ADMINISTRATIVE ORDER NO. 58-21-55
of the
Traffic Engineer of Public Works Maintenance's Traffic Operations Team
of the City of Eugene
DESIGNATING TEMPORARY SPEEDS ON W 5TH AVENUE DUE TO
TEMPORARY LANE CLOSURE.
The Traffic Engineer of Public Works Maintenance's Traffic Operations Team of the
City of Eugene finds that:
A. Under the provisions of Chapter IV, Section 16 of the Eugene Charter of 2002, the
City Manager is designated as the administrative head of the City and is specifically authorized to
enforce all ordinances of the City. In addition, EC 5.040 authorizes the City Manager or the
Manager’s designee to take administrative action establishing or altering traffic control areas and
traffic control devices including traffic control signals, signs, and pavement markings. EC 5.055
sets forth the criteria the City Manager or the City Manager’s designee should consider when
taking administrative action authorized by EC 5.040.
B. On August 5, 2020, the City Manager issued Administrative Order No. 58-20-17
granting the Executive Director of the Public Works Department the authority to exercise all of
the duties and responsibilities specifically defined as those of the City Manager in Sections 5.040,
5.045 and 5.050 of the Eugene Code, 1971. That Order also granted the Executive Director of the
Public Works Department the authority to further delegate those duties and responsibilities to such
person or persons qualified to perform the delegated duties.
C. On August 6, 2020, the Executive Director of the Public Works Department issued
Administrative Order No. 58-20-18 granting the City Engineer the authority to perform the duties
and responsibilities specifically defined as those of the City Manager in Sections 5.040, 5.045 and
5.050 of the Eugene Code, 1971. That Order also granted the City Engineer the authority to further
delegate those duties and responsibilities to such person or persons qualified to perform the
delegated duties.
D. On August 11, 2020, the City Engineer issued Administrative Order No. 58-20-19
granting the Traffic Engineer of Public Works Maintenance's Traffic Operations Team the
authority to perform the duties and responsibilities specifically defined as those of the City
Manager in Sections 5.040, 5.045 and 5.050 of the Eugene Code, 1971.
E. ORS 810.180 (8) provides specific direction for establishing, on highways / streets
in the City’s jurisdiction, a temporary “designated speed” that is lower than the statutory speed
and includes additional criteria the City Manager or the City Manager’s designee should consider
when establishing a temporary designated speed.

F. For the safety and welfare of the public, it is necessary to establish a temporary
designated speed of 30 mph on W 5th Avenue in the westbound direction from approximately 100
feet west of the intersection with Seneca Road continuing west to the intersection of Bailey Hill
Road and continuing south to approximately 150 feet south of the same intersection.
G. In making this decision, I have considered all of the applicable criteria set forth in
EC 5.055 and ORS 810.180(8). The following findings support my decision to establish a
temporary designated speed for this street segment.
1. Current conditions / characteristics: W 5th Avenue in the westbound direction
between Seneca Road and Bailey Hill Road is classified as a major collector street
with a posted speed of 40 mph and Bailey Hill Road south of W 5th Avenue is
classified as a minor arterial road with a posted speed of 35 mph beginning
approximately 150 south of W 5th Avenue. The street segment has a paved width
of approximately 44 feet for two westbound travel lanes, becoming one travel lane
at the west end of the segment and continuing as one lane southbound on Bailey
Hill Road. The is no parking, no bike lanes, and no sidewalks present. A temporary
lane reduction that removes the northern westbound travel lane on W 5th Avenue
beginning west of the intersection with Seneca Road will narrow the roadway at
Market Street to a single westbound lane approximately 14 feet wide between a
curb on the southern side and a concrete barrier on the northern side. The area on
W 5th Avenue north of the concrete barrier between Market Street and Bailey Hill
Road will be reserved for people parking cars and recreational vehicles in a
managed site in an area approximately 12 feet wide measured from the northern
curb.
2. There were twelve motor vehicle crashes reported between 2007 and 2019 on this
segment of W 5th Avenue, west of Seneca Road and continuing to approximately
150 south of W 5th Avenue, involving ten possible injuries and seven property
damage only.
3. Traffic engineering principles and traffic investigations support a reduction in the
speed of automobile traffic when the roadway is narrowed and people are parked
as described above.
4. These treatments are consistent with standards, limitations, and rules promulgated
by the Oregon Transportation Commission or the Oregon Public Utility
Commission or their successors through guidance from the Oregon Department of
Transportation Traffic Control Plans Design Manual and also with other recognized
traffic control standards including the Manual on Uniform Traffic Control Devices
(Part 6) temporary traffic control.
5. Establishing a temporary designated speed of 30 mph on this street segment for a
temporary roadway lane reduction during a period from September 24, 2021 up to
December 31, 2023 (when the temporary designated speed maybe posted) is
