HomeMy WebLinkAboutOrdinance No. 20240 ORDINANCE NO. 20240 AN ORDINANCE AMENDING THE EUGENE-SPRINGFIELD METROPOLITAN AREA GENE~L PLAN (METRO PLAN) TO ADOPT A NEW PUBLIC FACILITIES AND SERVICES ELEMENT, PLANNED PUBLIC FACILITIES PROJECT LISTS AND MAPS, AND RELATED CHANGES TO THE PLAN TEXT AND GLOSSARY; ADOPTING A NEW EUGENE,SPI;~ANGFIELD METROPOLITAN AREA PUBLIC FACILITIES AND SERVICES PLAN AS A REFINEMENT PLAN TO THE METRO PLAN; REPEALING ORDINANCE NOS. 19478, 19858, 19888, AND 19873; REPEALING SECTION 4 OF ORDINANCE NO. 20186 ADOPTED FEBRUARY 14, 2{}00; AND ADOPTING A SEVERABILITY CLAUSE. The City Ccmncil of the City of Eugene finds that: Chapter IV of the Eugene-Springfield Metropolitan Area General Plan (Metro Plan) se~s fo~h Proced~es for amendment of the Metro Plan, which for Eugene are implemented by the provisions of SeCtions 9~7700 through 9.7750 of the Eugene Code, 1971. B. The Metro Plan identifies the Eugene-Springfield Metropolitan Area Public Facilities plan (Public Facilities Plan) as a refinement plan which forms the basis for the Public Utilities, Services and Facilities Element of the Metro Plan and guides the provision of public facilities and services in the metropolitan area. C. The Public Facilities Plan serves the goals, objectives and policies of the Metro Plan by addressing the provision of public ~;acilities and services within the urban growth boundao' (UGB), se~ices to areas outside the UGB, locating and managing public facilities outside the UGB, and financing public facilities. D. On May 27, 1987, by Ordinance No. 19478, the City of Eugene adopted the current Eugene-Springfield Metropolitan Area Public Facilities Plan as a refinement plan to the Eugene- Springfield Metropolitan Area General Plan, which was subsequently amended by Ordinance Nos. 19858, 19888, 19873, and Section 4 of Ordinance No. 20186. E. The Co'tmcils and Board of Commissioners of Springfield, Eugene, and Lane County voted to initiate review of the public Utilities, Services, and Facilities Element as part of the Metro P!~ periodic Review Work Program approved by the Oregon Department of Land Conservation and Development (DLCD) in May 1995. The review was guided by a Technical Advisory Committee comprised of the affected local governments and utilities. Ordinance- 1 G~ The Planning Commissions of Eugene, Springfield, and Lane County conducted a joint public hearing on the Technical Advisory Committee recommendations on October 24, 2000 and a joint work session on September 26, 2000. Lane CountyL. modified. The Plapming Commission of Eugene, on November 18, 2000, and of Springfield, and on November 19, 2000, unanimously recommended approval of the proposal as H. The Eugene City Council has conducted public hearings and is now ready to take action based upon fhe evidence and testimony already in the record as welt as the evidence and testimony' presented at the public hearing held in the matter of adopting the Public Facilities and Services Plan and amending the Metro Plan. Evidence exists within the record indicating that the proposal meets the requirement of Chapter 9 of the Eugene Code~ 1971, and the requirements of applicable sta~e and local laws. NOW, THEREFORE, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Sec!tionl, Ordinance Nos. 19478, 19858, 19888, and 19873, and Section4 of Ordinance No. 20186, and the ] 98 7 Euge~e-S~ringfieM Metropolitan Area Public Facilities Plan Technical Repor~ adopted and/or amended therein are repealed. Section 2. The 2001 Eugene-Springfield Metropolitan Area Public Facilities and Services Plan (Public Facilities and Services Plan), set forth in Exhibit A attached and incorporated herein, as amended by the attached Addenda #1, #2, #3, #4, and #5 to Exhibit A, is adopted as a refinement plan to the Eugene-Springfield Metropolitan Area General Plan (Metro Plan). Secfio~ 3, The Public Utilities. Services, and Facilities Element (Section III-G) of the Metro Plan is remove& superseded and replaced by a new Public Facilities and Services Element (Section III-G), as set 2tbrth in Part I of Exhibit B attached and incorporated herein, which is hereby adopted. Section 4. The Public Facility Plan Project Lists and Maps fbr Water, Storm Sewers, Sanitary Sewers, and Transportation in Appendix A of the Metro Plan, and the Electrical Substations and Transmission Lines in Appendix D of the Metro Plan are removed, superseded and replaced by the Project L4sts and PIanned Facilities Maps fbr Water; Wastewate;; Stormwater and Electrical Facilities in Chapter II of the 2001 Public Facilities and Services Plan, as amended and set forth in Part II of Exhibit B attached and incorporated herein, which are hereby adopted. Project timing and estimated costs are not adopted as policy. Section 5, Additions and modifications to terms in the Glossary (Section V) of the Mk~o Plan, and mnendments to other statements of the Metro Plan fbr proposes of consistency ,Mth Ordinance - 2 adoption of a new Public Facilities and Services Element, as set forth in Parts III and IV of Exhibit B attached and incorporated herein are adopted. Sec~ti. on 6~ Although not a part of this Ordinance~ the Council adopts Legislative Findings set fbrth in the attached Exhibit C, which findings are supported by the April 1999 Technical Background Report: Existing Conditions and Alternatives which are incorporated herein and made part of the Technical Supplement to the Metro Plan by this refbrence in support of this action. ~ection _7_~ An ordinance containing identical provisions to this was adopted by the Sp mgfield C~ty Council on November 5, 2001 and by the Lane County Board of Commissioners on October 14, 2001. Therefore, this Ordinance shall become effective in the manner provided by the Eugene Charter of 1976. Section 8~ If any section, subsection~ sentence, clause, phrase, or portion of this Ordinance ~s fbr any reason held invalid or unconstitutional by any court of competent jurisdiction, that portion shall be deemed a separate~ distinct, and independent provision and that holding shall not affect the validity of the remaining portions of this Ordinance.
