020, unless extended for additional periods by additional
administrative orders." Administrative Order No. 20-20-05 extended the declaration by an
additional two weeks, stating: "The extended declaration of a state of emergency continues until
April 28, 2020, unless extended for additional periods by additional administrative orders."
Administrative Order No. 20-20-06 extended the declaration by an additional two weeks, stating:
"The extended declaration of a state of emergency continues until May 12, 2020, unless extended
for additional periods by additional administrative orders." Administrative Order No. 20-20-07
extended the declaration by an additional two weeks, stating: "The extended declaration of a state
of emergency continues until May 26, 2020, unless extended for additional periods by additional
administrative orders."
NOW, THEREFORE, based upon the above findings, I order that:
Section 1. The state of emergency declared by Administrative Order No. 21-20-03 and
extended by Administrative Order Nos. 21-20-04, 21-20-05, 21-20-06 and 21-20-07, is extended
for an additional two week period.
Section 2 . The extended declaration of a state of emergency continues until June 9,
2020, unless extended for additional periods by additional administrative orders.
Section 3 . A copy of this order shall be immediately provided to the Mayor and City
Councilors.
