HomeMy WebLinkAboutOrdinance No. 19979ORDINANCE NO. 1~~2 7 AN ORDINANCE CONCERNING MU-~V WHITEAKER MILD USE DISTRICT FUR PROPERTIES LOCATED IN THE V~HITEAKER NEIGHBORHOOD; REPEALING ORDINANCE NO. 19834; AND DECLARING AN EMERGENCY THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS; Section 1. Descri tlon and Pur one. The purpose of the MU-W Whiteaker Mixed- Use .District is to encourage the economic vitality of the area for industrial, institutional, and commercial uses while also allowing a mix of residential dwellings. The district will have a broader range of permitted uses than found in any of the existing Eugene zoning districts. No single use will be mandated or required within the area and the district will encourage both a mixture of uses within a building as well as within a block. The mix of land uses and increase in residential density and employment opportunities is designed to provide a place for people to live and work in the same area. The district is intended for application to an area that historically developed primarily with single family homes and small apartments. Zn the early 19oos the area began to develop with industrial uses largely due to the influence of the Southern Pacific Railroad. ~n i94S, the area was predominately zoned for light-medium industrial uses. The area is currently characterized by a diversity of uses, including industrial, commercial, institutional and residential. tt is intended that the character of the district develop so that the diversity of uses are enhanced and tied together with various forms of usable public and private open space where there is pedestrian-oriented activity, Appropriate intermingling of structures, street amenities, and major landscape features will be necessary in order to integrate older development with newer development. Development within the district will occur incrementally over time and the district will help ensure a coordinated effort is undertaken to improve the area by the public and private nectars. The MU-W Mixed Use Whiteaker District is also designed to: ~a} Encourage the continued economic vitality of existing and redeveloped commercial and industrial uses with recognition of their role in providing a needed diversity of land uses and job opportunities. fib} Encourage an increase in residential density to create additional opportunities for people to live close to major employment areas. ~c} Encourage actions that will enhance the attractiveness of the area and ordinance - 1 ~ 05/23/94 increase the use of major landscape features that can help tie the public and private open spaces together. ~d} Encourage the preservation, rehabilitation, and restoration of significant historic structures and retention of older, mature street trees. The area's location near the downtown, central bus terminal, and numerous bicycle paths and routes could lead to decreased usage of the automobile. The district is not intended for uses that promote or favor the use of the automobile, particularly for commercial and residential uses, Drive-in and drive-through facilities, such as those associated with a fast food restaurant, shall be prohibited so that the land use pattern can further support the use of alternatives to the automobile. This does not mean that businesses that require automobile parking are prohibited or discouraged. These district provisions are not meant to exclude businesses that address the maintenance of the automobile such as an auto upholstery outlet or auto repair shop. 'Where a conditional use permit process is required by the Eugene Code, 1971, give special attention to the potential noise emissions or other environmental qualities that could influence the livability and economic vitality of the area. 5ectian 2. Permitted Buildin s and Uses. In this MU-V~ District, the following categories of buildings and uses are permitted as a matter of right, subject to the provisions of this ordinance and the Eugene Code, 1971. A change in the use of a building may require building modifications to address building code and fire and life safety requirements. Industrial Uses (a~ Industrial uses as permitted in the I-2 Light-Medium Industrial District under applicable provisions of Chapter 9 of the Eugene Code, 1971, except for the following uses: heavy equipment, truck and tractor sales, RV and manufactured dwelling sales. Residential Uses fib} Dwelling units: 1. Attached and detached single-family dwellings and single-family accessory unit. 2. Duplexes. 3. Multiple-family dwellings. 