AN ORDINANCE AUTHORIZING THE INSTITUTION OF
PROCEEDINGS IN EMINENT DOMAIN FOR ACQUISITION
OF PROPERTY INTERESTS AT THE NORTHWEST
CORNER OF 2ND AVENUE AND CHAMBERS STREET
(MILLAND AND MCKEEGAN PROPERTIES) FOR THE
PROPOSED FIRE STATION NUMBER TWO AND
TRAINING FACILITIES.
The City Council of the City of Eugene finds that:
A. The City Council has authority under provisions of the City Charter and applicable state
law to institute proceedings in eminent domain for the acquisition by condemnation of
private property for public purposes, including uses associated with the operation and
maintenance of its Department of Public Safety.
B, The City of Eugene has developed the Fire Redeployment Plan to meet minimum response
times and provide necessary training facilities for the Department of Public Safety.
C. On September 19,1995 the Eugene electors approved the Fire Rede to ment Pro e Tax
P Y P ~y
Bond Measure to provide funding for the acquisition of property and construction of the
proposed facilities.
D. The adopted Fire Redeployment Plan identifies the need to construct new facilities to meet
minimum response times to emergency fire and medical calls. The acquisition of the
property described herein is in implementation of the Plan.
E. A study was completed by the Lane Council of Governments ~LCOG} to determine
availability of possible sites. 7n determining the location for the proposed facilities the
following criteria was studied: emergency response time, parcel size, access to the site,
land use suitability, and long-term flexibility. The property herein described is located at
2nd Avenue and Chambers Street meets the criteria.
F. To provide adequate land to construct the facilities described in the Fire Redeployment
Plan, the City must acquire additional land.
G. The majority of the land to be acquired by authorization of this ordinance is presently
vacant land that was part of the former saw-mill site. The smaller parcel on the immediate
corner includes an older hawse that is no longer being occupied. The properties are zoned
industrial.
H. The acquisition of these properties allows for the long-range development and operation
of the facilities consistent with the Fire Redeployment Plan. The extent of the private

disruption and injury caused by this acquisition of this property is minimal when compared
with the public need for and the benefit to be derived from the proposed fire station and
training facilities as per the Fire Redeployment Plan.
Now, therefore,
THE CITY ~F EUGENE D4E5 ORDAIN AS F~LLOwS:
Se~ i n 1. Based upon the above findings, which are incorporated herein by reference and
hereby adopted, the City Council of the City of Eugene does hereby find, declare, and determine
it necessary to acquire certain ownership in fee interests to the parcels of real property more
particularly described on Exhibit A attached hereto and incorporated herein by reference in order
to acquire land for the City of Eugene to be used for fire redeployment development. Such
acquisition minimizes disruption and injury to private property interests while affording a
significant public good.
i n 2. The City Council does hereby direct that the City of Eugene Manager or the
Manager's designee shall institute negotiations with affected property owners} for the needed
property interests, and shall institute proceedings in eminent domain for the condemnation of the
real property interests described in Section 1, and, at least 20 days prior to the filing of any action
for condemnation to make a written offer to the owners or parties having an interest therein of a
stated amount as compensation therefor and for any compensable damages to remaining property.
c r n The City Council further directs that the City of Eugene shall obtain
immediate possession of the real property interests described in Section 1 if negotiations will delay
the longWrange design, development and operation of the proposed facilities and implementation
of the Redeployment Plan.
i n 4. The City Council hereby declares that the improvements above set forth are
for a public purpose, are necessary for the public welfare, and are authorized under the laws of
the State of Oregon and Charter and ordinances of the City of Eugene.
i n The City Council further declares that the real property interests described in
Section t shall be used by the City of Eugene for public purposes at the earliest possible date and,
in any event, no later than ten years from the date this Ordinance is adopted by the Council and
approved by the Mayor.
