HomeMy WebLinkAboutAdmin Order 56-21-07-F -- Final Police Fee Schedule AmendmentAdministrative Order – Page 1 of 1 ADMINISTRATIVE ORDER NO. 56-21-07-F of the City Manager of the City of Eugene SETTING POLICE SERVICES AND ANIMAL LICENSING, REGISTRATION AND IMPOUNDMENT FEES AND SUPERSEDING THE FEE SCHEDULE ADOPTED BY ADMINISTRATIVE ORDER NO. 56-20- 03-F. The City Manager of the City of Eugene finds as follows: A. Section 2.020 of the Eugene Code, 1971, authorizes the City Manager to determine and set fees and charges to be imposed by the City for services, goods, use of municipal property, and licenses and permits. B. Pursuant to the above authority, on November 3, 2020, I issued Administrative Order No. 56-20-03-F establishing the current Police Services and Animal Licensing, Registration and Impoundment Fee Schedule (“the Fee Schedule”). C. On November 26, 2021, I issued Administrative Order No. 56-21-07-F, ordering that notice be given of the opportunity to submit written comments on my proposal to amend the Fee Schedule by setting new Used Merchandise Annual Reporting System fees. The Notice specified that comments on the proposed amendments would be received for 15 days from December 3, 2021, the publishing and posting date of the Notice. No comments were received within the time or in the manner described in the Notice. D. Based on my investigation pursuant to the provisions of Section 2.020 of the Eugene Code, 1971, I find that the fees should be set as proposed. (See Exhibit B to this Order) E. The unamended Police Services and Animal Licensing, Registration and Impoundment fees adopted by Administrative Order No. 56-20-03-F are incorporated into the Fee Schedule attached as Exhibit A to this Order. On the basis of these findings, I order that: 1. The Police Services and Animal Licensing, Registration and Impoundment Fee Schedule attached as Exhibit A to this Order is the schedule of fees to be charged for the described services as of the effective date of this Order. 2. The Fee Schedule attached to Administrative Order No. 56-20-03-F is superseded by the Police Services and Animal Licensing, Registration and Impoundment Fee Schedule attached as Exhibit A to this Order, as of the effective date of this Order. Findings: N/A (b) The amount charged by the City in the past. Findings: Fees for this service have fluctuated over the years, consistent with fluctuating expenses associated with contractual obligations for obtaining the service. The current vendor utilizes an annual fee escalation, so these expenses will continue to increase each year. (c) The full costs of providing the service supported by the fee. Findings: These fees cover the operating cost of the contract with our vendor and is prorated by historical numbers of transactions by each store. (d) The amounts charged by other comparable providers. Findings: N/A. There are no other comparable providers of this service as it is a unique transactional relationship between used merchandise dealers and law enforcement agencies that is governed by ordinance. (e) The revenue needs of the City as determined by the adopted city budget. Findings: The collection of these fees are a budgeted revenue within EPD’s budget to offset the cost of operating the program software. The vendor utilizes an annually escalating fee structure, with the costs being passed on to the used merchandise dealers who participate in the program, resulting in the program being self-funded.
