HomeMy WebLinkAboutOrdinance No. 19813ORDINANCE N0. /9~l/~ AN ORDINANCE GRANTING TD THE BURLINGTON NORTHERN RAILROAD COMPANY, A DELAWARE CORPORATION, ITS SUCCESSORS AND ASSIGNS, THE FRANCHISE TO MAIN- TAIN ITS RAILWAY TRACKS OVER CERTAIN STREETS IN THE CITY OF EUGENE, AND TO OPERATE TRAINS AND CARS THEREOVER, AND TO TRANSPORT PASSENGERS, FREIGHT, MAIL, BAGGAGE, AND EXPRESS THEREON, AND TO MAINTAIN ITS PRESENT POLES AND WIRES OVER CERTAIN STREETS IN THE CITY OF EUGENE, OREGON. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. That there be and hereby is granted to BURLINGTON NORTHERN RAILROAD COMPANY, a Delaware corpvrativn, its successors and assigns, the franchise and right to lay, construct, and maintain its present tracks and its present sidings, switches, curves, and connections, and to operate and run trains and cars thereaver, and to transport passengers, freight, mail, baggage, and express thereon, subject to the following restrictions and upon the following named streets and places in the City of Eugene, Oregon, T4 WIT: Across all intervening streets southerly and easterly of the intersec- tion of the right-of-way of the BURLINGTON NORTHERN RAILROAD COMPANY and the northern city limits of the City of Eugene, and extending southeast- erly to the easterly line of the intersection of Grant Street and 5th Avenue, including the crossings of Grant Street, Garfield Street, Roosevelt Boulevard, Side Street, Bethel Drive and Prairie Road. Together with the right and privilege of maintaining and reconstructing~on all the streets above described, such wyes, frogs, switches, curves, and connections, as said BURLINGTON NORTHERN RAILROAD COMPANY, its successors and assigns may deem necessary or convenient in the maintenance or replacement of ,. its present equipment, without in anywise extending the same. And that there be and there is hereby also granted to said BURLINGTON NORTHERN RAILROAD COMPANY, its successors and assigns, the right tv re-erect, reconstruct, and maintain poles, wires, and other necessary and convenient equipment for the purpose of preserving and maintaining its present equipment for conveying power and electrical current for its awn use, all upon the streets heretofore designated. Provided, however, that no switching of trains or cars shall be permitted on the streets of the City of Eugene other than to permit the plac- ing of cars at warehouses or other loading places. And provided, further, that all of the equipment shall be maintained in a reasonably good state of repair, properly painted, and that no poles shall be supported by stubs. Section 2. That there be and is hereby granted to said BURLINGTON NORTHERN RAILROAD COMPANY, its successors and assigns, the right to maintain and operate cars aver all private tracks and private property now occupied by it. Section 3. Said BURLINGTON NORTHERN RAILROAD COMPANY, its successors and assigns, shall have the right to do all necessary excavating or grading for the repair and maintenance of said streets and all portions of said streets so excavated or graded must be replaced in as near the original con- di ti an as practicable, and said company, its successors and assigns, shat l , during the term of this franchise, keep the portions of said streets upon which tracks are maintained, in as good condition and repair as the remainder of said street is maintained and to uniform street grade, for the whole width of said right-af-way between the rails of each track, and for the width of two feet on the outside of the rails of each track, and in case such streets shall be improved by the said city, the cost of improving the portions of said streets last above described sha11 be borne by the BURLINGTON NORTHERN RAILROAD COMPANY. Section 4. The motive power employed for operating cars and locomotives upon such tracks shall be diesel or diesel -electric. Section S. The rate of speed of all cars sha11 not exceed twenty miles per hour between grade crossings within the limits of the City of Eugene, and cars stopping at crossings shall not obstruct the cross-streets of said City and longer than five minutes at any one time. Section fi. All the rights herein granting a franchise to the BURLINGTON NORTHERN RAILROAD COMPANY upon and over the streets and places described in Section 1 shall continue and be in full force and effect for ten CIO} years from and after the date of the final approval of this ordinance. Section 1. ~A11 franchises or rights herein granted are upon the condi- tion that BURLINGTON NORTHERN RAILROAD COMPANY, its successors or assigns, shall, within thirty X30} days from the time this ordinance is approved by the Mayar, or otherwise takes effect, file with the City Recorder a written acceptance of its provisions. Section 8. As compensation to the City for the rights and privileges granted by this ordinance, and in order to secure to the City adequate ser- vice, BURLINGTON NORTHERN RAILROAD COMPANY, its successors or assigns, shall pay to the City annually during the life of the franchise granted by this ordinance, a flat fee of six-hundred dollars ~$fio4} per year, payments to be made within one hundred 'eighty ~ I80} days after the close of each calendar year. A flat fee is used in this franchise because of the difficulty of calculating a franchise fee based on the gross income of the BURLINGTON NORTHERN RAILROAD COMPANY. Such compensation shall not be in lieu of or a credit against any ad valorem or business tax, special assessment, or permit or inspection fees required by the construction code, or other ordinances of the City. Section 9. The franchise granted by this ordinance is hereby declared to be subject to the provisions of Section 43 of the Eugene Charter of I91fi, providing that the price to be paid by the City upon the acquisition of any public utility within the City by purchase, condemnation, or otherwise, shall exclude the value of any franchise. Section Io. In the event that BURLINGTON NORTHERN RAILROAD COMPANY ar its officers, agents or employees shall damage or cause harm to any property owned by the City, BURLINGTON NORTHERN RAILROAD COMPANY sha11, at the sole option of the City, repair, replace, or reimburse the City of Eugene for the cost of repair for such property. The City of Eugene shall not be responsi- ble far any damage to BURLINGTON NORTHERN RAILROAD COMPANY property by any third person or resulting from natural or unknown causes. BURLINGTON NORTH- ERN RAILROAD COMPANY sha11 `indemnify and hold the City and its officers, agents and employees harmless from and against all claims, actions, liabili- ties, costs, including attorney fees and other cysts of defense or appeal arising out of or in any way related to operations made possible as a result of this franchise.
