HomeMy WebLinkAboutAdmin Order 53-08-02-F ADMINISTRATIVE ORDER NO. 53-08-02-F of the City Manager City of Eugene, Oregon REPEAL OF ADMINISTRATIVE ORDER NO. 53-07-03-F AND EXTREME FIGHTING ADMINISTRATIVE RULE R-4.740. The City Manager of the City of Eugene fmds that: A. Section 2.019 of the Eugene Code, 1971, authorizes the City Manager to adopt rules for administration and implementation of any provisions of that Code. B. On January 8, 2007, the City Council adopted Ordinance No. 20375 adding Section 4.740 to the Eugene Code, 1971, which prohibited extreme fighting except for matches in which the participants and the promoter complied with rules established by the City Manager. C. On March 8, 2007, the City Manager issued Administrative Order No. 53-07-03-F adopting Extreme Fighting Administrative Rule R-4.740 which allowed extreme fighting to take place in accordance with that Rule and ensured that appropriate safety measures were in place during extreme fighting matches. D. In June of 2007, the Oregon Legislature adopted Senate Bill 492, (OR Laws Chapter 585, 2007) which provides that ordinances regulating mixed martial arts adopted by cities and counties before February 1, 2007, may not be enforced once the Superintendent of State Police adopts administrative rules regulating mixed martial arts matches. The definition of "mixed martial arts" contained in SB 492 includes the conduct defined in the Eugene Code as "extreme fighting." E. On June 13, 2008, the Superintendent of State Police adopted final Oregon Administrative Rules 230-010-000 et seq., regulating mixed martial arts matches. F. Because the State of Oregon now has sole jurisdiction to regulate: mixed martial arts, including the conduct defined in the Eugene Code as extreme fighting, on July 28, 2008, the City Council adopted Ordinance No. 20416 repealing Section 4.740 of the Eugene Code, 1971, and the provisions prohibiting extreme fighting. G. Due to the repeal of Section 4.740 of the Eugene Code, 1971, Extreme Fighting Administrative Rule R-4.740 is moot. Therefore, on August 6, 2008, I issued Administrative Order No. 53-08-02 proposing the repeal of Administrative Order No. 53-07-03..F and Extreme Fighting Administrative Rule R-4.740. H. Notice of the proposed Rule repeal was published in the Register-Guard, a newspaper of general circulation within the City, on August 14, 15, 16, 17, and 18, 2008. The Administrative Order - Page 1 of2 08 Repeal Extreme Fighting Rule - 2 ao (00204846).DOC Notice was also made available to persons who had requested such notice, and provided that written comments would be received for a period of 15 days from the first date of publication of the Notice. No comments were received within the time or in the manner provided in the Notice. Therefore, on the basis of these findings, I order that Administrative Order No. 53-07- 03-F, which established Extreme Fighting Administrative Rule R-4.740, is repealed.
