HomeMy WebLinkAboutCC Minutes - 09/14/98 Meeting MINUTES Eugene City Council Council Chamber--City Hall September 14, 1998 7:30 p.m. COUNCILORS PRESENT: Pat Fart, Tim Laue, Bobby Lee, Scott Meisner, Nancy Nathanson, Laurie Swanson Gribskov, Betty Taylor, Ken Tollenaar. Mayor Jim Torrey called the September 14, 1998, meeting of the Eugene City Council to order at 7:35 p.m. I. PUBLIC FORUM Mayor Torrey described the purpose of the Public Forum and explained guidelines for providing testimony in it. Misha Seymour, 1313 Lincoln Street #306, referred to a slogan advertising the Eugene Celebration and expressed concern that music was being "piped in" with the intention of driving certain persons from the West Broadway mall area. He said he believed the mall should be a place for fun that is used by everyone. Chris Brintnall, 455 West 1st Avenue, stated that he was a rider for Pedalers Express, a project of the Center for Appropriate Transport. He said he believed a significant portion of trips taken by the "hundreds of City vehicles" could take advantage of an alternate mode of transportation which does not pollute and is timely and efficient. He said that he believed it was the responsibility of the City to improve Eugene's livability by addressing such problems as traffic congestion and the pollution and noise it generates. Annie Trambley, 455 West 1st Avenue, described the routes of delivery of Pedalers Express, the number of full-time riders available, and the schedule of its delivery services. She distributed copies of documents containing information related to the delivery services. She recommended that councilors read the article entitled "When Cities Take Bicycles Seriously" from the September/October edition of World Watch included with the distributed documents. Nick Antone, Jr., 512 Honeysuckle Lane, stated that he had lived at his home for 33 years and that for 10 years he had been dealing with issues related to nuisance and zoning violations on his property. He said he had received a letter which had led him to understand that issues related to the violations and concerns of neighbors would be considered at the council work session held earlier in the evening. He said he did not believe resolution of the concerns had been attempted or that all options had been considered. He said reliance on neighbor's complaints was unhelpful. He said a Municipal Court order requiring abatement would be a more effective procedure than the one followed by City departments because a Municipal Judge had authority to order a mental evaluation of parties involved. B. Call for Public Hearings--Street and Alley Vacations for A &K Development, SV 98-3, West 3rd Place and SV 98-4, West 4th Avenue. Mr. Fart moved, seconded by Mr. Tollenaar, to approve the City Council Consent Calendar for September 14, 1998. Ms. Taylor requested that the minutes of the June 8, 1998, Council Meeting; July 8, 1998, Lunch Work Session; July 22, 1998, Dinner Work Session; and July 29, 1998, Lunch Work Session be considered for possible revision before the motion to adopt the Consent Calendar was acted upon. Mr. Fart requested that the minutes of the June 10, 1998, Lunch Work Session be considered for possible revision before the motion to adopt the Consent Calendar was acted upon. Mr. Meisner requested that the minutes of the July 29, 1998 Lunch Work Session and August 3, 1998, Dinner Work Session be considered for possible revision before the motion to adopt the Consent Calendar was acted upon. Ms. Nathanson requested that the minutes of the June 8, 1998, Council Meeting and June 10, 1998, Lunch Work Session be considered for possible revision before the motion to adopt the Consent Calendar was acted upon. Mr. Tollenaar requested that minutes of the June 10, 1998, Lunch Work Session and the August 3, 1998, Dinner Work Session be considered for possible revision before the motion to adopt the Consent Calendar was acted upon. Mr. Lee requested that the minutes of the July 29, 1998, Lunch Work Session be considered for possible revision before the motion to adopt the Consent Calendar was acted upon. Mayor Torrey determined there was no objection to the request and ordered the minutes to be revised. Ms. Nathanson requested that sentence 3 of paragraph 6 on page 12 of the minutes of the June 8, 1998, Council Meeting be amended, as follows: She said that she did not believed that mediation between business operators and those sleeping in vehicles on streets near their locations would not be effective. Mayor Torrey determined there was no objection to the request and ordered the minutes to be revised. Mr. Fart requested that sentence 2 of paragraph 4 on page 2 of the minutes of the June 10, 1998, Lunch Work Session be amended, as follows: He added that the structure had also enabled councilors and committees to hold meetings in different