HomeMy WebLinkAboutOrdinance No. 19806ORDINANCE NO. ~ °t ~ b ~o AN aRDINANCE LE'VYLNG ASSESSMENTS FaR SANITARY SEWERS IN THE RIVER ROAD AREA FaR BASINS "A," "B," AND "C", AMENDING THE ASSESSMENT ROLL ATTACHED TU aRDINANCE N4. 19757; AND DECLARING AN EMERGENCY. The City Council of the City of Eugene finds that: 4n March 4, 1991, Grdinance No. 19757 was passed by the Council and approved by the Mayor, levying assessments against the properties listed on the Assessment Roll attached thereto as Exhibit C for the construction of sanitary sewers in the River Road area for Basins "A," "B," and "C". A parcel of property in the name of William K. and Gloria J. Arne, located at 699 Howard Avenue, Eugene, gregon 97404, identified as Tax Lot 1?-04-14-31-119x, Account No. 90-1102-0010, was included as specially benebtted property in the local improvement district farmed for construction of sanitary sewers in the River Road area for Basins "A," "B," and "~" by Resolution No. 4180 adopted by the Council on May 29, 1994. The property was not, however, included in the Assessment Roll attached to Grdinance No. 19757 because the property was part of a bankruptcy proceeding. The property has now been released from the bankruptcy proceeding and the assessment can be levied. The Assessment Roll attached as Exh~~it "C" to +~rdinance No. 19757 should be amended by adding thereto the assessment for William K. and Gloria J. Acre, 699 Howard Avenue, Eugene, Qregon 97404, Tax Lot 17-44-14-31-1194, account number 941102-4414, in the amount of $3,732.84. ~. ordinance -1 Notice of the assessment and an opportunity to be heard thereon has been provided to William K. and Gloria J. Arre, as required by Sections 7.185 and 7.187 of the Eugene Cade, 1971. The assessment of this tax lot will not affect the amounts levied against other properties included on the Assessment Roll attached as Exhibit "C" to ordinance No. 19757. Now, therefore, THE CITY of EUGENE DGES GRDAIN AS FULLO'~'S: Section 1. Based upon the above findings, which are hereby adapted, the Assessment Roll attached as Exhibit "C" to Ordinance No. 19757, passed by the Council and approved by the Mayor an March 4,1991, is amended by adding thereto the following assessment: Account No. Name Amount 9U1102-401U 'William K. and Gloria J. Arre $3,732.84 Section 2. The finance officer is directed to: 2.1 Make the above corrections to Exhibit "A" to Ordinance No. 19757 by increasing the amount reflected in ITEM 12. TGTAL ASSESSMENT by $3,732.84, and by correcting the Assessment Roll attached as Exhibit "C" to ordinance No. 19757 by adding the information set forth in Section 1 of this Ordinance thereto; 2.2 Make the above correction to the docket of city liens; and 2.3 Send a notice of the assessment to the property owners set forth in Section 1 above. Section 3. Except as herein specifically amended, all other provisions of Qrdinance Grdinance - 2 No. 19757 and the assessments provided far therein remain in full force and effect. Section 4. That the matters contained herein concern the public welfare and safety, and it is necessary that the above corrections be made as soon as possible, and therefore, an emergency is hereby declared to exist, and this Ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor, retention by the Mayor far more than ten days, or readoption over a Mayoral veto by two thirds of all members of the Council. Passed by the City Council this day of ~o v~~s~2 ~ 1991 ~~ City R er Approved by the Mayor this day of ~D wQ•~ ~ , 1991 ,' . yor Ordinance - 3 FINDINGS AND RECD ATIDNS SUBJECT: SANITARY SEWER ASSESSMENT FOR TAX LOT 17-041431-11900 RIVER ROAD SArTITARY SEWER PROJECT BASIN B (CONTRACT 90-10) BACKGROUND This project was initiated by City Council in May of 1990. At the time of final assessment in February 199 ~ this particular tax lot was undergoing bankruptcy proceedings. The tax lot was deleted from the final assessment roll until such time that an assessment lien could be placed with limited risk. ASSESSMENT The assessment is based on actual costs of the construction of the project and the current local and regional systems development charges. The costs to be assessed are shown below: Lateral $ .30/square foot Service $ 727.86/each Levy $ .025/square foot MWMC $ 222.00/each REC4 ATIaN The final cost are similar to the preliminary casts quoted at the local improvement hearing and are comparable to those assessed to other properties in the vicinity of this tax lot. Staff rec~m- mends approval of the assessment. A hearing regarding the above assessment was scheduled far October 22,1991 at 6:00 P.M, in the First Flaar Conference Room of City Hall II. Na persons appeared in regard to that hearing. Based upon the information provided by the City Engineer, the Hearings Official finds that the assessments for this project have been calculated in accordance with Eugene Code.
