STORM AND SANITARY SEWERS ON WAGNER STREET FROM MANGAN STREET 8 0 0 ~-FEET WEST; AND DECLARING AN EMERGENCY . ~ CONTRACT 9 4 - 3 4 } ~ JOB # 3191 } The City Council of the City of Eugene finds that: Cn the 6th day of January, 1994, as authorized in Subsection 7.160 ~ 8 } , Eugene Code, 1971 SEC} the City Engineer initiated the proposed local improvement consisting of paving, curbs, gutters, walkways, storm and sanitary sewers and Eby agreement with the affected property owners} water lines and power service on Wagner Street from Mangan Street 800-feet west. After due notice and a public hearing thereon before the hearing official, and no remonstrances having been filed, on the 11th day of July, 1994, the City Council formed the local improve- ment district and authorized construction of the local improvement. The actual cost of the local improvement is ascertained to be $271,370.93 and the amounts to be assessed to and borne by the specially benefitted property and to be borne by the City or others has been determined in accordance with applicable provisions of the Eugene Code, 1971 and as set forth in Exhibit A attached hereto and incorporated herein by reference. The City Council has established the method of calculating local improvement assessments in E.C. 7.170 and 7.175. A notice containing the information required by E . C . 7 ,185 has been posted on a bulletin board at City Hall and given by certified mail to the owners of the parcels of real property subject to the assessment more than ten days prior to the public hearing before the hearing official. At the time and place specified therein, a hearings official heard all evidence and argument presented, and no remonstrances having been filed, has fully considered the same, and has reported his or her adopted findings to the City Council. The Council has reviewed and considered the assessment report of the City Engineer and Finance officer and the hearings offi- cial's findings and summary of the hearing, and based thereon, THE CITY of EUGENE DOES ORDAIN AS F4LLOW5: ,~ectiQn 1. The Summary of the hearing conducted by the hearings official are hereby made apart of the Council' s record in these proceedings, and the hearings official's findings, including those regarding compliance with E.C. 7.16Q to 7.19, and the agreement with the affected property owners attached hereto as Exhibit B and incorporated herein by reference, are hereby adopted. ~~ction 2. The actual cost of the local improvement compris- ing of paving, curbs, gutters, walkway, storm and sanitary sewer $271,37Q.93 of which $251,60.89 is hereby assessed against the parcels of property hereinafter described in the amounts set opposite, respectively. Sg„ i n The City Council does hereby determine and assess each lot and part of lot being within the described local improve- ment district as set forth on the assessment roll attached as Exhibit C hereto and incorporated herein by reference. ~ction,~4. The City Council does hereby determine that each parcel of land or lot hereinabove described is specially benef fitted to the extent of the assessment set forth. The Finance Officer ORDNANCE - 2 shall give notice of the assessments to the owners of the assessed parcels advising them the assessment may be paid in full, without interest, within ten days of the effective date of this ordinance. Assessments that remain unpaid after the ten day period are declared to be liens upon the respective lots, parts of lots or parcels of land against which said several amounts are assessed, and may be paid, with interest on the unpaid principal amount commencing ten days after the effected date of this ordinance: 4.1 In up to twenty semi-annual installments, including principal and interest at the rate set by the City Manager as provided in E.C. 2.022 through 2.024. 4.2 If the property owner so elects, in l20 monthly install- menu, including principal and interest at the rate set by the City Manager as provided in E.C. 2.D22 through 2.024 plus a service charge to be determined by the City Manager as provided in E.C. 2.020. ~~ction 5. The City Recorder is directed to enter in the docket of City Liens a statement in connection with each unpaid assessment containing the following: 5.1 A description of each lot, part of lot or acreage specially benefitted by the local improvement; 5.2 The name of the owner or reputed owner thereof, that the name of the owner is unknown; and 5.3 The sum assessed upon said property, the amount and date from which interest accrues, and the date of entering the same in the docket of City Liens. ORDINANCE - 3 Sec~„,Qr~. Upon enactment of this ordinance, the City Finance Officer shall send notice of the assessments by first class to the owners of the assessed parcels containing the information required by E.C. 7.194 and enclose therewith an application for paying the assessment in installments according to the terms set forth in Section 4 of this ordinance. Sect~r~,,~ 7 . Any assessment remaining unpaid and for which no application for installment payments has been received may be foreclosed as provided by law. The proceeds from the payment or foreclosure of assessments levied by this ordinance shall be