ORDINANCE NO. 20227
AN ORDINANCE CONCERNING THE DOWNTO~N MALL;
AMENDING THE SUNSET PROVISIONS OF SECTION 2 OF
ORDINANCE NO. 20121 AND SECTION 3 OF ORDINANCE
NO. 20122; REPEALING ORDINANCE NO. 20149,
ORD]INANCE NO. 20150, AND SECTIONS 1 AND 5 OF
ORDINANCE NO. 20196; AND PROVIDING AN IMMEDIATE
EFFECTIVE DATE.
The City Conncil of the City of Eugene finds that:
On June 8, 1998 Ordinance No. 20121 was passed by the Cky Council and approved
by the Mayor adding a new Section 4.874 to the Eugene Code, 1971 authorizing the exclusion of law
violators from the downtown rnall in accordance with the procedures set l~brth in that section. On
that same date, Ordinance No. 20122 was passed by the City Council and approved by the Mayor
adding a new Subsection (3) to Section 4~680 of the Eugene Code, 1971 prohibiting persons from
being within the Broadway portion of the downtown mall between the hours of 1:00 a.m. and 6:00
a.ra. except as provided in that section.
Section 2 of Ordinance No. 20121, which was not included in the Code~ provided for
the automatic repeal of Ordinance No. 20121 mad Section 4.874 of the Eugene Code, 1971~ effective
midnight, March 31, 1999. Section 1 of Ordinance No. 20150~ passed by the City Council and
approved by the Mayor on March 15, 1999, extended the automatic repeal date to midnight, April
30,2001. Ordinance No. 20150 should be repealed, and Section 2 of Ordinance No. 20121 amended
to provide that Ordinance No. 20121 and Section 4.874 of the Eugene Code, 1971 be repealed,
effective midnight, July 31,2001.
Section 3 of Ordinance No. 20122, which was not included in the Code, provided for

the automatic repeal of Ordinance No. 20122 and Subsection (3) of Section 4.680 of the Eugene
Code, 1971, effective midnight, March 31, 1999. Ordinance No. 20149, passed by the City Council
and approved by the Mayor on March 15, 1999, amended Subsection (3) of Section 4.680 and
extended the automatic repeal date to midnight, April 30, 2001. Ordinance No. 20149 should be
repealed, and Section 3 of Ordinance No. 20122 amended to provide that Ordinance No. 20122 and
Sribsection (3) of Section 4.680 oft he Eugene Code, 1971 be repealed, effective midnight, July 31,
2001.
D. Sections 1 and 5 of Ordinance No. 20196 passed 'by the Cotmcil and approved by the
Mayor on May 8, 2000 revised Sections 4.680(3) and 4.874 of the Eugene Code, 1971, and those
sections should be repealed, effective rnidnight, July 31,2001.
E. The possibility- of reopening Broadway to vehicular traffic is currently being
considered. Such action would necessitate revisions to provisions of the Eugene Code, 1971,
including those referenced above. In the interim, it would be in the public interest to continue the
current provisions authorizing the exclusion of law violators from the described portions of the
downtown mall for an additional 90 day period as provided above.
Now, therefore,
THE CITY OF EUGENE DOES O~AIN AS FOLLOWS:
Section 1. Based on the above findings, which are adopted herein, Ordinance No. 20150
passed by the Council and approved by the Mayor on March 15, 1999 is hereby repealed, and Section
2 of Ordinance No. 20121 passed by the Cormcil and approved by the Mayor on June 8, 1998 is
amended to provide:
"Section 2. This Ordinance, and Section 4.874 of the Eugene Code, 1971, are

repealed effective midnight, July 31, 2001 .'
Section 2, Sections 1 and 5 of Ordinance No~ 20196, passed by the City Council and
approved by the Mayor on May 8, 2000, are repealed effective midnight, July 31, 2001.
Section 3~ Ordinance No. 20149 passed by the Council and approved by the Mayor o~
March 15~ 1999 is hereby repealed, and Section 3 of Ordinance No~ 20122 passed by the Com~cil a~d
approved by the Mayor on June 8, 1998 is amended to provide:
~Section 3. This ordinance, including the addition ora new subsection (3) to section
4.680, is repealed effective midnight, July 31, 2001 .'
Section 4. The City Recorder is requested to attach a copy of this Ordinance to Ordinance
No. 20121 and Ordinance No. 20122.
Section 5. The City Recorder, at the request of or with the concurrence of the City Attorney,
is authorized ;o administratively correct any reference errors contained herein or in other provisions
of the Eugene Code, 1971, to the provisions added, amended or repealed herein~
Section 6~ It is necessary for the preservation of the public health, welfare and safety for this
Ordinance to have ~mmediate effect. Therefore, this Ordinance shall become effective immediately
upon its passage by the City Council and approval by the Mayor, retention by the Mayor fbr rnore
than ten days, or readopfion over a Mayoral veto by two-thirds of all members of the City Council.
