HomeMy WebLinkAboutOrdinance No. 19944ORDINANCE N0. 1 ~~ ~~ AN ORDINANCE AUTHORIZING THE INSTITUTION OF PROCEEDINGS IN EMINENT DOMAIN FOR THE ACQUISITION OF PROPERTY INTERESTS IN GLEN- WOOD FOR THE PURPOSES CONSTRUCTION OF SANITARY SEWER IMPROVEMENTS. The City Council of the City of Eugene finds that: The City Council has authority under provisions of the City Charter and applicable state 1 aw to institute proceedings i n eminent domain for the acquisition by condemnation of private property for public purposes , including the construction maintenance of sanitary sewers. The City of Eugene i s i n the process of designing sewers for the Gl enwoad Area i n conformity with the Sanitary Sewer Master Plan . On March 1, 1993, the Counci 1 approved the '94 fiscal year Capital Improvement Projects ~CIP~ which included the design of the Glenwood sanitary sewer/pump station and acquisition of needed rights -of -way . The proposed improvements shall be in compl lance with, and in furtherance of , the plans and specifications to be prepared by the City Engineer i n accordance with provisions of Chapter 7 of the Eugene Code, 1911, and applicable pot i ci es of the City of Eugene . In determining the 1 ocati on of the easements and rights-of-way to be acquired, consideration was given to avoiding existing structures and nature trees ; to minimizing the costs of constructing, maintaining and operating the proposed sanitary sewer improvements ; to minimize disruption to existing vacant areas that could develop i n the future by 1 ocati ng the easements a1 ong 1 of lines or i n private ways of ingress and egress ; and to selecting 1 ocati ons for the proposed sanitary sewer that were the most direct, thereby reducing the costs of construction . Rather than disrupt existing street, curb, gutter and si dewal k improvements and the public uti 1 i ti es therein , to the extent practi ca 1, the acquisition of the proposed easements are outside the existing rights-of-way i n a 1 ocati on that wi 11 preserve existing pubs i c improvements and reduce the cost of the proposed sanitary sewer improvements . The public good from the sanitary sewers far outweighs any damage whi ch a property owner might sustain parti cut arty i n 1 i ght of the City' s ob1 i gati on to provide just compensation to the affected property owners and the City's e~ecti veness to keep the cost of sanitary sewers and possi b1 e assessments therefor as modest as possi b1 e. The costs of delaying the project and the savings from e~ici ent construction management techniques require the City to act promptly to acquire the necessary property interests for this project. Now, therefore, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. Based upon the above findings , which are incorporated herein by reference and hereby adopted , the City Counci 1 of the City of Eugene does hereby find , declared , and determine i t necessary to acquire certa i n easements or right-af -way interests i n portion of the parcels of real property more particularly described on Exhibit "A" attached hereto and incorporated herein by reference i n order to construct the sanitary sewer improvements i n Glenwood i n accordance with the design to be prepared by the City Engineer and approved by the City Manager. Section 2. The City Counci 1 does hereby direct that the City Manager or the manager's designee steal 1 institute negotiations with affected property owners to acquire needed property and institute proceedings i n emi Went domai n for the condemnation of the other real property interests described in Section 1, and , at 1 east twenty ~~0 } days prior to the filing of any action for condemnation to make a written offer to the owners or parties having an interest therein of Ordinance - 2 a stated amount as compensate on therefore and for any compensatl e damages to remaining property . Section 3. The City Counci 1 further directs that the City Manager shat 1 obtain for the City immediate possession of real property interests described i n Section 1 i f negate ate ons wi 11 delay the canstructi on of the described improvements . Section 4. The Ce ty Counci 1 hereby declares that the improvements set forth above are for a publ i c purpose, are necessary for the publ i c wel fare, and are authorized under the 1 aws of the State of Oregon and charter and ordinances of the City of Eugene . Section 5. The City Counci 1 further declares that the rea 1 property interests described i n Secti on ~ shal 1 be used by the City of Eugene for publ i c purposes at the earliest passe bl e date and, i n any event , no 1 ater than ten years from the date this Ordinance i s adopted by the Counci 1 and approved by the Mayor.
