CONTRACT 92..6} _. The City Council of the City of Eugene finds that: On June 1~, 1993 Ordinance No. 19920, "AN ORDINANCE LEVYING ASSESSMENTS FOR PAVING, SIDEWALKS, CURB AND GUTTERS, STREET LIGHTS AND STORM SEWERS ON GOODPASTURE ISLAND ROAD 200D-FEET NORTH OF VALLEY RIVER DRIVE T0~425-FEET NORTH OF KINGSLEY STREET; AND DECLARING AN EMERGENCY. CONTRACT 92-26}, " was enacted. It has been determined that an error was made in the calculation of 22 of the assessments. Based upon their percentage of unit ownership, 11 parcels were under-assessed and ll were over- assessed. The total dollar amount erroneously allocated is $539.40. The expense of giving new assessment notices, conducting another hearing on the increase, re-imposing corrected assessments and processing new applications for installment payments does not make it cost effective to correct the assessments for those parcels that were under assessed. Therefore, the city shall bear the cost of the under-assessments. Under Section 7.230, Eugene Cade, 191 SEC}, the assessments far the ll parcels that were over-assessed should be corrected and notice of the correction given to the affected property owners. the owners of the affected parcels far which the assessment nas already been paid shall receive a refund and an adjustment shall he made to the assessment account for the parcels where the owners have elected to pay the assessment in installments. THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. Based on upon the above findings, which are hereby adopted, the assessment on the Assessment Roll attached as Exhibit "C" to Ordinance No, 19920, far the following parcels are amended to the amount shown opposite each parcel, as follows: Tax Lot Na. The finance office is directed ta: Z.l Correct Exhibit "A" of Ordinance No. 19920 by increasing the amount reflected in city paving by $539.40 plus $5.13 in interest, and correct the specific assessments in Exhibit "C" of Ordinance No. 19920 as set forth in Section l of this Ordinance; Z.Z Correct the docket of city liens consistent with this ordinance; and - ORDINANCE - 2 2.3 Send a notice of the reduced assessment to the owners .of the affected property. Send notice as required by EC 7.230 to the current owners of affected parcels accompanied by a refund check to the owners where the assessment was paid in full, or accompanied by notice of a credit applied to the assessment accounts for the parcels where the. owner elected to pay the assessment in installments and there remains an unpaid balance. If the application of a credit results in aver-payment of a n assessment account, the excess shall be returned to the current owner of the parcel unless the owner is delinquent in the payment of another special benefit assessment. if the owner is delinquent, the excess credit shall be applied to the delinquent account, provided, however, that such payment shall not cure any delinquency or cause prevent the City's pursuit of any remedy it may have to collect the delinquency. Section 3. Except as herein specifically amended, all other provisions of ordinance 19924 and the assessments provided for therein remain in full force and effect . Section 4. That the matters contained herein affect the public welfare and safety and therefore, an emergency is hereby declared to exist, and this ordinance shall became effective immediately upon its passage by the City Council and approval by the Mayor, retention by the Mayor for mare than ten days, or readoption over a mayoral veto by two-thirds of all members of the Council.
