Home My WebLink AboutOrdinance No. 19981ORDINANCE NO. ~ ~~ ~~ An Ordinance vacating a portion of the following described street, to-wit: A portion of ~Villagillespie Road right-of-way which is approximately 25 feet wide, beginning at the intersection of Abbie Lane and extending approximately 475 feet in a northerly direction, and mare particularly described in Exhibit A hereto. School District 4-J, SV 94-001) RESERVING herein a public utility easement over, under and across the above described property and the right to enter thereupon for the purposes of construction, reconstruction, maintenance and repair. Gn the 1st day of August, 1994, the City Council of the City of Eugene by Motion duly passed, called a public hearing to be held at 7:30 p.m., Pacific Time on the l2th day of September, 1994, at the Council Chambers at City Hall, Eugene, Oregon, at which time and place protests and remonstrances could be heard as to the proposed vacation of a portion of the above described street. Notice was duly and regularly given of the hearing and at said time and place the Council heard all objections to the proposed vacation. All .persons awning property abutting the portion of the street to be vacated have consented to the vacation and applied for the same. THE CITY aF EUGENE DOES ORDAIN AS FOLLQWS: Section 1. The City Council of the City of Eugene finds that due and regular notice of the hearing was published and posted as by law required, and no valid objections were made at the hearing or filed. The consent of the owners of the abutting property has been duly and regularly filed in the proceedings and the public interest will not be prejudiced by the vacation of a portion of the street. Section Z. The hearing was held on the 12th day of September,1994 at 7:3o p.m., Grdinance -1 Pacific Time, at the Council Chambers, City Hall, Eugene, Lane County, Oregon, and all matters necessary to be done in the premises have been duly and regularly completed. Section 3. The hereinabove described portion of street is hereby vacated, and the portion of the street so vacated shall revert pursuant to the statutes of the State of Oregon. Section 4, The City Recorder is hereby directed to file a certified co of this pY Ordinance with the Recorder of Lane County, Oregon, together with a map or plat of said property, and a certified copy of this Ordinance shall be filed with the Lane County Assessor and another certified copy shall be filed with the Lane County Surveyor. This section of the right-of way is not being used for the traf'f<c flow of willagillespie Street. The new alignment for the street is to the west with the easterly curb and sidewalk being westerly of the portion being requested for vacation. Sewer, water, electrical, gas, telephone and telegraph, pipes and lines, and other utilities lie within the area being requested for vacation. The easement for the placement, construction, repair, etc., of these utilities will be conveyed to the City of Eugene with the Conveyance of Utiility Easement document. This document will be filed at the time of request for vacation. The Public 1Norks Department for the City of Eugene has no plans for widening the existing traveled portion of the street to the east. There are no plans for a lane configuration change in the area.
