AN D1EAGEICY.
THE CITY Of EUGENE DOES ORDAIN AS FOllOWS:
Section 1. The definition of -At largo- set forth in Section 4.330 of
the Eugene Code, 1911, 1s amended, and a nev definition of -Dog-off-leash
area- is added in alphabetical order t~rein to provide:
4.330 Animal Control - Definitions. For purposes cf sections 4.330 to
4. 500 of tM $ chapter, tile fo 11 ow1 ng words and phrases lleaR:
At large. A dog or other animal 1nside the corporate 11.1t$
c'f the city,. off the prellises of the owner, and not under cOfAJ)lete
~ontro'l by adequate leash. A dog in field training or a dog in an
area deslgnlted as a dog-off-leash area within a ~lty park~ is ex-
cepted herefrora unless the dog causes personal injury or property
d'~ge off the prelises of the owner. This exception does not
apply to any dog identtf1ed as a potentially dang~rou$ dog unde...
section 4.435 to 4.445.

Section Z. Subsection (2) of Section 4.425 of the Eugene Codet 1971, is

(2) A dog owner is deeled to be negligent per se for the actions
of a dog at large. a dog undergoing field training. or a dog in a dog-off<<.
leash area, wilen the dog causes injury to a person or pl"Opel"ty.
section 3. The City Recorder, at the request of, or with the concur-
note of the City Attorney, is authorized to adilintstr'aUvely correct any
reference errors tontained he;rein, or i.n other' provisions of the Eugene Code,

Section 4. That the matters contained herein concern the public welfare
and safety and therefore, an emergency is hereby declared to exist, and this
Ordinance shall become effective immediately upon its passage by the City
Council and approval by the Mayor, retention by the Mayor for IIOre than ten
days~ or readoption over a Mayoral veto by two thirds of all members of the
City Council.
