AN ORDINANCE CONCERNING LOCAL IMPROVEMENTS; AMENDING
SECTION 1.010 OF THE EUGENE CODE, 1971; AND DECLARING
AN EFFECTIVE DATE.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. The definitions of "Local improvement" and "Public way" set
forth in Section 1.010 of the Eugene Code, 1911, are amended to provide:
1.010 Definitions. for purposes of this chapter, the following words
and phrases shall have the meanings ascribed to them by this sec-
tion;
local im rovement. Any project or service or part thereof
undertaken by the city where all or part of the costs are borne by
1 ocal assessments 1 evi ed against parcels of real property which
provi des a speci al benefit only to specific parcels or rectifies
a problem caused by specific parcel ~ s } . Such 1 oval improvements
may include, but are not 1 i mi ted to, a street, sidewalk, street
light, underground ut i 1 i ty, sanitary or storm sewerage facility,
water uti 1 i ty foci 1 i ty, off-street motor vehicle parking foci l i ty,
flood control foci l i ty, park, playground or neighborhood recrea-
tion facility.
e Public. way. Any street, road, alley, right-of-way, pedes-
tr~ an or b~ cycl a easement, or utility easement for public use
which is controlled by the city, county or state.
Section 2. Pursuant to the provisions of Section 39 of the Eugene
Charter of 191fi, this Ordinance shall become effective six months from the
date of its adoption by the Council and approval by the Mayor, retest i on by
the Mayor for more than ten days, or readoption over a Mayoral veto by two
thirds of al ] members of the City Counci 1.
