ORDINANCE N0. l~I ~~~ AN ORDINANCE AUTHORIZING THE INSTITUTION OF PROCEEDINGS IN EMINENT DOMAIN FOR THE ACQUISITION OF PROPERTY INTERESTS ALONG AMAZON CREEK BETWEEN BAILEY HILL ROAD AND BELTLINE HIGHWAY, FOR THE PURPOSES OF CONSTRUCTION AND MAINTENANCE OF DRAINAGE CHANNEL AND BIKE PATH IMPROVEMENTS. The City Council of the City of Eugene finds that: The City Counci 1 has authority under provisions of the City Charter and applicable state 1 aw to institute proceedings i n eminent domain for the acqui si - tion of private property far public purposes, including the improvement and maintenance of city drainage canals and bicycle/pedestrian paths. By Council adoption of the City's Capital Improvement Plan the City of Eugene initiated the acquisition of property a1 ong Amazon Creek interests for the continuing operation and maintenance of drainage channels and other features. The public's property interest in the present right-af-way containing the AmaZOn Creek Channel} is clouded. Because of the need to clarify the City's right to maintain the Channel, to enhance the Channel's carrying capacity as a drainage facility and to put the right-af-way to other public uses, including planned for bicycle and pedestrian paths, the City needs to clarify its property rights in the Channel's right-of-way. Enhancing the Channel and using i t to implement the Bicycle Element of the Eugene-Springfield Metropolitan Area Transportation Plan avoids having to purchase other right-of-way for additional drainage facilities and bicycle facilities. Such acquisitions would be unduly disruptive to already developed private property in the drainage and transportation corridors which the Channel right-of-way serves. Further such acquisitions would require substantially mare r' public dollars than the acquisitions herein approved. Any proposed improvements shall be incompliance with, and in furtherance of, plans and specifications to be prepared by the City Engineer in accordance with provisions of Chapter 7 of the Eugene Code, I97I, and applicable policies of the City of Eugene. Development and growth now necessitate extending the Fernri dge Bi kepath to serve the surrounding neighborhood and to continue compliance with the Bicycle Element of the Eugene-Springfield Metropolitan Area Transportation Plan. The cost of delaying the acquisition project, the savings from efficient management techniques, and the need to facilitate the safe and efficient movement of bicyclists and pedestrians requires the City to act promptly to acquire the necessary property interests far this project. NOI~, THEREFORE, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section I. Based upon the above findings, which are incorporated herein by reference and hereby adopted, the City Council of the City of Eugene does hereby find, declare, and determine it necessar to ac uire certain awnershi y q P interests i n portions of the parcels of real property mare parti cul art y described an Exhibit A attached hereto and incorporated herein by reference an order to properly maintain and enhance improvements to Amazon Creek between Bailey Hill Road and Beltline Highway including drainage enhancements, maintenance access, bikepath improvements and other features in accordance with plans and designs prepared by the City Engineer and approved by the City Manager. Section 2. The City Council does hereby direct that the City of Eugene shall institute negoti ati ans with affected owners to acquire needed property and institute proceedings in eminent domain for the acquisition of real property interests described in Section 1, and, at least 20Ydays prior to the filing of any action for condemnation to make a written offer to the owners ar parties ~~ having an interest therein of a stated amount as compensation therefore and for any compensable damages to remaining property. Section 3. The City Council further directs that the City Manager shall obtain for the City immediate possession of real property interests described i n Section I, if negotiations will delay the construction of the described improvements. Section 4. The City Council hereby declares that the improvements set forth above are for a public purpose, are necessary far the public welfare, are the mast compatible with the greatest public good and the least private injury, and are authorized under the laws of the State of aregon and Charter and ordinances of the City of Eugene. Section 5. The City Council further declares that the real property interests described in Section I shall be used by the City of Eugene for public purposes at the earliest possible date and, i n any event, no 1 ater than ten years from the date this Ordinance is adopted by the Council and approved by the Mayor.
