AN ORDINANCE CONCERNING FEES; AMENDING SECTIONS 2.212,
7.595, 7.610, 8.820, 9.030, 9.035, 9.040, 9.126, 9.128,
9.154, 9.512, 9.516, 9.576, 9.672, 9.690, AND 9.700 OF
THE EUGENE CODE, 1971; AND DECLARING AN EMERGENCY.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. Section 2.212 of the Eugene Code, 1971, is amended to pro-
vide:
2.212 Extraterritorial Water and Sewer Service Extensions. The city
manager or the manager's designee is hereby authorized to receive
on behalf of the city requests for extraterritorial water service extensions,
sewer service extensions, or provision of water or sewer service to special
service districts. Such requests shall be accompanied by the application fee
established by the city manager as provided by section 2.020 of this code.
The city manager, or the manager's designee, shall submit such requests to
the Lane County Boundary Commission, together with a favorable recommendation
by the city only if the city manager, or the manager's designee, finds that
the extension of service as proposed would be consistent in all respects
with adopted resolutions, policies, plans and ordinances.
Section 2. Section 7.595 of the Eugene Code, 1971, is amended to pro-
vide:
7.595 Vacation of Im roved Ri hts-of-Wa and Unim roved Streets and
Alle s. - Petitioner De osit. When a petition or the vacation
of an improved right-o -wa.y, pub is p ace or part thereof, or unimproved
street or alley, including an improved easement or part thereof, is pre-
sented to the finance officer for filing and consideration by the council,
the person presenting the petition shall deposit with the finance officer
a fee as established by the city manager as provided by section 2.020 of
this code. This deposit shall be used to pay the cost of publishing and
posting notices of the proposed vacation and other expenses as are incurred.
In case the cost exceeds the amount of the deposit, an additional sum suffi-
cient to cover the deficiency shall be collected by the finance officer be-
fore the vacation is completed.
Section 3. Subsection (i) of Section 7.610 of the Eugene Code, 1971,
is amended to provide:

Section 4. Subsection (2) of Section 8.820 of the Eugene C~.~de, 1971,
is amended to provide:
8.820 Application, Fee, and Public Hearing Notice.
(2) The application shall be accompanied by a fee as established
by the city manager as provided by section ?..020 of this code.
Section 5. Subsection (1) of Section 9.030 of the Eugene Code, 1971,
is amended to provide:
9.030 Minor Partition Procedure.
(1) Minor Partition A lication. An application and relates in-
formation as prescri ed by the city sha be submitted by the person pry~pos-
ing the minor partition, together with the fee set by the city manager ~s
provided by section 2.020 of this code. ~

Section 6. Subsection (1) of Section 9.035 of the Eugene Code, 197?~;,
is amended to provide:
9.035 Ma-ion Partition and Subdivision Tentative Plan Procedure.
(1) Tentative Plan - Application. An application and related in-
formation prescribed by the city as required for major partition, or subdivi-
sion tentative plan approval shall be submitted by the person proposing the
tentative plan, together with a fee set by the city manager as provided by
section 2.020 of this code.
Section 7. Subsection (1) of Section 9.040 of the Eugene Code, 1971,
is amended to provide:
9.040 Ma'or Partition Ma and Subdivision Plat Procedure. ;

established by the city manager as provided by section 2.020 of this code.
Section 8. Subsections (1) and (4) of Section 9.126 of the Eugene
Code, 1971, are amended to provide:
9.126 Metro Plan - A lication.

shall be filed on a orm prescribed by the city and accompanied by a non-
refundable deposit established by the city manager as provided by section
2.020 of this code to help cover the cost of categorizing the amendment.
(4) Pa ment of Fee. The applicant shall pay a fee appropriate to
the classification o t e proposed plan amendment as established by the city
manager as provided by section 2.020 of this code. No application shall be
accepted or processed further prior to the payment of this fee.
Section 9. Subsection (1) of Section 9.128 of the Eugene Code, 1971,
is amended to provide:
9.128 Metro Plan - A eal of Plan Amendment Classification.