4. Rooming and Boarding Houses. ~c} Home occupations, subject to applicable provisions of Chapter 9 of the Eugene Code, 1971. (d) Bed and breakfast facilities. Electrical substations, gyp} Uses with similar operating characteristics and external impacts as the uses described in this MU_~ ordinance. The city manager or designee shall determine if uses similar to the above in terms of district intent, operating characteristics, building bulk and size, parking demand, customer types, and traffic generations are to be permitted, permitted conditionally, or prohibited in the district. ~q} Accessory buildings and uses normal and incidental to the uses permitted in this MU-w ordinance, Section 3. Develo ment Standards. Except as provided in Subsections ~5} to X13} of this Section, the "General Provisions: Height, Yard, Area, and Coverage Regulations, Conditions and Exceptions; Special .Setback Requirements; off Street Parking Requirements" set forth in Chapter 9 of the Eugene Code, 1971, shall apply within this MU- w District. In the event of a conflict between the general provisions in Chapter 9 of the Eugene Code, 1971 and the provisions set forth in this Section, the specific provisions of this Section shall prevail. ~1} Residential Standards. Except as provided in Subsections ~5} to X13} of this Section, all residential development shall be governed by the general provisions as applied to the C-~ General Commercial District in Chapter 9 of the Eugene Code, 1971. ~2} Industrial Standards. Except as provided in Subsections ~5} to X13} of this Section, all industrial development shall be governed by the general provisions as established in the I-~ Light-Medium Industrial District in Chapter 9 of the Eugene Code, 1971. ~3} Commercial and Professional Gffice Standards. Except as provided in Subsections ~5} to X13} of this Section, all commercial or professional office development shall be subject to the standards established far the C-2 General Commercial District in Chapter 9 of the Eugene Code, 1971. ~4} Mixed Use Standards. Mixed use development shall be subject to the least restrictive standards set forth in this section that are applicable to the project. Ordinance - 5 X5123194 ~5} Pam. Off street parking shall be provided in accordance with applicable provisions of the Eugene Code, 1971, including provisions for shared parking and parking within 1000 feet of the development site, except that there shall be no off street parking required for motor vehicles for up to six residential dwellings that are part of a mixed use development. ~6} Landscaping. At the time property adjoining a public right of way is developed or redeveloped, the curb strip landscaping shall be restored or implemented. An exception to the use of plant materials shall be made if the curb strip is providing another function for the public such as a bus stop shelter, secure bicycle storage area, or wider sidewalk. The use of benches or moveable planters are also encouraged in this area. Any permits required by provisions of the Eugene Cade, 1971 shall be obtained prior to such restoration or installation of benches or planters. ~7} He„~h~. Height limitations in this district shall not exceed 45 feet in height. Height limitations established in Chapter 9 of the Eugene Code, 1971, to protect the view to and from Skinner Butte, shall apply to those areas indicated therein. ~8} Street Trees. No street tree in the public right-of way within the district shall be removed without first securing from the city approval for the removal and the replacement of the tree according to adopted standards , ~9} Lot Area. Each lot or development site shall have a minimum area of 4,500 square feet, except far a duplex division lot created in accordance with the provisions of Chapter 9 of the Eugene Code, 1971, X10} Solar Access. Development in the MU-W District shall be exempt from the solar access requirements of the Eugene Code, 1971, X11} Sl n D~stnct. The provisions of the Industrial Sign District as set forth in Chapter 9 of the Eugene Code, 1971 shall apply within the MU-W District, except that additional restrictions may be imposed through site review. X12} Historic Marker Preservation. Development within this district shall not result in removal of the stone marker of Eugene Skinner's cabin. When the area south of Second Avenue, between Lawrence and Lincoln Streets, is redeveloped, enhanced opportunities for public viewing of the stone marker shall be provided. (13) ~rc~-4th (~nnnector Prior to new development along the 3rd-4th connector the city engineer may include requirements such as, but not limited to, public right of way dedication and realignment, street improvements, and sidewalks, Section 4. Interpretation. References in this Ordinance to a provision of the Eugene Code, 1971 shall be interpreted to be a reference to the provision or successor provision as ordinance - d 45/23/94 it exists at the time it is being applied or interpreted. Section 5. Rem. Ordinance No. X9834 is repealed as of the effective date of this ordinance. Section 6. That the matters contained herein concern the public welfare and in order to insure the orderly implementation of the provisions hereof an emergency is hereby declared to exist, and this Ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor retention by the mayor for over ten days, ar readoption over a mayoral veto by two-thirds of all members of the council.
