HomeMy WebLinkAboutOrdinance No. 19776ORDINANCE NO. ~ ~p AN GRDINANCE AMENDING THE EUGENE-SPRINGFIELD METRGPGLITAN AREA GENERAL PLAN TG ENLARGE THE URBAN GRGWTH BOUNDARY 4F THE CITY GF SPRINGFIELD BY ADDING TAX LGTS 401, 40Z, 403 AND 405 QF MAP 17-0~-Z8; APPLY NEw LAND USE DESIGNATIGNS Ta THE PROPERTY; AMENDING THE TEXT' OF THE PLAN; AND ADOPTING A SAVINGS AND SEVERABILITY CLAUSE. The City Council of the City of Eugene finds that: A. The City Council of the City of Eugene has received a praposal from the City of Springfield Springfield Journal No. 90-11-177} far the amendment of the Eugene Springfield Metropolitan Area General Plan Metro Plan} to add a 75 acre parcel of land to the Springfield Urban Growth Boundary, to amend the land use designations of the site, to apply Springfield zoning districts to the site, and to amend the text of the Metro Plan to add a statement concerning water-related industrial uses. B. This proposal comes to the City of Eugene for action pursuant to procedures described in the Metro Plan and Chapter 9 of the Eugene Code, 1971 for amendment and refinement of the Metro Plan. C. The Springfield Planning Commission reviewed the proposal in a public hearing on December 12, 199, and recommended approval. D. The Lane County Planning Commission reviewed the proposal in a public hearing on March 19, 1991, and recommended approval to the Board of County Commissioners of Lane County. E. The Eugene Planning Commission reviewed the proposal in a public hearing on April 2, 1991, and recommended approval to the City Council. F. Evidence exists within the record indicating the praposal meets the requirements of Chapter 9 of the Eugene Code, 1971, and the requirements of applicable state and local law. G. The City Councils of Eugene and Springfield and the Board of County Commissioners of Lane County conducted a public hearing on April 29,1991, and the City Council of the City of Eugene is now ready to take action. Ordinance - 1 NOW, THEREFORE, THE CITY OF EUGENE DOES GRDAIN AS F~LLGWS; Section 1. The above findings, and the lndings set forth in Exhibit C, attached hereto and incorporated herein by reference are adopted. Section Z. The Springfield Urban Growth Boundary is enlarged by addition of property identified as Tax Lots 401, 402, 403 and 405 of Map 17-02-28, being approximately 75 acres in area, as depicted on Exhibit A attached hereto and incorporated herein by reference. Section 3. The Metro Plan Diagram land use designation of the property is amended from "Sand and Gravel" to a combination of "Natural Resource," "Light-Medium Industrial," and "Sand and Gravel," as depicted on Exhibit B attached hereto and incorporated herein by reference. Section 4. The following text is added as a Policy statement in Section III-B of the Metro Plan ~"Economic Element"~: Industrial land uses abutting the large aggregate extraction ponds north of High Banks Road in Springfield shall demonstrate that they require the location next to water to facilitate the manufacture or testing of products made on-site. Section 5. If any section, subsection, sentence, clause, phrase or portion of this Grdinance is far any reason held invalid or unconstitutional by any court of competent jurisdiction, such portion shall be deemed a separate, distinct and independent provision, and such holding shall not effect the validity of the remaining portions hereof.