amendment by the planning director may be appealed by an applicant to the
Metropolitan Policy Committee. Appeals shall be submitted on a form pre-
scribed by the city and accompanied by a fee set by the city manager as pro-
vided by section 2.020 of this code.
Section 10. Subsection (2) of Section 9.154 of the Eugene Code, 1971,
is amended to provide:
9.154 Application, Fee, and Public Hearing Notice.
(2) The application shall be accompanied by a fee as established
by the city manager as provided by section 2.020 of this code.
Section 11. Subsection (2) of Section 9.512 of the Eugene Code, 1971,
is amended to provide:
9.512 Tentative Plan Consideration.
(2) Application. A tentative plan application and related infor-

affected property, together with a fee established by the city manager as
provided by section 2.020 of this code.
Section 12. Subsection (1) of Section 9.516 of the Eugene Code, 1971,
is amended to provide:

Section 13. Subsections (5){k) and (8) of Section 9.576 of the Eugene
Code, 1971, are amended to provide:
9.576 General Provisions - Solar Access Guarantee.
(5) A licatic~ for a Solar Access Guarantee. An applicant for a
Solar Access Permit must nc u e:
(k) Such other information as may be required by regulations
adopted by the city manager and a fee in an amount established by
the cit; manager as provided by section 2.020 of this code.
(8) Modification. An affected party or the Solar Access Guarantee
holder may applyy o~~cation of a Solar Access Guarantee. Such appli-
cation shall set forth the information and comply with the standards set
forth in section 9.576(5). No such modifications shall be allowed without
written agreement of the guarantee holder and the affected party or parties
par*_ies or unless the guarantee holder or his or her predecessor-in-interest
has caused a material change in circumstances which coviates the need for
solar protection of the amount provided for in the Solar Access Guarantee.
Proceedings for modification of a Solar Access Guarantee shall be conducted
in the same rnanner as proceedings for issuance of such a permit. The fees
for filing a request for modification shall be amounts established by the
city manager as provided by section 2.020 of this code.
Section 14. Subsection (2) of Section 9.672 of the Eugene Code, 197],
is amended to provide:
9.672 Application, Fee, and Public Hearing Notice.
(2) The application shall be accompanied by a fee established by

the city manager as provided by section 2.020 of this code.
Section 15. Subsection (2) of Section 9.690 of the Eugene Code, 1911,
is amended to provide:
9.690 Site Plan Review Procedure.
(2) A lication submit±ai. An application and related information
shall be submitte y the applicant, in the manner prescribed by the city,
together with a fee established by the city manager as provided by section
2.020 of this code.
Section 16. Section 9.700 of the Eugene Code, 1971, is amended to pro-
vide:
9.700 A lication. A conditional use permit application and related in-
orm~ ation shall be submitted by the applicant, as prescribed by the
city, together with the fee established by the city manager as provided by
section 2.020 of this code.
Section 17. All currently imposed fees affected by this Ordinance,
whether set by ordinance, resolution or administrative action, are ratified
and shall remain in effect until changed under the procedures set forth ~in
Section 2.020 of the Eugene Code, 1911. Those portions of ordinances, reso-
lutions and administrative orders establishing such currently imposed fees
are hereby repealed, effective as of the date of adoption of an administrative
order changing the fees that are the subject thereof.
Section 18. The City Recorder, at the request of or with the concurrence
of the City Attorney, is authorized to administratively correct any reference
errors contained herein or in other provisions of the Eugene Code, 1971, to
the provisions amended or added herein.
Section 19. That the matters contained herein concern the public wel-

fare, and in order to insure the orderly implementation of the provisions
hereof, an emergency is hereby declared to exist, and this Ordinance shall
become effective immediately upon its passage by the City Council and approval
by the Mayor.
