AN ORDINANCE CONCERNING THE VIDEO DISPLAY
GAMBLING DEVICE TAB; AMENDING ORDINANCE NO.
19980 TO PROVIDE AN EFFECTIVE DATE; AND
DECLARING AN EMERGENCY.
The City Council of the City of Eugene finds that:
A. Ordinance No.1995owas passed by the Council and approved by the Mayor
on September 12,1994 establishing a video display gambling device tax. That Ordinance did
not contain an emergency clause, and pursuant to the City Charter and Eugene Code, 19? 1
would became effective on October 12,1994.
B. A referendum petition is currently being circulated to refer ordinance No.
19950 to the electors of the City, and the Council finds it is in the public interest to provide
an effective date of November 1, 1994 for Ordinance No. 19950 and the tax established
therein in order to provide circulators of the petitions 30 days within which to gather
signatures.
Now, therefore,
THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS:
Section 1. Based on the above findings, which are adopted herein, Ordinance No.
19950 passed by the Council and approved by the Mayor is amended to provide that the
Ordinance, and the tax established therein shall become effective on November 1,1994.
Section 2. Pursuant to the provisions of Section 2.971 of the Eugene Code, 1971, a
completed referendum petition to refer ordinance No.19950 to the electors of the City must
be filed with the City Recorder no later than 5:00 p.m. on October 31,1994.
Section 3. In the event a completed referendum petition is filed and certified, the
effective date for imposition of the tax as set forth in Ordinance No. 19980 as amended
herein, shall be postponed pending the action of the Council pursuant to Section 2.950 of
the Eugene Code, 1971 or the election held pursuant to Section 2.951 of the Eugene Code,
1971.
Section 4. The City Recorder is requested administratively to change the reference
to October 1, 1994 set forth in Section 3.702 as adopted by Ordinance No. 19950 to
November 1,1994.
Section 5. Notwithstanding any contrary provision of the Eugene Code, 1971, no

provision of this ordinance shall be construed to invalidate any signature on the referendum
petition currently being circulated to refer ordinance No.1998o to the electors of the City.
Section b. That the matters contained herein concern the public welfare and
therefore, an emergency is hereby declared to exist, and this ordinance shall become
effective immediately upon its passage by the City Council and approval by the Mayor,
retention by the Mayor for more than ten days, or readoption over a Mayoral veto by two-
thirds of all members of the City Council.
