AN ORDINANCE CONCERNING SANITARY SEWERS AND SEWAGE
DISPOSAL REGULATIONS; AMENDING SECTION 6.010 OF THE
EUGENE CODE, 1971y AND DECLARING AN EMERGENCY.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. Section 6.010 of the Eugene Code, 1911, is amended to pro-
vide:

~1} Except as provided in subsections fi.010~3} and fi.010~4},
within the city or within a local improvement district for sanitary sewers
created by the council, all structures in which plumbing fixtures are in-
stalled or which discharge domestic sewage, industrial waste or trade waste
and are 1 ocated within 160 feet of a publ i c sanitary sewer or of a publ i c
right-of-way containing a public sanitary sewer shall be connected t0 the
public sanitary sewer system i n a manner prescribed by this code and shat l
discharge all sewage into such system.
~ 2} No private sewage disposal system shal 1 be allowed wi thi n
the city unless the requirement in subsection ~1} above cannot be met and
approval and a permit is obtained from the Lane County Health Department.
~3} When a structure has been serviced by an apprOVed private
sewage disposal system and a public sanitary sewer becomes available as des-
cribed in subsection 6.0101}, the city may allow an 18 month grace period
from the date the property owner or person in charge of property receives
actual notice of the public sanitary sewers' avai 1 obi 1 i ty within which to
connect the structure to the public sanitary sewer. If allowed, the 18
month grace period terminates when work is done on the affected property
that requires a plumbing permit or when conditions exist on the affected
property which are described in subpart fi.010~g} or section 6.075.
~4} Except for actions enforcing subpart 6.010~g} or section
6.015, at 1 east 90 days before initiating 1 egal action al 1 egi ng a vi al ati on
of section 6.0101} the property owner ar person in charge of property shall
be sent written notice advising that legal proceedings will be filed against
them for violation of section 6.070 if they have not completed the required
sewer connection within 90 days.
~ 5 } The notice required by subsection 6.070 ~ 4 } shat 1 be delivered
by personal service or sent by certified mai 1 to the property Owner or per-
son i n charge of property and shall describe the premises required to be
connected to the public sanitary sewer, the date after which legal proceed-
i ngs may be initiated far violation of section 6.010, and the city office
where information and required permits may be obtained. A copy of the
notice shall be sent by first class mai 1 to the occupant of the property i f
other than those receiving the required notice.
~fi} No person shal 1 sever a sewer connection or disconnect without
first obtaining permission from the responsible city official.

~1~ The conditions prohibited by this section are nuisances and
subject to abatement as provided in this code.
Section 2 . The City Recorder, at the request of, or with the concur-
rence of the City Attorney, is authorized to administratively correct any
reference errors contained herein or i n other provisions of the Eugene Code,
1911, to the provisions amended, added or repealed herein.
Section 3. That the matters contained herein concern the public health,
welfare, and safety and therefore, an emergency i s hereby declared to exist,
and this Ordinance shall become effective immediately upon its passage by
the City Council and approval by the Mayor, retention by the Mayor for more
than ten days, or readaption over a mayoral veto by two thirds of all members
of the Council .
