CONTRACT 91-512j The City Council of the City of Eugene finds that: on the 6th day of March, 1990, as authorized in the Eugene Cade 7.160~8~ the City Engineer initiated the proposed local improvement consisting of a sound barrier wall along the south side of Beltline Road, from Norwood Street to Gilham Road. After due notice and a public hearing thereon before the hearing official, and no remonstrances having been filed, on the 10th day of December, 1990, the City Council formed the local improvement district and authorized construction of the local im- provement. The actual cost of the local improvement is ascertained tv be $89,085.31 and the amounts to be assessed to and borne by the specially benef fitted property and to be borne by the City or others has been determined in accordance with Resolution Number 4214, applicable provisions of the Eugene Code, 1971 and as set forth in Exhibit A attached hereto and incorporated herein by reference. The City Council has established the method of calculating local improvement assessments in Sections 7.170 and 7.175 of the Eugene Code, 1971. A notice containing the information required by Section 7.185 of the Eugene Code, 1971 has been posted on a bulletin board at City Hall and given by certified mail to the owners of the parcels of real property subject to the assessment more than ten days prier to the public hearing before the hearing official . At the time and place specified therein, a hearings official heard all evidence and argument presented, and no remonstrances having been filed, has fully considered the same, and has reported his or her adopted findings to the City Council. The Council has reviewed and considered the assessment report of the City Engineer and Finance Officer and the hearings offi- cial's findings and summary of the hearing, and based thereon, THE CITY of EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The Summary of the hearing conducted by the hearings official are hereby made a part of the Council's record in these proceedings, and the hearings official's findings, including those regarding compliance with Sections 7.160 to 7.190 of the Eugene Code, 1971, attached hereto as Exhibit B and incorporated herein by reference, are hereby adopted. Section 2. The actual cost of the local improvement comprised of a sound barrier wall along the south side of Beltline Road, from Norwood Street to Gilliam Road is $45,260.66 which is hereby assessed against the parcels of property hereinafter described in the amounts set opposite, respectively. Section 3. The City Council does hereby determine and assess each lot and part of lot being within the described local improve- ment district as set forth on the assessment roll attached as Exhibit C hereto and incorporated herein by reference. Section 4. The City Council does hereby determine that each parcel of land or lot hereinabove described is specially benefitted ORDINANCE - 2 to the extent of the assessment set forth. The Finance officer shall give notice of the assessments to the owners of the assessed parcels advising them the assessment may be paid in full, without interest, within ten days of the effective date of this ordinance. Assessments that remain unpaid after the ten day period are declared to be liens upon the respective lots, parts of lots or parcels of land against which said several amounts are assessed, and may be paid, with interest on the unpaid principal amount commencing ten days after the effect date of this ordinance: 4.1 In up to 20 semi-annual installments, including principal and interest at the rate and on the terms set by the City Manager as provided in E.C. 2.020 through 2.024. 4.2 If the property owner so elects, in up to 120 monthly installments, including principal and interest at the rate and on the terms set by the City Manager as provided in E.C. 2.020 through 2.024. Section 5. The City Recorder is directed to enter in the docket of City Liens a statement in connection with each unpaid assessment containing the following: 5.1 A description of each lot, part of lot or acreage specially benefitted by the local improvement; 5.2 The name of the owner or reputed owner thereof , that the name of the owner is unknown; and 5.3 The sum assessed upon said property, the amount and date from which interest accrues, and the date of entering the same in the docket of City Liens. oRDINANCE - 3 Section 6. Upon enactment of this ordinance, the City Finance Officer shall send notice of the assessments by first class to the owners of the assessed parcels containing the information required by Section 7.190 of the Eugene Code, 1971, and enclose therewith an application for paying the assessment in installments according to the terms set forth in Section 4 of this ordinance. Section 7. The assessments levied herein are characterized for purposes of the property tax limitation in Section 11b, Art. xI of the Oregon Constitution as assessments for a local improvement not subject to the limitation of $l0 per thousand of real market value. Section 8. Any assessment remaining unpaid and for which no application for installment payments has been received may be foreclosed as provided by law. The proceeds from the payment or foreclosure of assessments levied by this ordinance shall be deposited to the city funds which advanced the cost of construc- tion, engineering and related expenses or which are used to retire any indebtedness incurred by the City for this improvement. Section 9. That the matters contained herein affect the public welfare and safety and therefore, an emergency is hereby declared to exist, and this ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor, retention by the Mayor for more than ten days, or readoption over a mayoral veto by two-thirds of all members of the Council. ORDINANCE ~» 4 Passed by the City Council this ~~ a of 2c(~ , 199 ~-~ City Recor er Approved by the Mayor this a day of - jf °~~ 199, Mayor oRDINANCE ~ 5 FINDINGS AND RECUNIlV~NDATIONS SUBJECT: SOUND BARRIER WALL ALONG THE SOUTH SIDE OF BELTLINE ROAD, FROM NORWOOD STREET TO GILHAM ROAD (JOB #2433) BACKGRGUND A project