A SPECIAL ORDINANCE GRAIV~TING A D
E~MPTION TG THE APPLICATION OF EUGENE CODE,
1971, SECTIONS ~4.6$a AND 4.515; PROVIDING FOR AN
AUTOMATIC REPEAL AS OF JUNE 1, 1993; AND
DECLARING AN EMERGENCY.
The City Council of the City of Eugene finds as follows:
A. The City Council has publicly acknowledged its awareness of the severity of
problems facing homeless persons within the City and has initiated and supported
measures directed towards the alleviation of those conditions.
B. A proposal has been made that homeless persons be permitted to camp on
a temporary basis and far a limited period of time in a designated portion of Alton Baker
Park. Such camping is presently prohibited by Sections 4.6502} and 4.815 of the Eugene
Cade, 1971 SEC}.
C. it would be in the public interest and further City Council policies to grant
a limited and unique exception to the enforcement of EC Sections 4.b54~2} and 4.815 for
a designated portion of Alton Baker Park. This limited exception is granted on a trial
basis only and should not serve as a precedent for future exceptions, nor interfere with the
continued enforcement of EC Section 4.815 in other portions of the City.
NOW, THEREFORE,
THE CITY OF EUGENE DOES GRDAIN AS FOLLOWS:
Section 1. The findings set forth above are adopted.
Section 2. Notwithstanding Sections 4.6SO~2} and 4.515 of the Eugene Code, 1971,
the City Manager shall designate an area within the two western-most parking bays of the
V~ISTIC/Alton Baker parking area to be used by homeless persons for car or tent
camping. The Manager shall designate not mare than thirty sites for camping. The
Manager shall designate such sites as soon after the effective date of this ordinance as is
practicable, The Manager may adopt administrative rules to govern use of the
campground, including provisions related to allocation of the sites, and payment of ~a fee
for use of the campground. The Manager also may contract with anon-prol~t provider to
manage the day~to-day operations of the campground.

Section 3. Notwithstanding EC Subsections 4.6SO~2} and 4.5153} a person may
camp in one of the sites designated under Section 2 of this ordinance, provided that the
person complies with any rules adopted under Section 2, No person may camp within the
Acton Baker parking area except in one of the sites, and only if assigned the site pursuant
to the rules to be adopted by the City Manager. Violation of this ordinance or the rules
adopted hereunder shall be deemed a violation of EC 4.8153}, punishable under EC
Section 4.995.
Section 4. The authority granted under this ordinance shall terminate as of 12:00
noon on May 31, 1993. No person shall camp at any of the designated sites after that
time.
Section 5. This ordinance automatically shall be repealed as of June 1, 1993.
Section G. That the matters contained herein concern the public health, welfare
and safety and therefore, an emergency is hereby declared to exist, and this ordinance
shall become effective immediately upon its passage by the City Council and approval by
the Mayor, retention by the Mayor for more than ten days, or readaption over a mayoral
veto by two-thirds of all members of the City Council.
