KATE FIELAND CITY RECORDER ORDINANCE N0. ~~~~ AN ORDINANCE ADOPTING THE METROPOLITAN NATURAL RESOURCES FUNCTIONAL PLAN AS AMENDED, ADOPTING GOVERNMENT-INITIATED AMENDMENTS TO THE METROPOLITAN AREA GENERAL PLAN TEXT AND DIAGRAM, AND ADOPTING A SE~fERABILITY CLAUSE. The City Counci 1 of the City of Eugene finds as fal 1 ows: I. The Metropolitan Natural Resources Special Study was initiated in July, I9H7, to address wetland and other natural resource sites in the Metro- politan Area and to update the natural resources portion of the Metropolitan Area General Plan. 2. The Natural Resources Functional Plan contains detailed policies and recommended actions concerning Statewide Planning Goal 5 and the existing natural resources system in the Eugene-Springfield metropolitan area. The accompanying Study Report includes a description of the study's purpose, background and methodology, site descriptions, analysis and recommendations and the economic, social, environmental and energy analysis prescribed by Statewide Goal 5. It provides information in support of the Natural Resources Functional P1 an pal i ci es . 3. A citizen advisory committee known as the Special Studies Advisory Committee reviewed and revised the Metropolitan Natural Resources Special Study preliminary inventory, study report and policy report. These documents were the subject of a joint public hearing before the Springfield, Lane Coun- ty, and Eugene Planning Commissions, review and revision by the Joint Plan- ning Commission Committee, further review by each of the three planning com- missions, and a joint public hearing before the governing bodies of Spring- field, Lane County, and Eugene. The Natural Resources Special Study Policy Report was reformatted and renamed the Natural Resources Functional Plan fallowing planning commission review and recommendations. 4. The Eugene, Springfield, and Lane County Planning Commissions rec- ommended adoption of the Natural Resources Functional Plan, inventory, Study Report, and associated working papers with amendments. 5. The Eugene, Springfield, and Lane County Planning Commissions rec- ommended adoption of text amendments to the Metropolitan Area General Plan, as shown in Exhibit B incorporated herein by reference. These amendments are included in the Functional Plan. The three planning commissions also recom- mended adoption of amendments to the Metropolitan Area General P1 an diagram, as shown in Exhibit C incorporated herein by reference. 6. Notice was provided to the Land Conservation and Development Com- mission on May Zo, 199Z concerning the proposed Metropolitan Area General Plan text and diagram amendments . 7. Implementation of the recommended actions contained in the Ordinance - I Functional Plan are subject to available funding and, in some cases, further analysis or processing of related plans yr studies. 8. The proposed government-initiated Metrvpvlitan Area General Plan text and diagram amendments are consistent with relevant Statewide Planning Goals and applicable po]icies in the Metropolitan Area General Plan as shown in the Findings set forth in Exhibit D, attached hereto and incorporated herein by reference. NOW, THEREFORE THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section I. The Metropolitan Natural Resources Functional Plan as amend- ed, attached hereto as Exhibit A, and incorporated herein by reference, is adopted. Section 2. The text amendments to the Metropolitan Area General Plan as set forth in Exhibit O, attached hereto and incorporated herein by reference, are adopted. Section 3. The diagram amendments to the Metrvpvlitan Area General Plan as set forth in Exhibit C, attached hereto and incorporated herein by refer- ence, are adopted. Section 4. The findings set forth above and the findings contained in Exhibit D, including the Metrvpvlitan Natural Resources Study Report and amendments thereto, attached hereto and incorporated herein by reference, are adopted. Section 5. Adoption of the Metropolitan Natural Resources Functional Plan, including text and diagram amendments to the Metropolitan Area General Plan, shall become effective only if they also are approved by Lane County and the City of Springfield. Section 6. If any section, subsection, sentence, clause, phrase, or portion of this Ordinance is for any reason held invalid or unconstitutional by any court of competent jurisdiction, that portion shall be deemed a sepa- rate, distinct, and independent provision and that holding shall not affect the validity of the remaining portions of this Ordinance.
