AN ORDINANCE CONCERNING WILDLIFE REHABILITATION;
AND AMENDING SECTIONS 9.015, 9.384, AND 9.386 OF
THE EUGENE CODE, 1911.
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. Section 9.015 of the Eugene Code, 1971 is amended by adding
a definition for Wildlife rehabilitation in alphabetical order therein, to
provide
9.015 Definitions. As used in this chapter, unless the context requires
otherwise, the following words and phrases mean:
Wildlife rehabilitation. The restoration of an injured, sick,
or immature wild bird, mammal, amphibian, or reptile to a condition
where i t i s capable of being released into the wild or, i f i ncap-
able of survival on its own, retained for educational purposes or
transferred to an organization, educational institution, museum,
publicly funded zoo or other facility as determined by the Oregon
Department of Fish and Wildlife.
5ectian 2. The matrix set forth in Section 9.384 of the Eugene Code,
1911 is amended by adding the following in alphabetical order therein, to
provide :

code within the RA, R-1, R-~, R-3, and R-4 zoning districts:

ing anew standard 33 thereto, to provide:

X33} Wildlife Rehabilitation.
~a} Commercial activities are not allowed. Breeding or
raising wildlife for sale or trade, or the sale or trade of ani-
mal products i s not permitted.
~ b} Al 1 wi 1 dl i f e that are outside, whether i n cages or not,
must be kept within an area that i s bounded by a s i te-obscuring
fence, Enclosures must be designed and constructed in a manner
that i s sturdy enough to prevent escape and access to their i nter-
iors by unauthorized people.
~c} All cages and wildlife facilities are subject to inspec-
tion by the Oregon Department of Fish & Wildlife and federal
agencies as required.
~d} Proper sanitation must be maintained at all times. Pro-
per sanitation includes:
1. Not allowing wildlife waste to adversely affect the
health of the wi 1 dl i fe itself, property residents, or neigh-
bors.
2. Taking necessary steps to ensure odors are not de-
tectable beyond praperty lines.
3. Storing all wildlife food i n rodent and pest resi s-
tant containers .
fie} All wildlife must be naturally occurring i n Oregon .
~f} Bears and cougars are prohibited.
. fig} At least one person licensed by the state of Oregon as

under the supervision of a licensed rehabilitator must occupy the
property.
~h} If the property is rezoned to something other than AG,
RA, or R-1, the use must be discontinued within two years.
~ i } Wi 1 dl i fe restored to a condi ti on whereby i t can be re-
l eased and survive under natural conditions must be removed from
the property. Wildlife that cannot be restored to a condi ti on
whereby i t can be expected to survive under natural conditions may
be retained for off -site wi 1 d1 i fe education, or to assist i n the
rehabi 1 i tati on of other animals, provided required state and fed-
eral licenses and permits are obtained.

Section 4. The City Recorder, at the request of, or with the concur-
rence of the City Attorney, i s authorized to administratively correct any
reference errors contained herein, or in other provisions of the Eugene Code,

1911, to the provisions added or amended herein .
