ADMINISTRATIVE ORDER NO. 53-20-07

City of Eugene, Oregon
DELEGATING DUTIES UNDER CHAPTERS 2 AND 9 OF THE EUGENE
CODE, 1971, AND REPEALING ADMINISTRATIVE ORDER NO. 53-04-
10.
The Planning Division Director of the Planning & Development Department finds
A. On January 29, 2020, the City Manager Pro Tern issued Administrative Order No.
21-20-02 appointing me as the City of Eugene's AIC Planning Division Director of the Planning
& Development Department ("the Planning Director").
B. On August 27, 2020, the Executive Director of the Planning & Development
Department ("Executive Director of POD") issued Administrative Order No. 53-20-06, delegating
to the Planning Director the Executive Director of PDD's authority as designee of the City
Manager, to perform and carry out the City Manager's duties and responsibilities under Chapter 9
of the Eugene Code, 1971, except:
1. The adoption, amendment, or repeal of any rules authorized therein;
2. The adoption, amendment, or repeal of any fees or fee schedules authorized therein;
3. The City Manager's decision-making authority with respect to appeals and
determinations to implement legal proceedings on behalf of the City; and
4. The authority and responsibility to enforce the provisions of Chapter 9 of the
Eugene Code, 1971, including permits or variances issued thereunder, which was
delegated jointly to the Planning Director and to the Building & Permit Services
Division Director.
C. Administrative Order No. 53-20-06 also delegated to the Planning Director the City
Manager's authority to execute agreements governing annexations on behalf of the City and to
carry out the City Manager's responsibilities under Section 2.212 of the Eugene Code, 1971, with
respect to requests for extraterritorial water service extensions, sewer service extensions, or
provision of water or sewer service to special service districts.
D. Administrative Order No. 53-20-06 further specifically authorized the Planning
Director to in tum sub-delegate any of the duties or responsibilities delegated to the Planning
Director, and I find it would be more efficient and in the public interest to do so.

NOW, THEREFORE,
The Planning Division Director of the Planning & Development Department orders and
directs that:
1. The above findings are adopted.
2. The Principal Planner and Senior Planners in the Land Use Planning section, as
well as the Senior Planner (Land Use Supervisor) in the Building & Permit Services Division are
hereby delegated the authority to carry out the Planning Director's duties and responsibilities under
the Eugene Code, 1971, (EC), as well as all duties and responsibilities delegated to the Planning
Director by Administrative Order No. 53-20-06. These delegated duties and responsibilities
include, but are not limited to the authority to:
a. Receive requests for extraterritorial water service extensions, sewer service
extensions, or provision of water or sewer service to special service districts, upon
a finding of compliance with EC 2.212;
b. Execute, on behalf of the City, agreements required to be executed in connection
with annexations, including any notices of such agreements, modifications of the
agreements, or other documents required by the agreements to be subsequently
executed;
c. Render Type I and Type II decisions (EC 9.7100-9.7120 and 9.7200-9.7230);
d. Render Land Use Code and Decision Interpretations (EC 9.0040);
e. Render Zone Verification decisions (EC 9.1080);
f. Sign and date approved partition and subdivision plats (EC 9.8245 and 9.8570);
and
g. Execute performance agreements on behalf of the City (EC 9.7025).
3. Upon a finding that it would be more efficient and in the public interest to do so,
any of the duties and responsibilities delegated herein may in tum be sub-delegated to such person
or persons considered qualified to perform the duties or assume the responsibilities.
4. The delegation of authority contained herein shall be construed to extend to and
include any person(s) "acting in capacity" (AIC) for the persons to whom authority is delegated.
5. Nothing contained herein shall be construed in any way to limit or impair the
Planning Director's authority to perform any of the Planning Director's duties or responsibilities,
whether delegated herein or not.

6. The authorizations and delegations provided for herein are equally applicable when
the actions taken or duties performed involve matters occurring within that area outside the city
limits and within the City of Eugene's Urban Growth Boundary (the urban transition area) pursuant
to the urban transition agreement between the City of Eugene and Lane County and the land use
codes adopted by Lane County and applicable within the urban transition area.
7. Administrative Order No. 53-04-10 is repealed as of the effective date of this Order.
