AN ORDINANCE AUTHORIZING THE INSTITUTION OF
PROCEEDINGS IN EMINENT DOMAIN FOR THE
ACQUISITION OF PROPERTY INTERESTS EAST OF
ORR LANE AND SOUTH OF 23RD AVENUE FOR THE
PURPOSE OF ACCESSING AND MAINTAINING STORM
DRAIN FACILITIES.
The City Counci ~ of the C1 ty of Eugene finds that
The City Council has authority under provi s7 ons of the City Charter
and applicable state 1 aw to institute proceedings i n eminent domain for the
acquisition by condemnation of private property for public purposes , including
rights of access to provide for maintenance of city drainage facilities.
Under the City's Storm Drainage Master Plan and the Public Works
Maintenance Division Storm Sewer Maintenance Policy, the City routi nely mai ntai ns
several natural waterways and storm sewer inlets . This maintenance service i s
provided i n the Public's interest to assure that the storm sewer systems are
properly maintained to allow cal 1 ecti on , channeling and disposition of the storm
water to avoid flooding of adjoining properties . Each year heavy rains and
runoff have caused a storm sewer inlet grate 1 acated near the end of Orr Lane to
plug with debris . The resultant flood? ng has required Public Works Maintenance
personnel to c1 ear the grate ante or twice per year.
Having 1 egal and ready access to the storm sewer i n1 et east of orr
Lane and south of 23rd Avenue wi l 1 enhance the City's obi 1 i ty to plan and
schedule equipment and staff needed for routine and emergency maintenance.
With the seasonal rainy weather approaching , increased storm water
runoff wi l 1 create the need for adequate maintenance for the i n1 et , requiring the
City to act promptly to acquire the necessary property interests far the access
easement . Alternative sot uti ons have been reviewed , however , the existing system
i s most e~ecti ve given the setting and overall community cost .

NOW, THEREFORE , THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS
Section 1, Based upon the above findings , which are incorporated
herein by reference and hereby adopted , the City Counci 1 of the City of Eugene
does hereby find, dec1 are, and determine i t necessary to acqui re a drai Wage
easement over a portion of the parcel of real property more particularly
described on Exhibit "A'~ attached hereto and incorporated herein by reference in
order to provide 1 egal access to the storm sewer i nl et for proper maintenance and
repair .
Section Z . The City Counci 1 does hereby direct that the City of
Eugene steal 1 institute negotiations with the affected property owner to acquire
needed access rights and institute praceedi ngs i n eminent domain for the
candemnati on of the property interest described i n Section 1, and , at 1 east
twenty ~~4~ days prior to the filing of any action for condemnation to make a
written offer to the owners or parties having an interest therein of a stated
amount as compensation therefore and for any compensabl e damages to remaining
property ,
Section 3 . The City Counci 1 further directs that the City Manager
shat 1 obtain for the City immediate possession of real property interests
described i n Section 1 i f negoti ati ons wi 11 delay needed maintenance of the
affected facilities.
Section 4. The City Counci 1 hereby declares that the actions set
forth above are for a publ i c purpose, are necessary far the public welfare, are
the most compati bl e wi th the greatest public goad and the 1 east private injury ,
and are authorized under the 1 aws of the State of Oregon and Charter and
ordinances of the City of Eugene.
Section 5. The City Council further declares that the real property
interest described i n Secti on I steal 1 be used by the City of Eugene for publ i c
ardi Hance - ~
purposes as needed and, i n any event, no ~ ater than ten years fror~ the date thi s
ardi Hance i s adopted by the Caunci i and approved by the Mayor .

Range 4 West of the Willamette Meridian, Lane County, Dregan, thence South 2357.8
feet to a point, thence South S9° 20' East 354.0 feet to a point being the true point
of beginning and the Northeast corner of this easement, which is on the West
boundary of Noll's Plat as platted and recorded in Book 43, Page 14 of Lane Caunty
Oregon Plat Records, thence South along said West boundary 14.04 feet, thence
