BACKGROUND On September 15, 2008, the City Council held a public hearing on the annexation of the subject property. At the public hearing, the City Council heard testimony from Jonathan Lauch, representing Eugene School District 4-J. No other testimony, written or otherwise, was received at the hearing. Following the close of the public hearing, the City Council left the record open until 5:00 p.m. on Friday, September 19, 2008, and asked that Mr. Lauch submit his comments in writing. During the open record period, the only written testimony received was submitted by Mr. Lauch. This testimony is provided as Attachment D. Previously, on July 14, 2008, the City Council voted to defer action on the proposed annexation until after holding a public hearing as allowed under the annexation application procedures of the Eugene Code. Accordingly, the September 15, 2008, public hearing was scheduled and public notice was provided in accordance with Eugene Code requirements. No written testimony was received prior to the public hearing. As addressed in the attached findings, the proposed annexation request complies with the approval criteria from the Eugene Code, as the subject property is located within the urban growth boundary and contiguous to city limits, and given that the minimum level of key urban services can be provided. Approval of an annexation request requires the City to adopt a resolution. To comply with the Charter requirements for resolutions, a draft resolution approving the requested annexation has been prepared and is attached for reference (Attachment A). The Planning Director’s findings, which provide analysis of the proposal’s compliance with applicable approval criteria, are attached to the draft resolution as Exhibit C. In considering the draft resolution, the City Council will consider the supporting findings and can either accept them as proposed, or amend them as necessary. Additional background information regarding this request, including relevant application materials, is included for reference as Attachment B. The Metro Plan and the Willakenzie Area Plan policies applicable to this request are addressed in the Planning Director’s findings and recommendation (Exhibit C of Attachment A). COUNCIL OPTIONS The City Council may consider the following options: 1. Adopt the draft resolution. 2. Adopt the draft resolution with specific modifications as determined by the City Council. 3. Deny the draft resolution. To deny the request, the City Council must make findings that the annexation request is not consistent with the approval criteria of the Eugene Code. CITY MANAGER’S RECOMMENDATION The City Manager recommends that the City Council adopt the draft resolution. SUGGESTED MOTION Move to adopt Resolution 4948 annexing land to the City of Eugene (School District 4-J, A 08-1).
