AN ORDINANCE CONCERNING THE MU-E ELMIRA ROAD MIXED-USE
DISTRICT, FOR PROPERTY ON THE NORTH SIDE OF ELMIRA ROAD.
THE CITY OF EUGENE DOE5 ORDAIN AS FOLLOWS:
Section 1. Description and Purpose. The purpose of the MU-E Elmira
Road Mixed-Use District i s to al l ow a mix of 1 ow-density residential uses and
a 1 imi ted range of commercial uses . The district i s to be applied to proper-
ty on the north side of Elmira Road that has historically been used for a
variety of commercial and i ndustri a1 functions, including use by Govdwi 11
Industries.
This MU-E District i s also intended tO achieve the f o11 owi ng, more spe-
ci f i c purposes;
a. To allow use of existing non-residential structures on the property
and development of complimentary structures far video, audio, and
and film production related purposes;
b. To ensure that non-residential uses of the property are compati b1 e
with adjacent residential areas, both on and of f the site to which
the district is applied;
c. To ensure that portions of the site are kept available far residen-
ts a1 development; and
d. To ensure that development within the Mixed-Use district is devel-
oped i n a compati b1 a manner with the surrounding neighborhood.
Section 2. Permitted Buildings and Uses. In this MU-E District, the
fol 1 owi ng categories of bus 1 di ngs and uses are permitted as a matter of
right, subject to the provisions of this MU ordinance and the Eugene Code,
1971:
a. Audio, video, and film production facilities ~e.g., studio, editing
suites, dubbing f ac i 1 i ti es, screening rooms, equipment storage and
maintenance, and similar functions}.
b. Nan-retai 1 art and photographic studios;
c. Accessory business services when ref ated to audio, video, or f i 1 m
production ~e.g., typesetting, word processing, computer services,
and similar functians~;
d. Conference rooms;
e . One dwelling unit i n any or all existing structures on the site as
of the effective date of this ordinance;

f . Non-retail dupl i cats an and printing when related to audio, video or
f i 1 m production ; and
g. Uses permitted outright in the RA Suburban Residential District
under Section 9.384 of the Eugene Code, 1911.
Section 3. Bui 1 di n s and Uses Permitted Condi ti anal 1 . In this MU- E
District, the .Hearings Official may grant a condi t i anal use permit i n accor-
dance with the procedures and standards set forth s n Section 9.696 to 9.122
of the Eugene Code, 1911. Bui 1 d i ngs and uses so permitted shat 1 be limited
to those 1 i steel as candi t i anal uses i n the RA Suburban Residential District,
Section 9.384 of the Eugene Code, 1971.
Section 4. aeyel opment ,Standards. The general provisions set forth s n
Sections 9.532 through 9.598 and the performance standards set forth in Sec-
tion 9.636 through 9.662 of the Eugene Cade, )911, shall apply in this MU-E
District, except where the standards listed below provi de a greater restri c-
tion.
a. All residential development shall be governed by the general provi-
s ions applied to the RA Suburban Residential District, except res i -
denti al development wi thi n a structure existing on the effective
date of this ordinance. Any residential development wi thi n a struc-
ture existing on the effective date of this ordinance shall conform
with the general provisions applied to the GO General Office Dis-
trict.
b. All non-residential development shall be governed by the general
provisions applied to the GO General Office District, with the ex-
cepts on that all buildings shall conform with the height 1 i mi tats ons
of the RA Suburban Residents a1 District.
c. A minimum of 3o percent or 1.45 acres of the total site of 4.14
acres shall be developed with residential uses.
d. Any redevelopment p1 an for the existing i ndustrs al structures or new
non-residential structures shall be reviewed under the Site Review
procedures contained in Sections 9.686-9.694, with the following
specific concerns to be addressed during this site review process
1. Compati bi 1 i ty with surroundings, particularly when resi dents a1
in character.
2. Efficient, workable, and safe s nterrel ati onshi ps among bui 1 d-
i ngs, parks ng, ci rcul ati an, open space, and 1 andscaped areas, as
well as ref ated activities and uses .
3. Safe and efficient ingress and egress.
e. Any new, non-residential structures shall be set back a minimum of
25 feet from the exterior boundaries of the site.
f. Signing for residentsal portions of the site shall be governed by
the provisions of the Residential Sign District; signing far non-

residential portions of the site shall be governed by the provisions
of the General office Sign District.
