Home My WebLink AboutOrdinance No. 20005ORDINANCE NO. ~ao~S AN ORDINANCE AUTHORIZING THE INSTITUTION OF PROCEEDINGS IN EMINENT DOMAIN FOR THE ACQUISI- TION OF PROPERTY INTERESTS ALONG AMAZON CREEK BETWEEN BELTLINE ROAD AND SOUTHERN PACIFIC RAILROAD AT TERRY STREET, FOR THE PURPOSES OF CONSTRUCTION AND MAINTENANCE OF DRAINAGE CHANNEL AND BIKE/PEDESTRIAN PATH IMPROVEMENTS (JOB #2921). The City Council of the City of Eugene finds that: The City Council has authority under provisions of the City Charter and applicable state law to institute proceedings in eminent domain for the acquisition of private property for public purposes, including the improvement and maintenance of city drainage canals and bicyclelpedestrian paths. By Council adoption of the City's Capital Improvement Plan the City of Eugene initiated the acquisition of property along Amazon Creek interests for the continuing operation and maintenance of drainage channels and other features. The public's property interest in the present right-of way containing the Amazon Creek Channel} is clouded. Because of the need to clarify the City's right to maintain the Channel, to enhance the Channel's carrying capacity as a drainage facility and to put the right-of way to other public uses, including plans for bicycle and pedestrian paths, the City needs to clarify its property rights in the Channel's right-of-way and to purchase addition rights-of-way as needed. Enhancing the Channel and using it to implement the Bicycle Element of the Eugene-Springfield Metropolitan Area Transportation Plan avoids having to purchase other right-of-way for additional drainage facilities and bicycle facilities in other parts of the community. Such alternate acquisitions would be unduly disruptive to already developed private property in the drainage and transportation corridors which the Channel right~of-way serves. Further such acquisitions would require substantially mare public dollars than the acquisitions herein approved, Any proposed improvements shall be in compliance with, and in furtherance of, plans and specifications to be prepared by the City Engineer in accordance with provisions of Chapter 7 of the Eugene Code, 1971, and applicable policies of the City of Eugene. Extending the Fernridge Bike path at this time is necessary to serve the community and to continue compliance with the Bicycle Element of the Eugene-Springfield Metropolitan Area Transportation Plan. The cost of delaying the acquisition prof ect, the savings from efficient management techniques, the need to facilitate the safe and efficient movement of bicyclists and pedestrians, and to meet the federal grant conditions for const~.iction, requires the City to act promptly to acquire the necessary property interests for this prof ect. NGW, THEREFGRE, THE CITY OF EUGENE DOES GRDAIN AS FGLL4WS: Section 1. Based upon the above findings, which are incorporated herein by reference and hereby adopted, the City Council of the City of Eugene does hereby fznd, declare, and determine it necessary to acquire certain ownership interests in portions of the parcels of real property more particularly described on Exhibit A attached hereto and incorporated herein by reference in order to properly maintain and enhance improvements to Amazon Creek between Beltline Road and Southern Pacific Railroad near Terry Street including drainage enhancements, maintenance access, public bike and pedestrian path improvements and other features. All to be constructed in accordance with plans and designs prepared by the City Engineer and approved by the City Manager. Section 2. The City Council does hereby direct that the City of Eugene shall institute negotiations with affected owners to acquire needed property and institute proceedings in eminent domain for the acquisition of real property interests described in Section 1, and, at least 2a-days prior to the filing of any action for condemnation to make a written offer to the owners or parties having an interest. Section 3. The City Council further directs that the City Manager shall obtain for the City immediate possession of real property interests described in Section 1, if negotiations will delay the construction of the described improvements. Section 4. The City Council hereby declares that the improvements set forth above are for a public purpose, are necessary for the public welfare, are the most compatible with the greatest public good and the least private injury, and are authorized under the laws of the State of Oregon and Charter and ordinances of the City of Eugene. Section 5. The City Council further declares that the real property interests described in Section 1 shall be used by the City of Eugene for public purposes at the earliest possible date and, in any event, no later than ten years from the date this Ordinance is adopted by the Council and approved by the Mayor.
