AN ORDINANCE CONCERNING CITY BOARDS, COMMISSIONS AND
COMMITTEES; AMENDING SECTIONS 2.013, 2.249, AND 8.005
OF THE EUGENE CODE, 1911; ADDING SECTION 2..215 TO THAT
CODE; REPEALING ORDINANCES AND RESOLUTIONS IN CONFLICT;
PROVIDING AN EFFECTI~+`E uATt; AND DECLARING AN EMERGE~~CY.
THE CITY OF EUGENE DOES ORDAIN AS FOLL04~5:
Section 1. The table of Boards, Commissions and Comrni ttees set forth i n
Subsection ~ 1 } of Section 2.013 of the Eugene Cade, 1971, i s amended by del et-
i ng ''Air Qua1 i ty Maintenance Area Advisory Committee, " "`Joint P1 anni ng Commi s-
s i on Committee, " "Lane County Economic Improvement Commission, " "Lane County
Employment Training Advisory Committee," "Lane County Legislative Committee,"
and "Lane County Social Services Advisory Committee" therefrom, amending the
provisions far '"Board of Appeals" and "Joint Parks Committee" set forth there-
in, and adding "Housing Rehabilitation Loan Review Committee"~in alphabetical
order therein, to provide:

Section 2. Anew Section 2.215 is added to the Eugene Code, 19T1, to
provide:
2.215 Housi n Rehabilitation Loan Review Committee.
~ 1 } Pur ose. A hous i ng rehabi 1 i tat i an 1 aan review committee i s
created, which shall serve as an advisory body to city staff in connection
with the city's housing rehabi 1 i tati on loan programs .
~ 2 } Duties ; The committee shall review underwriting or program
requirements and haus~ ng rehabi 1 ~ tati on loan requests, and make recommenda-
t~ ons to c~ ty staff concerns ng housing rehabilitation lawn approvals or
denials .
~3 } Membersh i The committee shall consist of five members nomi -
nated by the mayor and appointed by the council . One member shal 1 be sel ect-
ed from each of the fall owing areas of expertise useful i n evaluating hausi ng
rehabilitation 1 oan requests:
~a} Real estate appraisal;
fib} Finance;
~c} Finance/real estate investment;
~d} low- i ncame persons/mi Hari ti es/people with di sabi 1 i ti es;
and,
fie} Low-income housing.
~4} Term of Office. The initial terms shall be staggered, with
three members appo~ rated for a two year term and two members appointed for a
one year ,term. The assignment of these i n i t i a1 terms shat l be determined by
al phabet ~ cal order. Thereafter, al 1 appointments shall be to f i 11 an unex-

pi red term or far a two year term, as the case may be.
~ 5 } vacancies . Vacancies i n the committee shal 1 be f i 11 ed i n the
same manner and from the same area of expertise as original appointments. A
position becomes vacant upon
~ a} The death ar res i gnati vn of the incumbent;
fib} Removal of an incumbent by the council for misconduct or
non-performance of duty;
~c} Fai 1 ure of the counci 1 to reappoint an incumbent at the
expiration of his or her term; or
~d} The incumbent ceases to be qualified for i ni ti a1 appoi nt-
ment.
Section 3. Subsections (1)(a) and (3) of Section 2.249 of the Eugene
Code, 1911, are amended to provide:
2.249 Tree Commission - Membershi Term of Office.
~1} The tree commission shall consist of nine members, nominated
by the mayor and appointed by the counci 1, and composed of
~a} One representative from the Eugene parks and recreation
commission;
~3} , The members from the Eugene parks and recreation commission,
pl ann ~ ng comma ss ~ on, EWEB and nee ghborhood group shall serve far a two year
term. The initial terms far citizen members shall be staggered, with one
member appointed for a one year term, two appointed for two year terms, and
two appointed for three year terms . The assignment of these initial terms
shall be determined by alphabetical order, Thereafter, each citizen member
shall serve for a term of three years from the date of his or her appoi nt-
ment.
Section 4. Subsections 8.0051}~c}1,, ~c}2., and ~c}3. of the Eugene
Code, 1911, are amended to provide:
8.005 Administrative Code.

Construction Cade Board of Appeals consisting of members who
are qualified by experience and training to act upon matters
pertaining to building construction and building service
equipment and who are not employees of the city. The city
manager, after consul tat i on with the board, shall adopt rules
of procedure for conducting the board's business. The board
shall have na authority to interpret the pravi s i ons of th i s
administrative code, be empowered tv waive requirements of

the technical codes, nor render a decision which conflicts
with a written decision or interpretation issued by a state
agency .

claims that the city has denied, suspended or revoked a permit

city has misinterpreted the true intent of a techn i cal code .
The owner of a building or structure or property also may
appeal from a decision of the city manager refusing to grant
a modi f i cat i an to the prov i s i ins of a techn i cal code covering
the design or method of construction or materi a1 to be used i n
the erection, a1 terati on, or repair of the bui 1 di ng or struc-
ture or bui 1 d i ng service equipment when i t i s the app] i cant's
bet ief that he/she has proposed an equally good or better
material or method of construction ar installation than that
required by a technical code.
3. Membershi of construction code board of a eal s.
The construction code board of appeals shall consist of eight
~8} members nominated by the mayor and appai nted by the
council. The eight board members shall consist of: a licensed
professional engineer, architect, bui 1 di ng contractor or sup-
eri ntendent of bui 1 di ng construction, electrical contractor,
an Oregon 1 i censed engineer with electrical speciality, p1 umb-
i ng contractor, mechanical ~heati ng and venti l ati one contrac-
tor, and Oregon 1 i censed engineer with mechanical speciality.
The city manager or designees, shal 1 be ex of f i c i a members of
the board.
Section 5. The City Recorder, at the request of, or with the concur-
rence of the City Attorney, i s authori ted to administratively correct any
reference errors cantai ned herein, or i n other provisions of the Eugene Code,
1911, to the provisions added, amended, or repealed herein.
Section fi. Notwithstanding the effective date of this Ordinance, the
provisions contained i n Section 4 of this Ordinance changing the composition
of the Construction Code Board of Appeals shall become effective upon the
expiration of two of the current journeyman positions on December 31, 1992,
or upon any of the current three journeyman positions becoming vacant, which-
ever first occurs.
Section 1. Resolution Nos . 2831 and 3085, and any other Resolution or

Ordinance i n conflict herewith i s hereby repealed.
Section 8, That the matters contained herein concern the public welfare,
and in order to ensure the orderly implementation of the provisions contained
herein, an emergency i s hereby declared to exist, and except as provided i n
Section 6 above, this Ordinance shall become effective immediately upon its
passage by the City Council and approval by the Mayor, retention by the Mayor
for more than ten days, or readoption over a mayoral veto by two thirds of
all members of the Council .
