AN ORDINANCE CONCERNING HOME OCCUPATIONS AND OTHER SAND USE
REGULATIONS; AMENDING SECTIONS 9.015, 9.384, 9.38b, 9.49fi
AND 9.538 OF THE EUGENE CODE, 1911; AND DECLARING AN EFFECTIVE
DATE .
THE CITY OF EUGENE DDES ORDAIN A5 FOLLDWS:
Section 1. Section 9.015 of the Eugene Code, 1911, i s amended by add -
ing a definition far "Home occupation" in alphabetical order therein, to pro-
vi de:
9.015 Definitions. As used in this chapter, unless the context requires
otherwise, the fol 1 owi ng words and phrases mean
Home _ accup„a,ti on . An activity that i s incidental to a dwel l -
ing's residential use and which involves the profit or non-profit
exchange of goods or services.
Section 2. The matrix set forth in Section 9.384 of the Eugene Code,
1911 is amended by adding "Model Home Sales Office" in alphabetical order
therein and amending the provision for "Fowl and Rabbits" to provide:
9.384 Uses. The following reflects the uses permitted outright, condi -
tionally, or subject to standards or other requirements of this
code within the RA, R-1, R-2, R-3, and R-4 zoning districts:

Section 3. Section 9.386 of the Eugene Cade, 1971, is amended by amend-

~h} Fowl and rabbits maximums: Up to two adult rabbits or
fowl ono roosters} over six months of age are allowed in R-1, R-2,
R-3, and R-4 districts if they meet the above standards. There is
no 1 i mi t an the number of fowl ar rabbits aver six months of age
permitted i n the RA district provided they are on 1 ots of at 1 east
20,000 square feet and they meet the above standards.
X32} Model Home Sales Office.
~a} May be used as a gathering point for sales and other
personnel provided they work i n the subdivision within which the
model home i s 1 acated.
fib} All office activities must be located entirely within
the dwelling or garage; na outside equipment or material storage
on the site other than as necessary to complete construction of
the units in that subdivision.
~c} There must be off-street parking spaces for all personnel
and business vehicles associated with the model home.
~d} The model home must be located in the subdivision under
development.
. fie} Signs are subject to the Residential Sign District prOVi-
s~ons ~n this chapter.
~ f } There must be no detrimental effect on the residential
character of the surrounding neighborhood through excessive traffic,
violation of the city's noise or other performance standards, ex-
cessive late or early hours of aperatian, yr other activities that
are incompatible with adjacent residential uses.
fig} The model home use must be discontinued when al 1 the
homes i n the subdivision have been sold.
Section 4. Section 9.496 of the Eugene Code, 1911, i s amended to prv-
vide:

zoning districts shat l be subject to the following standards. Day
care faci 1 i ti es serving 1 ess than three persons and garage sales for up to
three consecutive days two times in a twelve month period are exempt from
these standards.
~a} The home occupation must be located entirely within the
dwel 1 i ng, garage, or an accessory bui 1 di ng of the person conduct-
ing the home occupation,
fib} Signs shall be subject to the provisions of the Residen-
ti al Sign District. There shat 1 be ane sign permitted, which
shall consist of a maximum of one and one-half square feet in sur-

face area. The sign shall be attached to the dwelling or home
occupation structure and shall indicate only the name of the occu-
pant or home occupation.
{c} .There shall be no activity or display, other than the
al 1 awed s ~ gn, that w~ 11 indicate from the exterior of the bui 1 d-
i ng that the property i s being used for any purpose other than a
dwel l ~ ng.
{d} There shall be no outside storage of materials visible
from the street other than plant materials.
{e} There shall be no detrimental effect on the residential
character of the surrounding neighborhood through generation of
excessive traffic or on-street parking, or by noise, odor, vibra-
ti on, glare, heat, electromagnetic generation or other emissions
that are perceptible beyond the home occupation property, regular
freight truck del every of more than once a week, or other incom-
patible activities not in keeping with adjacent residential uses.
{ f } The home occupation shall not result i n any structural
a1 terati ons ar additions to the dwelling that wi 11 change its
primary use.
{g} The dwel 1 i ng shall not be used as a headquarters for the
assembly of workers for instructryion or other purposes, including
dispatch to other locations.
{h} There shall be a 1 imit of one business vehicle per home
occupation . I n connection with home occupat i ons, a bus i Hess
veh i c1 e i s any vehicle that i s used i n the conduct of the home
occupation, or which has the name or logo under which the home
occupati an activity i s conducted painted or otherwise exhibited
on the vehicle, or i s a veh i cl a that i s or has been depreciated
i n connection with the home occupation on state or federal tax
returns.
{ i } Other than dwel 1 i ng residents, there shal 1 be a maxi mum
of two workers per home occupation.
{ j } I n add i t i an to required parking i n conjunction with the
dwel 1 ~ ng, there shall be off -street parking spaces to accommodate
al 1 employee and business vehicles .
{k} The home occupation shall not interfere with on-street
parking.
{ 1 } An adult resident i n the dwel 1 i ng shall be employed i n
the home occupation.
{m} There shall be no separate home occupation address.
{n} , The home occupation must be incidental to the dwel 1 i Hg's
res~dent~al use.
{o} There shall be no motor vehicle repair except to vehicles
awned by people residing on the property.
Section 5. Subsection {5} of Section 9.538 of the Eugene Code, 1971,
is amended to provide:
9.538 General Yard Re ul at i ons .
(5) Special setback for ara es and carports. There shall be at

least 18 feet of driveway, accessway ar maneuvering space, as measured
through the center of the driveway, accessway, or maneuvering space, from
the street property line to the garage, or carport. The purpose of this
requirement is to require parking of motor vehicles wholly on private prop-
erty.
Section fi. The City Recorder, at the request of, or with the concur-
rence of the City Attorney, i s authorized to administratively correct any
reference errors contained herein or in other provisions of the Eugene Code,
1911, to the provisions added, amended or repealed herein.
Section 1. In order to allow sufficient time to implement the proce-
dural changes adopted herein, this Ordinance shall, upon passage by the
Council and approval by the Mayor, became effective on July 1, 1992.
