HomeMy WebLinkAboutOrdinance No. 19992ORDINANCE NO.~~ A SPECIAL ORDINANCE G G A LIMITED EXEMPTION TO THE APPLICATION OF EUGENE CODE, 1971, SECTIONS 2.019, 4.GS0 AND 4.515; PROVIDING FOR AN AUTOMATIC REPEAL AS OF DUNE 10, 1995; AND DECLARING AN EMERGENCY. The City Council of the City of Eugene finds as follows: A. In recognition of its awareness of the severity of problems facia homeless ... g persons vv~th~n the City, the City Council has ~n~t~ated and supported measures directed towards the alleviation of those conditions, including adoption of ordinance No. 19942 on November 22, 1993 to permit homeless persons to camp on a tempara basis and for a . ~ limited period of time ~n a designated portion of Alton Baker Park. It would be in the public interest and further City Council policies to a ain g grant a l~m~ted and unique exception to the enforcement of EC Sections 4.6$U 2 and 4.$15 ~} for a designated portion of Alton Baker Park. This limited exception should not be construed to serve as a precedent far future exceptions, nor interfere with the continued enforcement of EC Section 4.$15 in other portions of the City. NOW THEREFORE, THE CITY OF EUGENE DOES ORDAIN AS FOLLOWS: Section 1. The findings set forth above are adapted. Section 2. Notwithstanding Sections 4.6$U~2} and 4.$15 of the Eugene Cade, 1971, the City Manager shall designate an area within the three western-most arkin ba s of the P g Y wISTIC1Alton Baker parking area to be used by Nameless persons for car or tent cam in . . Section 4. The authority granted under this ordinance shall terminate as of 12:00 noon on May 31, 1995, unless the City Manager extends the termination date for u to an .. P add~t~onal ten days, ~n which case the authority shall terminate not later than 12:00 o'clock roan on June 1,1995. 1n na event shall a person camp at any of the designated sites after the authority terminates. Section 5. This ordinance automatically shall be repealed on June 10,1995. Section 6. That the matters contained herein concern the public health, welfare and safety and therefore, an emergency is hereby declared to exist, and this ordinance shall become effective immediately upon its passage by the City Council and a royal b the PP Y Mayor, retention by the Mayor for more than ten days, or readoption over a ma oral veto Y by two-thirds of all members of the City Council.