to construct a sound barrier wall along the south side of Beltline Road from Norwood Street to Gilliam Road was initiated by a petition from property owners, representing 77% of the effected ownership. Based upon the interest of the property owners for the construction of such a sound barrier, an intergovernmental agreement was reached among the State of Oregon, Lane County and the City of Eugene. The agreement called for the State Highway Division to pay 50%, Lane County 25%, City of Eugene 12.5% and effected property owners 12.5% of the costs of the project. Following a public hearin g regarding the formative of a local improvement district (LID) for the construction of the project, the City Council authorized formation of the LID on December 10, 1990. The project has now been constructed and a public hearing regarding the assessment to property owners was held on January 5,1993. Minutes taken by the Hearings Officer at the public hearing are attached to these Findings and Recommendations as Exhibit "1". As indicated in the Minutes, considerable testimony from property owners was received at the Hearing to the effect that the construction of the sound barrier wall had done little or nothing to reduce the noise from Beltline .Road. At the request of the Hearings Officer, the City Engineer sought follow-up sound studies in order to determine the extent of sound reduction, rather than simply rely an antidotal evidence. The Oregon Department of Transportation conducted such a study which is attached as Exhibit " 2". From Exlu~bit 2's bndings, it appears that some sound reduction was achieved at all locations behind the wall varyuag from SdBA at the west end of the wall to lOdBA at the east end. The Hearings Official also notes that the number of automobiles using Beltline Rooad were noticeably higher in the follow up study, suggesting that the relative noise reduction might even be greater. In other words, it would seem that if traffic along Beltline Road has increased in the three years between the original and follow up studies to the extent indicated in Exlu~it 2, then the properties may have benehitted even more than would seem apparent. However, the Hearings Official was unfamiliar with decibel studies and whether reductions of 5 to 10 decibels were really si~cant. The City Engineer presented the Hearings 4fliclal with Exhl~it "3", attached hereto, which explains the logarithmic nature of the decibel scale. This further suggests that the sound reduction behind the sound barrier wall has been significant. _1_ SPECIFIC ISSUES RAISED AT PUBLIC FEARING 1. Two Tiers vs. Three Tiers. As noted in the minutes, several property owners painted out that they had understood previously that three tiers of houses would be identified far assessment. Because two tiers of houses are actually scheduled far assessment, they felt that their respective assessments were inappropriately high. The City Engineer provided the Hearings Df~icial with two letters dated December 21,199 Exhibit 4}, which includes the mailing list, and July 24,199o with the mailing list. Exhibit 5} Both of these letters make clear that only two tiers of houses will be assessed. The Hearings Qfhcial finds that adequate notice was provided to interested parties concerning the two-tier approach to assessment. 2. Assessment of the Collins' Property. Both at the hearing for the formation of the LID and the hearing regarding assessments, Mr. Bob Collins objected to his placement within Tier I. The Hearings Dfbcial conducted a visual inspection of Mr. Collins' property following the hearing for the formation of the LID. The recommendation submitted to the City Council was for inclusion of the Collins property in Tier I. The City Council adopted that recommendation. The Hearings Dfhcial remains of the view that the Collins property is more similar in location to the other houses designated in Tier I than those which are in Tier II. Mr. Collins also testified at the assessment public hearing that he agreed to the idea of the project because he thought it would reduce the sound level at his home and felt lured into the project. The City Engineer provided the Hearings Dfl"icial a copy of the Petition far Improvement received on July 19,1958. The approval of neither Mr. Collins nor his wife appears on the document. Therefore, the Hearings aff"icial beds that Mr. Collins was not "lured" into the project, because he never joined in the petition for the construction of the wall. S Y AND RECCMMENDATIaN The follow up sound study indicates that a noticeable reduction of sound has been achieved. while the effected property owners might have wished for a greater reduction than they perceive, that needs to be balanced against the apparent increase in trafl~c along Beltline Road over the last three years. The nature of the decibel scale suggests that the reduction is greater than might have been perceived. It further appears to the Hearings Official that because of the intergovernmental agreement and the resolution of the City Council which approved this project, there is little or no _2~ alternative to the assessment scheme provided by the City Engineer. The property owners requested that a sound wall be constructed. It has achieved some noticeable sound reduction and they should be assessed their relatively modest proportion in light of the over all cost. Finally, it is the bnding of the Hearings Official that the proposed project is one for which the assessments are for a local improvement as set forth in QRS 310.140 because: 1. The assessments do not exceed actual costs; 2. The assessments are imposed for a capital construction project which provides a specibc benebt to a specific property or rectifies a problem caused by a specific property; 3. The assessments are unposed in a single assessment upon completion of the project; and 4. The assessments allow the property owners to elect to pay off with interest over at least l0 years. Therefore, it is the recommendation of the Hearings Qfhcial that the City Council adapt a resolution Imposing the assessments as determined by the City Engineer.
