AN ORDINANCE CONCERNING MU-IC WHITEAKER
INDUSTRIAI,~COMMERCIAL USE DISTRICT FOR PROPERTIES
L(ICATED IN THE DER COMMUNITY; AND DECLARING AN
EMERGENCY
THE CITY OF EUGENE DGES ORDAIN AS FOLLOWS;
Section 1. Descri tion and Pu se. The purpose of the MtJ-IC Whiteaker
IndustriallCammercial Mixed-Use District is to encourage a mix of industrial and
complementary commercial uses. The district is intended for application to an area that
has historically been zoned for industrial use, but which is characterized by a diversity of
uses, including industrial operations, quasi-commercial functions, and same residential
uses. The district facilitates reuse of existing structures and encourages retention of the
character established by the Planing Mill. The district is also intended to expand the range
of use which can occur in the area immediately adjacent to the central downtown core.
Recognizing that portions of the area where this district will be applied are developed with
residences, the district permits continued and new residential use; however, it does not
mandate new residential development.
Section 2. Permitted Buiidin s and Uses. In this MU-IC District, the following
categories of buildings and uses are permitted as a matter of right, subject to the
provisions of this MU-IC ordinance and the Eugene Cade, 1971.
(a} Light-medium industrial uses as permitted under Section 9.45, Eugene Cade,
1971.
(b} General and professional office uses permitted in the General Office District
under Section 9.439, Eugene Code, 1971.
(c~ Amusement and recreation services;
1. Dance and health studios and schools.
2. Billiard and pool establishments.
3. Coin-operated amusement devices.
(d} Eating and drinking places;
1. Eating places, excluding drive-ins.
2. Taverns and micro-breweries
(e} Educational services;
1. Public schools and accredited private schools.

gym} Home occupations, subject to Sections 9.494 and 9.49b, Eugene Code, 1971,
or as hereafter amended.
(n} Accessory buildings and uses normal and incidental to the uses permitted in
this MU-IC ordinance.
Section 3. Development Standards. In this MtJ-IC District, the general provisions

set forth in Sections 9.532 to 9.595 General Provisions: Height, Yard, Area, and
Coverage Regulations, Conditions and Exceptions; Special Setback Requirements; off-
Street Parking Requirements} of the Eugene Code, 1971, shall apply, except as provided
below.
~1} Residential Standards. A11 residential development shall be governed by the
general provisions as applied to the R-3 Multiple-Family Residential District, Eugene
Code, 1971.
~2} Industrial Standards. All industrial development shall be governed by the
general provisions as established in the I-2 Light-Medium Industrial District, Eugene Code,
1971, except as provided herein.
~3} Commercial General and Professional office Standards. All commercial,

general, or professional office development shall be subject to the standards established
for the C-2 General Commercial District, Eugene Code, 1971, except as provided herein.
~4) Parlo'n~. Gff-street parking shall be provided in accordance with Sections 9.5S1~
to 9.595, Eugene Cade, 1971, except that the minimum parking required for dwelling units,
other than quads and quints, shall be one space per dwelling unit.
~5} Yds. No lots or development sites in the MU-IC District shall have interior
or front yard requirements, except:
~a} To maintain vision clearance where streets and alleys intersect with
other streets or alleys; or
(b) When necessary to comply with the Uniform Building Code.
(6} ,,Landscapina. At the time the adjoining property is developed or
redeveloped, parking strip landscaping shall be restored, including the fallowing
specil~c areas:
~a} Between the sidewalk and the curb on the north side of 3rd Avenue,
from Washington to Lawrence Streets;
(b) Between the sidewalk and the curb along Washington Street;
(c) At the northeastern and southeastern corners of the intersection of 3rd
Avenue and Lawrence Street;
(d) Between the sidewalk and the curb at the northeastern corner of 2nd
Avenue and Lawrence Street;
(e) Between the sidewalk and the curb along the south side of 2nd Avenue,
from Lawrence to Lincoln Streets; and
~f) Where openings exist between the sidewalk and the curb on the north
side of 3rd Avenue, from Lawrence to Lincoln Streets.
Use of benches and moveable planters shall be encouraged. Any permits required by
provisions of the Eugene Code, 1971 shall be obtained prior to such restoration or
installation of benches and planters.
~7) Hei t. Height limitations for main buildings shall be a maximum of 64 feet
and 15 feet for accessory buildings. Height limitations established in Section 9.536 (c},
Eugene Cade, 1971, to protect the view to and from Skinner Butte, shall apply to those

areas indicated in that section.
~8} open ~S„~ace. Dpen space shall only be required for new residential
development and shall be provided in accordance with Section 9.567, Eugene Code, 1971.
(9} Street Trees. No street tree in the public right-of-way shall be removed
without Hirst securing from the city approval for the removal and of the replacement tree
therefore and any required permits,
~ 10} Lot Area. Each lot or development site shall have a minimum area of 4,500
square feet, except far a duplex division lot or cottage unit lot created in accordance with
Section 9.060 Platting and Mapping Standards}, Eugene Code, 1971.
X11} Solar Access. Development in the MU-IC District shall be exempt from the
solar access requirements of the Eugene Code, 1971.
~ 12} Si ngr_ District. The provisions of the Industrial Sign District shall apply within
the MU-IC District as set forth in Section 9.1043, Eugene Code, 1971. Illuminated
awnings shall not be permitted.
X13} Marker Preservation. Develo meat within this district shall not result in

removal of the stone marker of Eugene Skinner's cabin. when the area south of Second
Avenue, between Lawrence and Lincoln Streets, is redeveloped, enhanced opportunities
for public viewing of the stone marker shall be provided.
X14} Plannin Mill Character. Efforts shall be made to retain elements that reflect
the character of the farmer Planing Mill, such as the roof-mounted pipe and cyclone
system.
X15} Site Review Subdistrict. Any new development shall be reviewed under the
Site Review Procedures contained in the Eugene Cade, Sections 9.686-9.694 ~or as
amended hereafter}, with the following concerns addressed during the site review process:
~a} Compatibility with the surroundings, particularly when residential in
character. Height, setback, and noise are a major concern and its effect on
surrounding residential areas. The issue of height shall consider the view of the
Shelton-McMurphy House, particularly views of the structure from Willamette
Street. Compatibility shall also address the relationship of new development with
the view of Skinner Butte from the general area, particularly from Willamette
Street.
(b} Safe and efficient ingress and egress and on-site traffic circulation. This
factor includes the review by the City Traffic Engineer of the use of the 3rd-4th
connector and nay include requirements such as, but not limited tQ, right-of-way

dedication and realignment, street improvements, and sidewalks,
~c~ Due consideration to the preservation of attractive or distinctive
historical and natural features. Landscaping shah be provided that is consistent with
the character of Skinner Butte, including street trees along the 3rd-4th connector.
~d} Signs and illumination in scale and harmony with the site and area.
Section 5. That the matters contained herein concern the public welfare and in
order to insure the orderly implementation of the provisions hereof an emergency is
hereby declared to exist, and this ordinance shall become effective ina~mediately upon its
passage by the City Council and approval by the Mayar retention by the mayor for over
ten days, or readoptivn over a mayoral veto by two-thirds of all members of the council.
