HomeMy WebLinkAboutAdmin Order 58-21-56-F -- Corrected Regional WW and Parks SDCsAdministrative Order - Page 1 of 2 ADMINISTRATIVE ORDER NO. 58-21-56-F of the City Manager of the City of Eugene AMENDING CITY OF EUGENE SYSTEM DEVELOPMENT CHARGE METHODOLOGIES, APPENDIX F "LOCAL SDC SYSTEM FORMULAS AND GENERAL FEE SCHEDULE," TO CORRECT ERRORS IN SYSTEMS DEVELOPMENT CHARGE INFLATIONARY ADJUSTMENTS MADE BY ADMINISTRATIVE ORDER 58-21-21-F (REGIONAL WASTEWATER SYSTEM AND PARKS AND RECREATION SYSTEM). The City Manager of the City of Eugene finds as follows: A. Section 2.020 of the Eugene Code, 1971 (EC), authorizes the City Manager of the City of Eugene to determine and set fees and charges to be imposed by the City for services, goods, use of municipal property, and licenses and permits. EC 7.710(5) and Section 2.4 of the Systems Development Charge (SDC) Methodologies authorize the City Manager to adopt by administrative order pursuant to EC 2.020, a change in the amount of a reimbursement fee or an improvement fee if the change in amount is based on: (1) the periodic application of an adopted specific cost index (inflationary adjustment); or (2) a modification to any of the factors related to rate that are incorporated in the established methodologies, so long as the fees are not increased by more than five percent within any 12-month period. B. Section 2.4 and Appendix C-2 of the City of Eugene System Development Charge Methodology provide for periodic inflationary adjustments to the SDC rates by applying the20- city national average construction cost index published by Engineering News-Record (ENR) and / or the Lane County Assessor’s Office Certified Ratio Study (when adjusting the SDC for acquisition costs of real property). C. The Engineering News-Record 20-City National Average Construction Cost Index is 2.96% (March 2020 through April 2021) and the Lane County Assessor’s Office Certified Ratio Study shows that real property acquisition costs have increased by 7.52%. On these bases, the 2021 inflationary rate for Parks and Recreation SDCs is +2.46% and the 2021 inflationary rate for the Regional Wastewater SDCs ranges from +1.953% to +1.62%, depending upon assigned strength categories. D. Administrative Order No. 58-21-21-F issued on June 25, 2021 was intended to make the 2021 inflationary adjustments to the SDC rates for the Transportation, Local Wastewater, Regional Wastewater, Stormwater and Parks and Recreation Systems, but the inflationary adjustments for the Regional Wastewater and the Parks and Recreation Systems made by Administrative Order No. 58-21-21-F were improperly calculated. E. To correct the inflationary adjustments for the Regional Wastewater and the Parks and Recreation Systems, on December 16, 2021, I issued Administrative Order No. 58-21-56 ordering that Notice be given of the opportunity to comment on a proposal to correct the errors. Notice was provided to the Mayor and City Councilors, was made available to persons who had requested such notice and, on December 21, 2021, was posted at two locations at City Hall and published in the Register Guard newspaper. The Notice provided that written comments would be received for a period of 15 days from the date of posting and publication. No comments were received within the time or in the manner set forth in the Notice. G. The corrections to SDCs reflected on Exhibit A to this Administrative Order will not result in a 5% or greater fee revision within a 12-month period. H. I find that the corrected inflationary adjustments set forth in Exhibit A to this Order are consistent with adopted policies of the City (See Exhibit B), are in conformity with applicable state law, are authorized by Section 7.710(5) of the Eugene Code, 1971, and should be implemented as soon as possible. On the basis of these findings, I order that: 1. The City of Eugene System Development Charge Methodologies are amended as shown in Exhibit A to this administrative order, more specifically described as City of Eugene System Development Charge Methodologies, Appendix F "Local SDC System Formulas and General Fee Schedule," which includes: A. Corrections to the systems development charges for the regional wastewater system (to reflect a 2021 inflationary adjustment that ranges from +1.953% to +1.62%, depending upon assigned strength categories) that were incorrectly made by Administrative Order No. 58-21-21-F; B. Corrections to the systems development charges for the parks and recreation system (to reflect a 2021 inflationary adjustment of +2.46%) that were incorrectly made by Administrative Order No. 58-21-21-F; and C. The systems development charges for the transportation system, local wastewater system, and stormwater system that were correctly made by Administrative Order No. 58-21-21-F. 2. The system development charges set out on Exhibit A to this administrative order (Appendix F to the City of Eugene System Development Charge Methodologies entitled "Local SDC System Formulas and General Fee Schedule") are to be implemented upon the effective date of this Order. This adjusted amount, as shown in the box below, was rounded to the nearest whole number (or dollar) and was included in Section 2.0 of this Appendix F. Subsequent adjustments to the cost per trip (i.e., fee changes adopted per Section 2.4 of the General Methodology) shall round to the nearest hundredth (or penny). See Section 2.0 of this Appendix F for current rates. 1.2.2 Transportation SDC Rates Except when the City Engineer has approved an applicant’s election to use the Alternate Trip Generation Calculation method or an alternative pass-by adjustment, the City Engineer shall apply rates included in the Transportation Trip Rates table, Table B-9, located below. Descriptions for the land use categories included in Table B-9 are included in Appendix A and are based upon ITE land use categories. (a) Applicable policies, enactments and directives of the Council. EC 7.710 states that “an amendment to a methodology that changes the amount of a reimbursement fee or an improvement fee based on the periodic application of an adopted specific cost index or on a change in the costs of materials, labor or real property applied to projects or projected capacity on a project list adopted pursuant to section 7.715(2) may be adopted by the City Manager by administrative order pursuant to section 2.020 of this code.” (b) The amount charged by the City in the past. Council Resolution 5306 adopted a new methodology to calculate Parks SDC fees effective January 1, 2022. The inflationary rates used to arrive at the proposed SDC increases are determined by reliable sources and the proposed SDC rate increases reasonably rely on those sources to determine the additional sums needed to develop the projects on the ORS 223.309 capital improvement plans for each system of SDCs due to inflation.