areas, e.g., *~',,,~ ~,,~'- ...... ~, ,,~"-,~"~' ~,~,,v, ,~*'-*~'"" Station Seven. Mayor Torrey determined there was no objection to the request and ordered the minutes to be revised. Mr. Tollenaar requested that sentence 2 of paragraph 1 on page 5 of the minutes of the June 10, 1998, Lunch Work Session be amended, as follows: Mr. Tollenaar said the council should give serious consideration to having a small full-time in-house counsel that would take responsibility for a the basket of services, including for oversight of contracted-for legal work, and ~ perhaps for dealing with some other issues such as questions of land use. Mayor Torrey determined there was no objection to the request and ordered the minutes to be revised. Ms. Nathanson noted that loyalty could mean being trustworthy and avoiding conflict of interest, or showing motivation and enthusiasm for doing the best job. Ms. Taylor requested that sentence 2 of paragraph 8 on page 7 of the minutes of the July 8, 1998, Lunch Work Session be amended, as follows: She said representatives of the City should suggest to persons living in vehicles who have families that they should approach the~ them for permission to camp on their back yards. Mayor Torrey determined there was no objection to the request and ordered the minutes to be revised. Ms. Taylor requested that the final sentence of paragraph 8 on page 7 of the minutes of the July 8, 1998, Lunch Work Session be amended, as follows: ~:~'~,,,,~ jw~:~'~° ~,,~'~"'~ r-,~w~ ~': .... ~',v ,,.~.::"~ She said that if it is true that the city of Springfield did not ban camping on its streets, representatives of the city of Eugene should suggest that people sleep there. Mayor Torrey determined there was no objection to the request and ordered the minutes to be revised. Ms. Taylor requested that paragraph 4 on page 8 of the minutes of the July 22, 1998, Dinner Work Session be amended, as follows: Ms. Taylor expressed ~,~ppeic,~m~mt disapproval that the Celebration's name has been changed and also that an entry fee has been impese~ raised for political parade entries, adding that she believes this is inconsistent with the principal of campaign finance reform. Mayor Torrey determined there was no objection to the request and ordered the minutes to be revised. Mr. Meisner noted that page 4 of the minutes of the July 29, 1998, Lunch Work Session was missing in the document distributed with the agenda of the meeting and that their approval would include approval of the missing page which had been electronically transmitted to councilors following the original distribution. Ms. Taylor requested that paragraph 8 on page 3 of the minutes of the July 29, 1998, Lunch Work Session be amended, as follows: Ms. Taylor reiterated her position, saying she might would not be able to vote ~;~* *h;~ m~*; ........ ;* ~* ~ .... *h ..... h" 'yes" without more discussion and the opportunity to ask additional questions. Mayor Torrey determined there was no objection to the request and ordered the minutes to be revised. MINUTES-Eugene City Council September 14, 1998 Page 4 7:30 p.m. Mr. Lee requested that the period after the word "wrong" in sentence 1 of paragraph 1 on page 7 of the minutes of the July 29, 1998, Lunch Work Session be removed. Mayor Torrey determined there was no objection to the request and ordered the minutes to be revised. Mr. Meisner requested that paragraph 2 on page 2 of the minutes of the August 3, 1998, Dinner Work Session be amended, as follows: Mr. Meisner requested that the final report of the survey include identification of the responses of participants by categories~, specifically identifying the responses of those within the portion of Glenwood already annexed to Eugene. Mayor Torrey determined there was no objection to the request and ordered the minutes to be revised. Mr. Tollenaar requested that sentence 2 of paragraph 5 on page 3 of the minutes of the August 3, 1998, Dinner Work Session be amended, as follows: Mr. Tollenaar replied that the question of Ms. Taylor had not been fully considered by the committee, but that if objections were r~ised to the shift in ~nne×~tion required ~ ...... ~ ~ + .... ~ ...... + ..... '~ ~ ...... ~"~ He said, however, that a vote would be required on the transfer to Springfield of territo~ already annexed to Eugene, if objections to the transfer were raised by either city council or by ten percent of the electors residing in that territo~. Mayor Torrey determined there was no objection to the request and ordered the minutes to be revised. Ms Nathanson expressed appreciation for the timely presentation to the council of minutes of meetings. She explained that requested changes in the minutes were to ensure that the legislative history of council actions was accurately recorded. The motion to approve the Consent Calendar was adopted unanimously, 8:0.
