The City Council Qf the City of Eugene finds that; 4n March 4, 1991, Ordinance No. 19757 was passed by the Council and approved by the Mayor, levying assessments against the properties listed on the Assessment Roll attached thereto as Exhibit C for the construction of sanitary sewers in the River Road area far Basins "A", "B", and "C" A parcel of property in the name of Robert Clemens, located 2D97 Delta Street, Eugene, oregon 97404, identified as Tax Lot 17- 04-14-22-02229, Account No. 90-1202-0010, was included as specially benefitted property in the local improvement district formed for construction of sanitary sewers in the River Road area for Basins r~Air ~ ~iBri ~ and "C" by Resolution No. 4180 adopted by the Council on May 29, 1994. The property was not, however, included in the Assessment Roll attached to ordinance No. 19757 because the property was part of a bankruptcy proceeding. The property has now been release from the bankruptcy proceeding and the assessment can be levied, The Assessment Roll attached as Exhibit "C" to Ordinance No, 19757 should be amended by adding thereto the assessment for Robert Clemens, 2097 Delta Street, Eugene, Oregon 97404, Tax Lot 17-04-14- 22-02229, account number 901202-DO1D, in the amount $4,181.99. Notice of the assessment and an o art~un~it to be he pp y and thereon has been provided to Robert Clemens, as required by Sections 7,185 and 7.187 of the Eugene Code, 1971. The assessment of this tax lot will not affect the amounts levied against other properties included on the Assessment Roll attached as Exhibit !'C" to ordinance No. 19757. Now, therefore, THE CITY of EUGENE DQES ORDAIN AS FoLLQWS: Section 1. Based on upon the above findings, which are hereb Y adopted, the Assessment Roll attached as Exhibit "C" to ordinance No . 19 7 5 7 , passed by the Council and approved by the Mayor an March 4, 1992, is amended by adding thereto the following assessment: Account„~Na~. Name Amount 901202-10 Robert Clemens $4,181.99 Section 2. The finance officer is directed to: 2.1 Make the above corrections to Exhibit "A" to ordinance No,.19757 by increasing the amount reflected in ITEM 12. TOTAL ASSESSMENT by $4,181.99, and by correcting the Assessment Rall attached as Exhibit "C" to ordinance No, 19757 by adding the information set forth in Section 1 of this ordinance thereto; 2.2 Make the above correction to the docket of city liens; and 2.3 Send a notice of the assessment to the property owners set forth in Section 1 above, Section 3. Except as herein specifically amended, all other provisions of ordinance No. 19757 and the assessments rovided for p therein remain in full force and effect. Section 4. The assessment levied herein are characterised for purposes of the property tax limitation is Section llb, Art. xI of the Oregon Constitution as assessments for a local improvement nat subject tv the limitation of $10 per thousand of real market value. Section 4. That the matters contained herein concern the public welfare and safety, and it is necessary that the above corrections be made as soon as passible, and therefore, an emergency is hereby declared to exist, and this ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor, retention by the Mayor far mare than ten days, or readaption over a Mayoral veto by two thirds of all members of the Council.