deposited to the city funds which advanced the cost of construc- tion, engineering and related expenses or which are used to retire any indebtedness incurred by the City far this improvement. ~,„i n .That the matters contained herein affect the public welfare and safety and therefore, an emergency is hereby declared to exist, and this ordinance shall become effective immediately upon its passage by the City Council and approval by the Mayor, retention by the Mayor for more than ten days, or readoption aver a mayoral veto by two--thirds of all members of the Council. The etitions p represented 55 percent support for the local improvement district. Based on the petitian, the City Engineer initiated the praject, as provided for in Eu ene Code . g 7.1608} on January 6, 1994 and the City Council formed the LID on July 11, 1994. The project has now been completed, and final assessment costs have been calculated. Wagner Street was platted as a street in 1980 within the Claret' Plat, 2nd Addition subdivision}, but it was never developed. The abutting property awners re nested that the ... q public facil~tres be constructed through the local improvement district SLID} process. The property owners also requested that water and electric service installation be included within the scope of the assessable costs, The City contracted with Eugene Water and Electric Board ~EWEB} to install these facilities. EWER billed the cost of the installations to the ci b tY Y lnvalce. P~~ The project included construction of a 28-foot wide street and a 35-foot radius cul-de-sac all i with associated curbs, gutters, walkways, sanitary and storm sewers. A ME F_ final Under City of Eugene assessment policy, 92.8 percent of the improvement costs will be distributed to the abutting property owners. The final assessment unit costs are listed below: 28-foot paving Sanitary sewer Sanitary service Storm sewer 5" Concrete (Walkway) Power (EWEB) Water (EWEB) Cost to City: $ 62.851front foot $ ~ .181square foot $ 495.151each $ .261square foot $ 319.641each $ 1,471.351each $ 1, 314.801each $ 19,768.04 The City Engineer determined that it would be most equitable to assess the cul-de-sac at a 28- footequivalent width as opposed to a 36-foot width. PAVING AND ASSOCIATED STREET IMPROVEMENTS ON WAGNER STREET FROM MANGAN STREET SOQ FEET WEST FINAL ASSESSMENT PAGE 1 P~jected At the hearing on formation of the Local Improvement District following the bid opening, the assessable unit casts listed below were quoted to property owners, based on the low bids received prior to construction: 28-foot paving $ 70.44/front foot 36-foot paving $ 90.56/front foot Sanitary sewer $ .22/square foot Sanitary service $ 542.55/each Storm sewer $ .32/square foot 5" concrete (walkway) $ 679.64/each Power (EWEB) $ 1,437.50/each Water (EWEB) $ 1, 812.50/each Cast to City: $ I1,566.55 Unit prices quoted in the poll letters ranged from $88.00 to $94.00 per front foot for paving, $4.I9 to $0.23 per square foot for sanitary sewers and $650 for sanitary sewer service. PUBLrC HFARIN The property owners were informed more than ten days in advance of the date of a scheduled public hearing on the final assessment. At least one person indicated an interest in attending the hearing. A hearing was scheduled, but no property owners or other interested persons appeared. No written testimony was submitted. The City Engineer submitted a report to the Hearings Officer Exhibit A} , FINDINGS AND RFCONIlV~NDAT ON Procedure The Hearings Official finds that notice of the public hearing was provided in accordance with the relevant provisions of the Eugene Code, and that all property owners were provided an opportunity to participate in the proceedings . Assessment of all Benefited Properties All properties within the local improvement district were benefited by the construction of the street and related improvements and all properties should be assessed the a ro riate amount . . , Pp P according to the provisions of the Eugene Cade. PAVING AND ASSOCIATED STREET IMPROVEMENTS ON ~VAGNER STREET FRGM MANGAN STREET 804 FEET WEST FINAL ASSESSMENT PAGE Z Nature of the Assessment The Hearings gfficer finds that the project is one for which the assessments are for local improvements as set forth in qRS 310.410 because 1. The assessments do not e~,ceed actual costs; 2. The assessments are imposed for a capital construction project which provides a specific benefit for a specific property or rectifies a problem caused by a specific property 3. The assessments are imposed in a single assessment upon completion of the project; and 4, The assessments allow the property owners to elect to pay the assessment with interest over at least ten ~ 10} years . Recommendation The final improvement costs are lower than quoted at the local improvement hearing and are comparable to projects of similar size. The EWEB powerlwater charges are less than originally estimated. The Hearings 4f~icial agrees with the recommendation of the City Engineer. The Hearings gf~~cial recommends approval of the assessment distribution. The Hearings gfficial also recommends that the City Council adopt an ordinance for assessment as set forth by the City Engineer.
